Jackson County Administrator Danny Jordan confirmed Wednesday that Hagey's employment with the county ended as of Friday. Jordan declined to say whether Hagey had been fired or resigned. "We do not comment on personnel matters," Jordan said. Hagey was placed on paid administrative leave the day after his Dec. 30 arrest. Jordan declined to say how long Hagey had been on paid leave before his employment with the county ended Friday. As director of Community Justice, Hagey oversaw adult probation and parole, juvenile probation, the juvenile detention facility and the Community Justice Transition Center. Medford police began investigating Hagey after an informant claimed Hagey had been buying small amounts of meth from the informant at various Medford locations. The informant assisted police in exchange for consideration on pending felony charges, according to a search warrant affidavit. Hagey pleaded not guilty Jan. 29 to a charge of methamphetamine possession. Jackson County District Attorney Beth Heckert has said she will not make a plea agreement offer to Hagey that includes an opportunity for a conditional discharge. With a conditional discharge, a defendant agrees to comply with certain conditions for a period of time. If the defendant successfully completes the terms, the case can be dismissed and a felony conviction will not appear on the person's record. Heckert has said she will not offer the conditional discharge because of Hagey's position in the community. Carl Caplan, Hagey's defense attorney, filed a motion last week asking a judge to allow Hagey's participation in a conditional discharge program. In a memorandum accompanying the motion, Caplan argued that the denial of conditional discharge represents "selective prosecution, denial of equal protection and a violation of the privileges and immunities clause of the Oregon Constitution." Caplan cited a previous court ruling that the government treat similarly situated people the same, unless there is a rational explanation for different treatment. Caplan said the Jackson County District Attorney's Office has a policy for denying defendants' entry into conditional discharge programs for drug cases, including if they have prior drug convictions or have previously entered a deferred sentencing program. Caplan said Hagey has no prior criminal history and has never been in a conditional discharge or diversion program. The policy also allows the district attorney to consider a defendant's likelihood of successfully completing a conditional discharge program based on factors such as motivation to complete drug treatment. Caplan said Hagey has completed a residential treatment program and is enrolled in local after-care treatment. "Position in the community is not listed as a factor to exclude a person from entering the conditional discharge program," Caplan wrote in the court document. Josephine County Circuit Judge Lindi Baker is being brought in to consider Caplan's motion to allow a conditional discharge. A hearing on the issue is scheduled for May 16, according to court records. A pre-trial conference before Jackson County Circuit Judge Lorenzo Mejia is scheduled for May 23.
