The attached concerns a new Civil Rights
matter reported to our Sacramento Office
involving allegations by some 30 farmers
in Kern and Tulare Counties, California,
charging the United Farm Workers Union UFH!
with violating their civil rights and the
civil rights of their workers.
On 8/20/73, an attorney representing the
various growers made available approximately
100 affidavits to the Bakersfield Resident
Agency relating to acts of violence on part
of the UFW. The FBI is requested to investi-
gate UFW for conspiracy to violate rights
of the growers in that the UFW has conspired
to commit violence in violation of the right
of farm laborers to work and growers to main-
tain and harvest crops. V
The Sacramento Division has investigated
several civil rights allegations wherein
members of the UFW have alleged their rights
have been violated by members of the Kern
County Sheriff's Department and by the grape
growers. These cases grew out of the current
strike in the grape fields involving the
UFW and Teamsters Union.
This case will be discussed with the Civil
Rights Division, U. S. Department of Justice,
and no investigation will be conducted unless
specifically requested by the Department.

oE"Saturday night, November 2, 1974, after they were
stopped fro picketing Fazio's Food Market, 5725 North
Dixie Drive, Dayton, Ohio, where they were urging
customers not to buy table grapes or head lettuce.
An unidentified spokesman was quoted as
saying the UFW had picketed the store several times
during the past six weeks and the incident came at the
end of a five-day union organizing workshop, including
members from Dayton, Columbu Toledo, Akron, Cleveland
and Cincinnati, Ohio.
The story stated pickets had been ordered by
Montgomery County Sheriff's Office Deputies at about
7:00 p.m. to leave the area when officers began arresting
persons in the group.
A Deputy Sheriff was quoted as saying that
the pickets were "clapping, chanting, and raving.
A spokesman for Eazio's Market reportedly stated that
the pickets were disturbing the peace.

On November 4, 1974, the Dayton Daily News
reported that UFW pickets arrested November 2, 1974
had entered pleas of not guilty and trial bad been
set for 9:36 a.m. in Municipal Court.

Montgomery County Sheriff's Office, in connection with

The UFW, according to the story, claimed that
Fazio's conspired with the Montgomery County Sheriff's

of UFW pickets by illegally taking away their right
to free speech.'

The telegram went on to say that UFW members

manner, based not on law, but on discrimination,
management bias, and Vindictiveness: that peaceful
demonstrators had been arrested in the process of
dispersing, soe of whom were pulled from a van
while trying to obey officers orders to leave the
scene.
The telegram stated that one deputy, without

however, he agreed to recontact the Agent later that
day.
During the early afternoon on November 7, 1974,Qtelephonically contacted the Dayton FBI Resident D1
cy. He said that all charges against the UFW
pickets have been dropped by the prosecution at their
court appearance. Additionally, he stated telegrams
to the FBI and the United States Department of Justice
had been sent previously by him in the belief that the
UFW was being denied the right to picket;
Since charges were dropped and since lines
of communication with the Montgomery County-Sheriff's
Office had been established, he said, the UFW desired
to withdraw any complaint made to the BB1 and the 51¢.United States Department of Justice. did not
desire to come to the FBI Office for ur er discussion
of the matter, he said.
The Journal-Herald on the morning of
November 8, 1974, reported that disorderly conduct
charges against UFW pickets were dropped during a
hearing in Municipal Court on November 7, 1974.
It was further reported that an agreement
had been worked out between the Montgomery County
Sheriff's Office, Fazios Market, and the UFW.
About fifty UFW members and supporters immediately
went back to the store where they had been arrested and
set up a picket line for about an hour, during which
time, there were no incidents, according to this news-
paper.

were released on bond from. Pecos County
jail here alter being arrested early Friday
morning for trespassing, Pecos County
Sheriff Charles Tenyclt said.
A total of 42 UFW supporters have been
arrested for trespassing since Wednesday
alter they began a campaign in Reeves
and Pecos counties to get area laborers to
stpport their movement.
-.Ten Eyck said eight men and ve women
v-ere arrested about T a.1'n. Friday when
they drove onto a private road on the Mike
Burltholder farm about two miles south of
Coyanosa, Tex.. oft County Raod 1716. i
"Everything, was ';~::':':!:t. just like
Thursday." TenEyck said. But they
drove past some posted signs and that is
all there was to it."
The picketers were charged with crimi-
nal trespass about 9 a.m. before justice of
the peace Tillie Cook.

