Josephine County District Attorney Ryan Mulkins today determined that the troopers, Gregor Smyth and Heather West, were justified under Oregon law in their use of deadly physical force when they shot Robert Box seven times outside his home in the 100 block of Fir Canyon Road. Smyth and West were called to Box's house at about 10:55 p.m. to investigate a report that Box earlier had assaulted his wheelchair-bound daughter there. He walked out of the house at the troopers' behest to talk about the incident, according to the district attorney's office. Box walked to within 15 feet of the officers with a loaded .44-caliber magnum revolver in his pocket, then pulled it out and pointed it at the officers despite their demands that he not touch the gun, Mulkins said in a news release. Smyth fired seven rounds, West fired four rounds and Box dropped his gun into the bed of a pickup truck, the release said. Box's gun was found to be loaded with six bullets, three of which were hollow-pointed, according to the district attorney's office. Box was pronounced dead at Asante Three Rivers Medical Center in Grants Pass 45 minutes after the shooting, police said. Tests showed that Box had a blood-alcohol level of .09 percent at the time of the shooting, the release stated. This was the second officer-involved fatality in the past year in Josephine County that Mulkins deemed justified.
