1. Money-transmitter licensing of virtual currency
- LB 474 (2025), Banking, Commerce and Insurance Committee (Chair Jacobson). Approved by the Governor 2025-05-20. Amends §§ 8-2701 to 8-2742 (Nebraska Money Transmitters Act) to adopt the Money Transmission Modernization Act. Definition: "Monetary value means a medium of exchange, whether or not redeemable in money." Full slip law saved:

- LB 717 (2026), Sen. Jacobson, approved 2026-02-25: annual banking update; changes the Money Transmitters Act, the Controllable Electronic Record Fraud Prevention Act cross-references and digital asset depository provisions; per CSBS it exempts small payroll processors (fewer than 20 employees or serving fewer than 50 Nebraska employees, with clean records) from the Money Transmitters Act, effective 2026-02-26. Digital asset depositories in practice: Telcoin Digital Asset Bank received final charter approval on 2025-11-12 (founder Paul Neuner: "Our charter makes history…"); it was reported to launch a stablecoin, eUSD, at approval, with operations reported starting in December 2025. [N1][N2] Whether it is the first such charter is stated in some headlines ("first-ever regulated digital asset…") but not in the article read (unverified). [N3]
3. Crypto ATM / kiosk law
LB 609 (2025) — Controllable Electronic Record Fraud Prevention Act (Sen. Bostar). Approved by the Governor 2025-03-11. The slip law has no emergency clause or operative date, so under Nebraska's general rule it took effect three calendar months after the 2025 session adjourned — about September 2025 (exact date unverified). - A kiosk operator may not do business with a person unless it holds a licence under the Nebraska Money Transmitters Act.
- Mandatory bold fraud warning text (scam contact by strangers, fake government/tech-support calls, etc.) and disclosures (not legal tender, delays, volatility, irreversibility).
- Daily limits per customer across all the operator's kiosks: $2,000 for new customers; $10,500 for existing customers (Sec. 8).
- Fee cap: all fees and spread together may not exceed 18% of the dollar value (Sec. 9).
- Refunds: a new customer fraudulently induced who tells the operator and a law-enforcement or government agency within 30 days gets a full refund including fees; an existing customer gets the fees refunded (Sec. 7).
- Live customer service Monday–Friday 7 a.m.–9 p.m. via toll-free number; a compliance officer (owning no more than 20% of the operator); receipts. [S1]
4. Tax treatment
- No Nebraska Department of Revenue guidance on virtual currency was found in this check (gap). Nebraska's individual income tax starts from federal AGI, so federal property treatment of Bitcoin would carry through (general knowledge; unverified).
- 2024 LB 1305 (no tax on gold/silver bullion; NCSL) failed; no crypto-specific tax exemption has been enacted. [S7]
5. Notable enforcement
- No Nebraska-specific crypto enforcement action was found in the searches run (gap). In the October 2026 Coinme multistate consent order, Nebraska is a participating state (Appendix A); its share of the $2.2M administrative penalty is $24,531.26 (Appendix B) Coinme consent order, App. A–B (completeness check, 2026-10-09). No Nebraska strategic-Bitcoin-reserve bill was found in the NCSL lists for 2024–2026 (gap: earlier years not checked).
7. Contested and fringe claims (flagged, not endorsed)
- "Digital asset banks make history." Telcoin's founder framed its charter as historic for US banking; critics of state crypto charters (e.g., federal bank regulators in the Custodia litigation — see
us-state-wy.md) argue such institutions carry novel risks. [N1] Promotional vs. regulatory views. - Kiosk fee cap of 18% is higher than caps in some other states (e.g., 3% proposed in New York — see
us-state-ny.md; 12% in North Carolina — seeus-state-nc.md) — consumer groups such as AARP have pushed for lower caps; industry argues kiosks have high costs. Policy dispute; AARP position on Nebraska not read directly — unverified.
