Thomas Eugene Tompkins, 67, of the 1000 block of Ellendale Drive was sentenced last week in Jackson County Circuit Court to three years probation. If he violates any terms of his probation, he will be sent to prison for three years. "You'll have 36 months hanging over your head. It's a lot of time," said Judge Kelly Ravassipour. Conditions of his parole include restrictions on his use of computers and other technology. He cannot have unsupervised contact with minors and must register as a sex offender. Tompkins admitted in court he duplicated five visual recordings of sexually explicit conduct involving children in 2011 and disregarded the fact that creation of the recordings involved child abuse. One of the five recordings purported to show a girl in Brazil, while another encouraged incest, according to court records. Defense attorney Donald Scales said Tompkins has a well-documented history of severe, crippling mental health issues and is undergoing treatment. He said Tompkins gets by on a small Social Security payment each month. Scales said the child pornography case was not as severe as many others seen in court. "Five images were found," he said. "That is atypical. Usually police find hundreds or thousands." Tompkins apologized in court for what he had done. "I regret my actions," he said.
