On 10/07/2001, a second order authorizing disclosure of
subscriber and other information pursuant to Title 18, United States
Code Section 2703(d) was executed at MSN Hotmail for the account
. The 10/07/2001 order requested opened email and
any email stored on the MSN Hotmail server more than 180 days.
Reference San Diego Rapid Start Control Number .
On 10/08/2001, MSN Hotmail provided documentation regarding
the account to Special Agent of
the Federal Bureau of Investigation, San Jose Resident Agency. SA
emailed the results to SA , San Diego
Division. The .zip file emailed to SA was saved to a
3.5 inch floppy disk and placed in an FD-340 envelope. The MSN Hotmail
records provided the following information:

The opened email provided by MSN Hotmail revealed several
emails sent or received by Omar Al-Bayoumi, including one email from
Omar Al-Bayoumi to on or about 06/11/2001. Al-Bayoumi
asks if he is still in . The content of the email was
printed and placed in an FD-340 envelope.

date of the trip to LA, Dyson was still not able to provide a
definitive week or month. It would have been whenever Al-Bayoumi's
visa had to be renewed.
SA asked Dyson if he was positive about his earlier
report that he and Al-Bayoumi did not meet any other persons while in
LA and if it was possible that they did meet someone. SA
advised Dyson that SA was aware of some statements and reports
from San Diego which indicated that during their trip to LA, Al-Bayoumi
met with Al-Hazmi and Al-Mihdhar. Dyson immediately apologized and
said SA was right. He did not recall the incident until this
information jarred his memory. He immediately provided the following
free flowing account of the meeting.
Dyson accompanied Al-Bayoumi to the Saudi embassy or
consulate during the day in question as previously reported. Al-
Bayoumi and Dyson left from San Diego in the morning at approximately
8:00 a.m. It took them between two and four hours to get to the
consulate. After Al-Bayoumi's business at the embassy was concluded,
they went to the Mediterranean restaurant/café in Culver City
previously mentioned. It was here that they bumped into Al-Hazmi and
Al-Mihdhar. Al-Bayoumi and Dyson were in the restaurant first. Two
Arab looking men (Al-Hazmi and Al-Mihdhar) came into the restaurant.
Al-Bayoumi began talking to them. He can't recall exactly why Al-
Bayoumi began talking to them, but believes Al-Bayoumi heard them
speaking Arabic or they heard Al-Bayoumi or Dyson say something
Islamic. This could have been a religious reference of some sort. Al-
Bayoumi introduced himself to the men and wound up inviting them to his
and Dyson's table to sit.
All four individuals sat, ate and interacted. The meeting
was "impromptu and coincidental." Dyson did not find this unusual as
this is the way Al-Bayoumi is. It fit with his personality. The
conversation was almost entirely in Arabic. Therefore, Dyson did not
understand the entire conversation. Al-Bayoumi would talk to Al-Hazmi
and Al-Mihdhar in Arabic and then translate for Dyson. This was in
order to let Dyson be a part of the conversation and know what was
going on. An estimate of how long the meeting/meal occurred is
approximately twenty to thirty minutes. Al-Hazmi and Al-Mihdhar did
not understand English. Therefore, Al-Bayoumi translated in that
direction also.
During the conversation, Dyson learned via Al-Bayoumi that
Al-Hazmi and Al-Mihdhar had an apartment in LA and have only been there
and in the United States (U.S.) for a short time. They did not like it
in LA. They were having a difficult time and didn't know anyone. Al-

