Hagey, 48, of Medford, was arrested Dec. 30 by Medford police at a Purple Parrot on charges of meth possession and resisting arrest. Jackson County District Attorney Beth Heckert, who will be the prosecutor in Hagey's case, said she will not pursue the resisting arrest charge. “After the reviewing the case, I didn’t feel there was enough to go forward with the charge at this time,” Heckert said. Heckert said she considered sending the case out of the county for prosecution, but she determined that the Community Justice Department is separate from the D.A.'s Office, and Heckert doesn't supervise anyone in Hagey's department. "Parole and probation is totally separate from my department," Heckert said. Heckert said a conflict could occur in Jackson County if Hagey gets convicted, because Hagey's department oversees parole and probation. “If he was to get convicted, probably another agency would have to supervise him," Heckert said. "But we’re not there yet.” Hagey was placed on paid administrative leave Dec. 31, as soon as county officials became aware of the arrest. Heckert said she believes Hagey is still on paid administrative leave. A call to Jackson County Counsel Joel Benton to verify Hagey's employment status was not immediately returned. Hagey's brother Jayson Robert Hagey, who lives with Shane Hagey in the 200 block of Dunthorpe Drive, was arrested on a methamphetamine possession charge Jan. 13. Heckert said the alleged crimes took place in separate places. Jayson Hagey's case is still under review by the D.A.'s office. "It'll be filed separately if it gets filed," Heckert said. "It occurred in a different location, so it's a separate case." No charges have been filed against Jayson Hagey yet, but a sunglasses case with meth paraphernalia was allegedly found in his bedroom by police, according to returns from an Oregon State Police search warrant served Dec. 30 on the Hagey residence.
