1 AN ACT
2 relating to the registration of virtual currency mining facilities
3 in the ERCOT power region that demand a large load of interruptible
4 power.
5 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
6 SECTIONA1.AASubchapter H, Chapter 39, Utilities Code, is
7 amended by adding Section 39.360 to read as follows:
8 Sec.A39.360.AALARGE FLEXIBLE LOAD REGISTRATION. (a) In this
9 section:
10 (1)AA"Virtual currency" has the meaning assigned by
11 Section 12.001, Business & Commerce Code.
12 (2)AA"Virtual currency mining facility" means a
13 facility that uses electronic equipment to add virtual currency
14 transactions to a distributed ledger.
15 (b)AAThe commission by rule shall require a person operating
16 a virtual currency mining facility who enters into an agreement for
17 retail electric service in the ERCOT power region to register the
18 facility receiving service as a large flexible load under this
19 section if:
20 (1)AAthe facility requires a total load of more than 75
21 megawatts; and
22 (2)AAthe facility load is interruptible.
23 (c)AAThe rules must require a person described by Subsection
24 (b) to:

1 (1)AAregister the large flexible load with the
2 commission not later than one business day after the date the
3 agreement begins; and
4 (2)AAprovide the commission with:
5 (A)AAthe location of the facility; and
6 (B)AAthe anticipated demand from the facility for
7 the five-year period beginning on the date of the registration.
8 (d)AAThe commission by rule shall:
9 (1)AAadopt criteria for determining whether a load is
10 interruptible for the purposes of this section based on whether it
11 is possible for the facility operator to choose to interrupt the
12 load; and
13 (2)AAestablish a method to ensure compliance with this
14 section.
15 (e)AAThe commission may share with an independent
16 organization certified under Section 39.151 registration
17 information received under this section.
18 SECTIONA2.AAThis Act takes effect September 1, 2023.
