According to an affidavit filed Monday in Jackson County Circuit Court by Medford police, local narcotics investigators and agents from the FBI, Drug Enforcement Administration and Homeland Security Investigations served a search warrant Wednesday at a home in the 2000 block of Hondeleau Lane. The affidavit says the homeowner, Thomas William Merriman, is a medical marijuana patient who is also licensed to grow for seven other patients, allowing him to possess up to 48 plants under the Oregon Medical Marijuana Program. But investigators allegedly caught him with 49, and a prior felony conviction means Merriman, 54, is also legally barred from possessing any of the 13 firearms the affidavit says were found in his home. Police said they had made three controlled buys from Merriman since March, two of them within the last month, the affidavit says. Court documents filed by the Jackson County District Attorney's Office charge Merriman with three counts of unlawful manufacture of marijuana, three counts of the unlawful delivery of marijuana for consideration and six counts of felon in possession of a firearm. Merriman also faces additional felony charges of tampering with a witness and menacing, stemming from death threats he allegedly made to a potential witness the day after his arrest, court records show. Merriman was convicted in 2006 of unlawful manufacture of a controlled substance following an investigation by the Medford DEA Task Force.
