Nicholas Clayton Newman, 38, no known address, faces charges of second-degree and fourth-degree assault for the alleged May 15 attack. He entered not guilty pleas to both charges this week in Jackson County Circuit Court and has a pre-trial conference scheduled for June 6. According to an affidavit, Ashland police responded to the Plaza for a report of an assault and found a man lying on the ground with a dislocated hip. The man told police his friend — who he knew only as "Cavin" — threw him to the ground with no provocation and kicked him. Paramedics took the man to Asante Ashland Community Hospital, where he was in an extreme amount of pain for approximately three hours before the hospital could get the proper physician there to reset the hip, the affidavit said. A woman who had been walking by Ashland City Hall across the street from the Plaza told police she saw a man punch the victim, throw him to the ground and kick him several times. She said the victim did not fight back, the affidavit said. Several other individuals present on the Plaza were not willing to give statements to police because of the "transient code" of silence, the affidavit said. The injured man remained in the hospital overnight and was released the next morning. The day after the alleged attack, police identified "Cavin" as Newman and found him on the Plaza at approximately 9:45 p.m. He said the injured man had started the fight.