Hazmi and Al-Mihdhar were in the U.S. to learn English. Al-Bayoumi
invited them to come to San Diego and check it out. Al-Bayoumi told
them they would probably like it in San Diego. Al-Hazmi and Al-Mihdhar
indicated they were interested. Al-Bayoumi gave his phone number to
Al-Hazmi. It is also possible that Al-Bayoumi got their phone number
as well, but Dyson is unsure. Dyson paid for everyone's meal. Al-
Bayoumi indicated to Dyson that he should not have done so. Al-Bayoumi
and Dyson left the restaurant/café and went to the Culver City Mosque
as previously reported.
Al-Hazmi and Al-Mihdhar's appearances were the same as that
in the photographs previously identified by Dyson. Al-Hazmi and Al-
Mihdhar were wearing western clothing. They were wearing pants and
shirts. Dyson did not see any vehicle associated with them, and
assumed they were on foot. Al-Bayoumi was wearing western clothing as
well.
During the meeting at the restaurant, nothing appeared
strange to Dyson. Al-Bayoumi did not seem to know Al-Hazmi and Al-
Mihdhar and vice versa. Al-Bayoumi did not appear to be expecting a
meeting either. Al-Bayoumi was never alone with these individuals.
Dyson was present during the entire time of the interaction. Another
reason that Dyson believes the meeting could not have been planned is
due to the fact that he and Al-Bayoumi were originally supposed to go
to a different restaurant. They found the restaurant Al-Bayoumi
originally wanted to go to. However, the establishment advised they no
longer serve sit down meals. They were only selling meat from the
butcher shop portion of the establishment. The restaurant portion of
the business was no longer in operation. The workers at this
establishment recommended a place nearby where they could get Halal
food. Therefore, Al-Bayoumi and Dyson went to this second restaurant
and this is where the meeting with Al-Hazmi and Al-Mihdhar happened to
occur.
The next time Dyson met Al-Hazmi and Al-Mihdhar was when they
were in the Parkwood Apartments on Mt. Ada Road in San Diego. This was
at the welcome/housewarming party he previously described. They then
started attending the mosque at the Islamic Center of San Diego (ICSD).
It was a matter of a few weeks to a month between the meeting at the LA
restaurant and the time of the welcoming party for Al-Hazmi and Al-
Mihdhar. During this interim period, Al-Bayoumi did mention that he
had been in contact with the two men they met at the restaurant in LA.
Al-Bayoumi also told Dyson that they even came down to visit San Diego
one time and liked it. Dyson never saw Al-Hazmi or Al-Mihdhar during
this supposed visit.

LAFI HUSSAIN SAIFI Al-HARBI, date of birth ,
place of birth Taif, Saudi Arabia, occupation Lieutenant
Commander, Saudi Arabian Navy, was interviewed in Riyadh, Saudi
Arabia. Present during the interview were of the
National Commission on Terrorist Attacks Upon the United States
and of the . After
being advised of the identity of the interviewing agents and the
purpose of the interview, AL-HARBI provided the following
information.
AL-HARBI has been in the Saudi Arabian Navy for
approximately twenty (20) years. AL-HARBI is currently assigned
to Jubayl, Saudi Arabia, and is involved as an Operations
Officer in a counterterrorism assignment in conjunction with the
United States.
In 10/1999, AL-HARBI traveled to the United States to
attend military training. AL-HARBI traveled to the United
States with his family, consisting of his wife DOHA, his

late 03/2000, AL-HARBI attended training in Coronado,
California, with five colleagues from the Saudi Arabian Navy.
During this time, AL-HARBI resided with his family in the
Barclay Square Apartments, Beadnell Way, San Diego, California.
While residing in San Diego, AL-HARBI and his family
attended the Islamic Center of San Diego (ICSD) which was
located across the street from his apartment complex. During
the Eid celebration in the parking lot of the ICSD in the
beginning of 2000, AL-HARBI met NAWAF AL-HAZMI. AL-HAZMI
advised AL-HARBI that he had recently arrived in the United
States and wanted to learn English. AL-HARBI provided AL-HAZMI
with his telephone number and told AL-HAZMI to call if he had
any questions while he was settling into the San Diego area.
AL-HARBI did not recall if he provided AL-HAZMI with his home
telephone number or his cellular telephone number. AL-HARBI did
not recall either of these telephone numbers.
After their first meeting at the Eid celebration, AL-
HARBI and AL-HAZMI exchanged multiple telephone calls. AL-HAZMI
sometimes called when AL-HARBI was not at home or not available;
AL-HAZMI then would leave a message with AL-HARBI's wife. AL-