leased on a $400 bond posted by a represen-
tative oi the Warren Burnett law otlice oi
Odessa.
Atter nearly a month in the
Reeves-Pecos counties area the UFW el-
forts have not only been dampened by cool
weather and rain. but this week they have
rnet with costly arrests and some reluc-
tance lrom the field workers they are
striving to unity. Workers failed to leave
the fields Thursday and Friday. although
250 did come from one field in Reeves
County Wednesday. .
l "Many workers! don't join the move-
tnent because they do not want to lose their
contacts with the growers." said UI-W
leader Antonio Orendain. The workers
keep telling us they are aircady making $2
an hour and that they need to make the
money so they can go back to the Rio
Grande! Valley." -
Orendaiu said he was at another picket
line v-hen the arrests were made Friday.
but upon inspecting the site shortly after-
wards he said no private property signs
were visible.
"But." he hastily added. "two or three
hours a.':cr the arrest there were three
signs up."

Wednesday at a picket near Verhalen in
southeastern Reeves County. All picketer:_

OdessaAmerican, the Odessa, Texas, newspaper, contained
articles setting out that 13 persons, including United Farm
Workers UHR! Union sympathizers and two Austin, Texas men
filming a documentary had been arrested by Pecos County
Sheriff's Office personnel, and that some of those arrested
had been "pushed around", and one individual had a tape
recorder taken away from him.

sight here Friday afternoon
after 13 persons were arrested
early Friday morning on
criminal trespass charges and
later released on 9400 bond
each.
Pecos County Chief De utySheriff Mike Hill said memgers
of the United Farm Workers
dispersed about noon Friday.

pickets moved back to Pecos in
Reeves County where the
pickeling started Wednesday
with the arrests of 27 persons.
The Reeves County Sheriff's
office said Friday night they
had no new confrontations with
the pickets during the after-
noon.
Three Reeves County
deputies assisted the Pecos
County Sheriff: office with the
pickets Friday morning at the
Jim Burkholder farm near
Coyanosa.
The pickets were charged
with criminal trespass about 7
a.m. Friday on a private road
at the Burkholder ranch.
The pickets are trying to
organize cantaloupe pickers
during the harvest now

Reeves and Pecos County
usually have some indication
what may be in store for the
respective counties late the
night before.
"If we need help over here, or
they need help in Reeves Coun-
ty, we usually know late the
night before and have our men
at the farm being worked by
dawn, Hill said.
The pickers left the
Burkholder farm and moved on
to another one near Coyanosa
Friday afternoon, Hill said.
"But the union pickets didn't

individuals consisting of males and females were observed to
picket in front of the federal office building at 701 Loyola
Avenue, New Orleans.
These pickets consisted of approximately six blacks
and the remaining persons were white. Ihey carried placardswhich read "JOBS not wan" and "en? our or cAnaonIA."' "
The Picketing was orderly in nature and was kept
under observation by building guards.

The UFWOC has recently been involved in a
controversial labor struke of lettuce growers and shippers
throughout the State of California. The UFW6¬ has been the
bargaining force for farm laborers in their efforts for better
wages and increased benefits. UFWOC has had recent success in
signing union contracts with a number of large lettuce and
vegetable growers in California. ;

Approximately 6:15 PM, January l7, 1973, an
explosion occurred in the United Farm Workers Coop
gas station, Iocated on Garces Highway, 2% liles west of
99 Freeway, Delano, California. The station belongs to
the United Farm Iorkers Union UFIU!,-an agricultural union
headed by Caesar Chavez.
Eiplosion iiterial ins placed outside of the west
wall and caused a two foot diameter hole in the 18 inch
thich adobe wall, breaking windows in the building and a
nearby residence. R0 injury resulted from th explosion.
Explosion is being investigated by the Kern
County Sheriff's Office and the Alcohol, Tobacco, and -
Firearms Division AIFD! of the United States Treasury

No positive suspects developed and according to
ATFD, preliminary examination indicates 1% to 2 pounds of
dynamite with safety fuse and blasting cap was the
explosive device used.
