Christian Matthew Berry, 21, of the 900 block of Royal Court, allegedly admitted to police he punched his 20-year-old girlfriend and struck her with a cane Sept. 10. The girlfriend, who was treated at Rogue Regional Medical Center for bruises, scratches and a lump on her face, said Berry also kicked her, according to police. A Medford police officer who interviewed Berry with a tape recorder wrote in an affidavit, "He didn't remember kicking her but told me that if she said it happened, then it probably did. He also admitted to assaulting her about 13 times in the last year. The argument tonight was because she didn't bring home In-N-Out burgers for dinner." Berry has been charged with second-degree assault, third-degree assault, two counts of fourth-degree assault, unlawful use of a weapon and coercion. He is scheduled to be arraigned on the charges Tuesday in Jackson County Circuit Court. Second-degree assault carries a minimum sentence of five years and 10 months in prison upon conviction under Oregon's Measure 11 sentencing law. The morning before the alleged assault, In-N-Out Burger opened a franchise at 1970 Crater Lake Highway in Medford. People visiting the fast-food restaurant, which has a cult-like following at its chain restaurants in California, experienced lengthy waits for drive-thru and dine-in service. Berry was originally held in the Jackson County Jail on $32,000 bail but was later released on his own recognizance with a court order not to contact his girlfriend, jail and court records show. She told police they had been dating for four years — since they were both teens, the affidavit said. On Sept. 21, In-N-Out Burger workers helped nab a fugitive in an assault case when they flagged down an Oregon State Police trooper over suspicions that Oscar Anthony Martinez, 35, of Portland was going through the drive-thru while intoxicated. Martinez pleaded guilty to driving under the influence of intoxicants in Jackson County Circuit Court later that month. After an extradition hearing, Martinez entered not-guilty pleas Friday in Multnomah County on charges of second-degree assault, fourth-degree assault and attempted fourth-degree assault.
