I have a few question about it. How does it square with the language in Proposition 91 that says only the state can set the cannabis taxes, and any other taxes are null and void? — Adam H., Medford First of all, Adam, Ballot Measure 15-133 applies only to unincorporated areas of Jackson County, not Medford. In other words, the tax would only apply outside of cities. A special March 10 election will decide whether county voters think it’s a good idea. If voters approve the measure, it would authorize the county to collect up to 25 percent on the sale of medical and recreational marijuana products. The measure would authorize a medical and recreational marijuana tax on growers of $35 per ounce for marijuana flowers, $10 an ounce for leaves and $5 for an immature plant. The grower’s tax would not apply to people with Oregon Medical Marijuana Program cards who produce marijuana for their personal consumption or to people producing recreational marijuana for their own consumption. As you correctly surmised, the county ballot measure doesn’t square with Measure 91, passed statewide in November 2014. According to Measure 91, only the state can tax marijuana. But local jurisdictions hope that the Legislature will modify the state statute and allow local taxes in addition to the state taxes. Supporters of Measure 91 say the state tax is sufficient because any additional taxes would encourage the black market for marijuana. Some legislators also have expressed reluctance to additional taxes on marijuana. The Oregon Legislature and the Oregon Liquor Control Commission, which will regulate retail sales, are in the midst of developing rules for Measure 91. Jackson County is beginning a separate process to regulate medical marijuana facilities. It could impose conditions on hours and locations, and set up a review process for applications. The county will offer chances for public input as it develops those land-use regulations for unincorporated parts of the county.