HAZMI queried AL-HARBI about learning English and about
purchasing an automobile. AL-HARBI advised AL-HAZMI that the
best way to learn English was to live with an American host
family. AL-HARBI did not know if AL-HAZMI pursued this idea.
AL-HARBI also advised AL-HAZMI about local English language
schools, but he did not know if AL-HAZMI ever registered for any
classes. During their telephone conversations, AL-HAZMI also
queried AL-HARBI about purchasing a cheap automobile. AL-HARBI
did not provide AL-HAZMI with any specific advice about
purchasing an automobile, and he did not know if AL-HAZMI ever
purchased an automobile.
AL-HARBI recalled that AL-HAZMI resided with another
Saudi Arabian male, but AL-HARBI never met this other
individual. AL-HARBI never visited the apartment of AL-HAZMI in
the Parkwood Apartment complex. AL-HARBI was familiar with the
Parkwood Apartment complex because it was across the street from
his own complex and from the ICSD, and because his colleague
FAHAD lived there (known to interviewing agents to be FAHAD AL-
OTAIBI).
AL-HARBI did not have knowledge of any of his five
colleagues, to include MOHAMMAD AL-GHANIM, having known AL-
HAZMI.
Other than talking on the telephone, AL-HARBI did not
have any further contact with AL-HAZMI. AL-HARBI relocated from
San Diego to Newport, Rhode Island, at the end of 03/2000 to
attend additional training. While attending training in Newport
from 04/2000 to 09/2000, AL-HARBI and his family actually lived
in Fall River, Massachusetts. Approximately two months after
moving to Rhode Island, AL-HARBI attempted to call AL-HAZMI on
one occasion to see how he was doing but AL-HAZMI's telephone
number had been disconnected. Therefore, AL-HARBI did not have
any contact with AL-HAZMI after moving to Rhode Island.
When asked why his cellular telephone was subscribed to
an address in Blacksburg, Virginia, AL-HARBI advised that the
address is that of his cousin who is a student at

09/2000, AL-HARBI gave his cellular telephone to .
AL-HARBI identified a photograph of NAWAF AL-HAZMI as
the individual he had met at the ICSD and with whom he had
talked on the telephone. AL-HARBI identified a photograph of

OMAR AL-BAYOUMI as an individual who attended the ICSD. AL-
HARBI advised that "everyone" knew AL-BAYOUMI because he was a
friendly and talkative person. AL-HARBI recognized a photograph
of OSAMA NOOH as another member of the Saudi Arabian Navy, but
he did not recall his name. AL-HARBI advised that approximately
one to two months ago, NOOH
had died. AL-HARBI did not identify photographs
of KHALID AL-MIHDHAR, , HANI HANJOUR, or OSAMA
BASNAN.

if FBI-San Diego subject MOHDAR ABDULLAH's
immigration cell mates' allegations that ABDULLAH had advance
knowledge of 9/11, FBI -LA began reviewing ABD ULLAH's connections
in Los Angeles, because 1) it was known that he had driven 9/11
hijacker's Khaled AL -MIHDHAR and Nawaf AL -HAZMI (American
Airlines #77 that crashed into the Pentagon) to Los Angeles on

06/09/2000 and 2) AL -MIHDHAR's and ALHAZMI's wherea bouts in Los
Angeles for a two week period between 01/15/2000 and 02/04/2000
were still unknown.
During the investigation, FBI -LA identified video
surveillance footage from Los Angeles International Airport (LAX)
security cameras for 06/10/2000. The video surveillance footage
is believed to show ABDULLAH and AL -HAZMI walking with AL -MIHDHAR
at LAX before AL -MIHDHAR's return trip to Yemen to visit his
family. More importantly, this footage also shows one additional
unknown male subject (UNSUB) who app ears to be accompanying
ABDULLAH, AL -HAZMI and AL -MIHDHAR through LAX security. The
UNSUB appears to be holding a camera and may have been conducting
reconnaissance of LAX. To date, FBI -LA investigation has not
identified the UNSUB.
09/11/2006, NBC Today and MSNBC ran a news story on ABDULLAH
that stated, "the FBI has now renewed its investigation of a man the
9/11 Commission said was perfectly suited to help the hijackers with
their mission. . .NBC News has learned that the renew ed FBI investigation
was triggered in part by surveillance videotapes inside the Los Angeles
Airport shot in June 2000 - a year before 9/11. Law Enforcement officials
tell NBC the grainy tapes show terrorist Nawaf al -Hazmi with Abdullah
and an unidentified man. Sources say the men appear to be scouting out
the airport. Some FBI agents believe that one of the men may be holding
a video camera and rotates in a circle while secretly videotaping the
security area. . . Why didn't they find these tapes until 2004 isn't
known - especially since the FBI knew that on the day the tapes were
shot in June 2000, one of the hijackers went to Los Angeles Airport for
a flight home to Yemen. Critics are certain to questions whether the
FBI again missed an important clue, and let a possible accomplice get
away."

