Marty Clark found no basis for criminal charges, the sheriff's department announced Tuesday. Clark had been accused of improperly dismissing a number of department-issued traffic tickets under the administration of former Sheriff Mike Winters, sparking an investigation by Oregon State Police for possible charges of first-degree official misconduct. Sheriff Corey Falls placed Clark on administrative leave Jan. 20 after learning of the allegations from two of his deputies, and asked Oregon State Police and the Jackson County District Attorney's Office to handle the investigation. District Attorney Beth Heckert later referred the case to the Oregon Department of Justice, which often handles major investigations of alleged official misconduct. Falls said the DOJ investigation ultimately had no bearing on Clark's employment with the sheriff's department. "His position was actually eliminated," Falls said, explaining that his restructuring of the department eliminated all positions at the rank of lieutenant. A deputy also had claimed that Capt. Terry Larson had been aware of Clark's alleged ticket dismissals, but Falls said Larson was ultimately cleared by the sheriff's department's own internal investigation. Falls said he was relieved to hear that the DOJ investigation exonerated Clark.  "I was glad to hear that there were no criminal charges filed," he said.
