According to an indictment filed Jan. 30, Brandon Boyd Mitchell used a fire department credit card to make more than $2,000 in purchases two different times between September 2013 and April 2014. Mitchell, 41, was scheduled to be arraigned Friday on two counts of first-degree theft, two counts of fraudulent use of a credit card and two counts of computer crime, all of which are Class C felonies carrying a maximum sentence of five years. The computer crime charges stem from allegations that Mitchell used a computer to fraudulently alter invoices to Sears and Lithia Nissan in March and April 2014. Chief Deputy District Attorney Jeremy Markiewicz said Mitchell was a Fire District 3 employee at the time of the alleged crimes, which were investigated by the Jackson County Sheriff's Office. "(The case) is roughly a year old now," he said. Deputy Chief John Patterson said Mitchell was hired by the department in July 2012. "He was originally hired as a battalion chief," Patterson said. Patterson said Mitchell resigned from the department on June 16, 2014, at the rank of interim operations chief. "He was not terminated," Patterson said. Court records show Mitchell has moved to Georgia since the case was filed and that his arraignment, which had been scheduled for March 20, has since been rescheduled seven times. "It would not surprise me if it's postponed again," Markiewicz said. According to a 2013 Fire District 3 newsletter, Mitchell spent more than 19 years at various fire departments in Georgia before joining the Jackson County department.