an unsolicited telephone call from , a reporter
for the San Diego Union Tribune. During their conversation, which
centered on the upcoming sentencing of an individual convicted
of a terrorism hoax, advised she had recently been in
e-mail contact with ABDULLAH (currently believed to be in Yemen.)
advised she asked ABDULLAH a bout the recent NBC news
article published on 09/11/2006 regarding ABDULLAH's role in
helping 9/11 hijackers Nawaf AL -HAZMI and Khalid AL -MIHDHAR.
(Note - has reported extensively on San Diego 9/11
subjects and associates.)
advised that ABDULLAH did not answer any
of her specific questions but related the following points:

As the LAX UNSUB is still unidentified, FBI -Los
Angeles wishes to show the LAX "still" photographs of the UNSUB
to , in the hopes he can identify the subject.
This belief is based on the following:

occasions to attend various Islamic schools. During his studies
in , became acquainted with individuals who had fought
with the mujahideen in Afghanistan during the 1980's conflict
with the Soviets.

Investigations have determined that JBAIHI, while in
the United States, was an Al -Qaeda recruiter. JBAIHI attempted
to recruit at least one individual in Los Angeles to attend the
AL-FAROOQ terrorist training camp. In addition, JBAIHI attended
the AL-FAROOQ terrorist training camp.

in Southern California nor questioned on individuals that he has

The report continues: "The two -toned object has
a beveled edge with rounded corners and is held "palm up" and
tilted slightly upward to an angle one might use when leve ling
a camera for a snapshot. The POI's shoulders are squared and his
elbow is steady and tucked into his side. A circular shape with
a dark center and metallic glare on its edge has characteristics
similar to a camera lens. The POI rocks a bit, lifts his right
arm and taps his index finger on the object in a quick downward
motion. This downward finger motion resembles the motion one makes
to snap a photograph, or start and stop a video camera. Once the
subject's index finger touches the object, the POI pic ks up his
pace and proceeds through the metal detector.
The report also estimated the height of the Person
of Interest (POI) (UNSUB) being between 5'4" and 5'7".

INVESTIGATION: SEARCH WARRANT ON ABDULLAH'S E -MAIL ACCOUNT
On 04/13/2009, FBI Los Angeles served a Federal search
warrant on Yahoo! for information regarding MOHDAR ABDULLAH's email
account The objective of the search warrant was to
corroborate former San Diego Union Tribune reporter
statements to a San Diego Assistant United States Attorney (AUSA) in
10/2006 . On 04/20/2009, FBI Los Angeles
received the results from Yahoo! which yielded ABDULLAH's verbatim answer
on 10/02/2006 to questions regarding the UNSUB:
Hi ,Regarding this notorious story that was blown out of
proportions, this tape is only collaborating and consistent with
whatever I have told the authorities and the grand jury in 2001.
This trip was made in 2 000 when Khalid was supposedly leaving
to Yemen to see his newly born child, it was my last contact with
him. I could not make the face of the third person whether he
was Khalid or their friend who was residing in LA. They introduced
me to him when we were here as a person they had known before
coming to San Diego. I don't remember having any contact with
this guy since then, please do me a favor send me a public message
and to senator Tom Kean in particular, I have never been reluctant
to cooperate with th e authorities to unravel the truth and my
so called immigration charges came as a reward of this complete
cooperation and a fake proffer agreement by the US Government.

PROPOSED MEDIA RELEASE
Los Angeles is requesting a public release d ate for the
LAX UNSUB video. A proposed media release plan for the LAX UNSUB video
was submitted and approved on 11/12/2008 .
This plan included a press release, a post on the FBI website with a
link to the video, and intervie ws with media forums to include television,
newspapers, and internet sites. It was also anticipated that on the
day of the release, representatives from the specific offices will promote
the FBI website release through local media channels to generate exp osure.
Upon approval of a public release of the video, Los Angeles will coordinate
with CTD and OPA to develop an updated media plan.

