Hubbard , went on trial in the circuit court this afternoon and the task of securing a jury to pass upon his guilt or innocence began after short court formalities. owing to the wide interest in the cases, and the bitter feeling manifested in some quarters, a special venire may be necessary. The game laws and the opinion of prospective jurors upon their merits or demerits, form the key question for both defense and state. Many witnesses from Trail, near where the murder occurred, arrived this morning. It is not expected that a jury will be secured before tomorrow noon, and that the hearing of testimony will begin then. Martin will plead self-defense. In refutation of this the state will introduce the mackinaw Hubbard wore, showing the course of the bullet through the lapels, and bring witnesses to prove that Hubbard's gun was strapped under his arm, making it impossible to have drawn it. Hubbard's gun was found under a bush 10 feet from the body. The state will claim that Martin put the gun there. Evidence will also be introduced showing that Martin had threatened Hubbard, and that the latter was warned to be careful when he secured the warrant for Martin from Justice Taylor of this city. The defense will introduce testimony to show that Martin was persecuted, and of a peaceable law-abiding nature. The only eye witness to the tragedy is Constable A.L. Irwin of Ashland, who accompanied Hubbard upon that fateful trip. The murder occurred near Martin's cabin on Trail Creek last December, where Hubbard with Constable Irwin had gone to arrest Martin for violation of game laws. They were met on the trail by Martin, rifle in hand. Hubbard dismounted from his horse. Martin warned him not to approach closer. Hubbard did not heed, and a bullet fired from the hip ploughed through his chest, causing instant death. Later Martin gave himself up to Sheriff Singler, waiving a preliminary hearing. The defense is represented by Attorney Evan Reames, the state by Prosecutor Kelly, and the case promises to be the hardest-fought legal battle in the history of Jackson County.
