Daniel Lee Gilbert, 37, of Shady Cove, was arraigned June 15 in Siskiyou County Superior Court for possession of marijuana for sale and transporting marijuana into California with the intention of selling it, court records show. His next court appearance is scheduled for Aug. 3. Gilbert is one of two registered owners of Kush Gardens, a marijuana dispensary with locations in Shady Cove and Medford. Gilbert did not return calls or emails seeking comment Wednesday. A California Highway Patrol officer allegedly stopped Gilbert's blue 2001 Honda Civic 2-door coupe just after noon Tuesday, May 24, because the car's front tinted windows were too dark, according to Yreka CHP officer Justin Pollock. The Siskiyou County Narcotics Task Force executed a search warrant on the car after the CHP officer said he found probable cause for a search, Yreka CHP officer Peter Fennel said. Pollock refused to say how much marijuana police found in the vehicle. Gilbert was booked in the Siskiyou County Jail May 24, and he was released that day after posting bail. Gilbert faces a maximum penalty of two to four years in prison if convicted of all charges. Kush Gardens was registered in Oregon Dec. 19, 2014, the business registry shows, with Jared Lee Jones named as authorized representative and Gilbert named as registrant. The Kush Gardens website describes Gilbert as "owner-operator." The dispensary was among the first legal medical marijuana dispensaries to operate in Medford.
