Land-use planner Calvin Martin of Jacksonville and retired Ashland lawyer Mark Haneberg are asking LUBA to overturn the City Council's approval of Costco's conditional use permit application in March. In February, the city's Planning Commission approved Costco's application for a conditional use permit, allowing the construction of a 161,992-square-foot warehouse and fuel station on 18.28 acres at the southwest corner of Hamrick and Table Rock roads. Martin and Medford lawyer David Smith filed separate appeals that were denied by the council. The deadline for the city to respond is 21 days after a briefing by the city. LUBA is expected to issue its opinion and final order in late August. The board also denied Central Point's request for dismissal. Central Point Development Director Tom Humphrey said Monday that the city has submitted 1,200 pages of records from Planning Commission and City Council decisions, including traffic analysis. The appellants sought to have additional data added to the process, Humphrey said, but LUBA declined the request. "The long and short of it is that LUBA will use the record we submitted," Humphrey said. "The only thing they wanted added was the resolution adopted by City Council in 2009, affirming the similar use of membership warehouse within light industrial-use zone." He said the additional record requests by Martin and Haneberg "would confuse the issue." Humphrey e said the present property owners and Costco have been patient during the process, and that the delay might help Costco avoid the cost of doing additional road work early in the project. —Reach reporter Greg Stiles at 541-776-4463 or [email protected].