Omar Al-Bayoumi. Analysis of financ ial and telephone records were also
reported in chart form. Legat was instructed to disseminate the
information to counterparts using appropriate protocol.
Since the date of the communication referenced above,
San Diego has continued to analyze additional financial and telephone
records connected with Omar Al -Bayoumi and his associates, conduct
additional interviews with individuals who were associated w ith Omar
Al-Bayoumi while he resided in San Diego, and pursue several logical
leads generated.
One such lead was set to Boston Division to re -interview
Isamu Dyson. He will be asked to review photos of employees of
the Saudi Consulate in Los An geles where Omar Al -Bayoumi and Isamu
Dyson visited just prior to meeting two subjects of Flight 77, Nawaf
Al-Hazmi and Khalid Al -Mihdar on February 01, 2000. It is anticipated
that Dyson will view the photographs and identify which employee
interact ed with Omar Al -Bayoumi on that day. An identification, if made,
will provide an additional avenue of investigation in an attempt to
determine whether Al -Bayoumi may have been working as an intelligence
officer for the Saudi Government.
San Diego a lso pursued a lead related to Ercon
Engineering of Newport Beach, California. Omar Al -Bayoumi, while
residing in San Diego, held himself out to be an employee Ercon Engineering.
It was previously determined that Al -Bayoumi was not employed by Ercon,
and that both Al -Bayoumi and representatives of Ercon made false financial
statements concerning Al -Bayoumi's employment. However, investigation
to resolve the discrepancy has produced little information of value to
the PENTTBOMB investigation. No further in terviews in this regard are
anticipated.
Efforts continue to identify all individuals associated
with San Diego, California, an
apartment rented by subjects Nawaf Al -Hazmi and Khalid Al -Mihdar on
February 04, 200 0. Investigation revealed that Omar Al -Bayoumi signed
the subjects' rental agreement as guarantor. Recent information was
developed that a third man may have also lived in the apartment for a
short period of time. A lead has been sent to Seattle to loca te and
interview that person, tentatively identified as The
results of that lead will be reported to receiving offices.
San Diego is awaiting receipt of video tapes obtained
by New Scotland Yard during a search of Oma r Al-Bayoumi's property on
September 21, 2001. One of the tapes has images of men in the apartment
rented by subjects Nawaf Al -Hazmi and Khalid Al -Mihdar at a party hosted
by Omar Al -Bayoumi. Al -Bayoumi's camera was used to record the tape.

Synopsis: To request Legat to obtain further information
regarding the father of SAUD AL -RASHEED, and to confirm the
employment of HAMID AL -RASHID at the Saudi Arabian Presidency
of Civil Aviation.
Reference:
Details: Investigation has determined that OMAR AL -BAYOUMI
assisted hijackers KHALID AL -MIHDHAR and NAWAF AL -HAZMI after
their arriva l in San Diego in approximately 02/2000.
Specifically, AL -BAYOUMI assisted the hijackers in securing an
apartment by obtaining a cashier's check for them and by signing
as a guarantor on the lease application. AL -BAYOUMI also assisted
AL-MIHDHAR in openi ng a bank account.
Further investigation into AL -BAYOUMI determined that
AL-BAYOUMI has been employed by the Saudi Arabian Presidency of
Civil Aviation (PCA) since 1975. An individual interviewed by
the FBI advised that PCA employee HAMID AL -RASHID, business
telephone number , was involved in the payment of
salary to AL -BAYOUMI (reference
). Furthermore, this individual identified HAMID
AL-RASHID as the father of SAUD ABDULAZIZ SAUD AL -RASHEED
(reference ). At the time of
this identification, the photograph of SAUD AL -RASHEED was being
broadcast in the news media as a result of the issuance of an
international Be On The Lookout (BOLO). The BOLO had been issued

Details: Investigation at San Diego has determined that subjects from
Flight 77, Khalid M. Al -Mihdhar and Nawaf M. Al -Hazmi lived in San Diego,
California. A records check of th e California Department of Motor
Vehicles reported that Nawaf Al -Hazmi listed 6401 Mount Ada Road,
Apartment San Diego, California, as his residence when he applied
for a drivers license on or about April 5, 2000. This was confirmed
by the records an d the of the Parkwood Apartments, 6401
Mount Ada Road, San Diego, California. According to the rental records,
Al-Mihdhar and Al -Hazmi both moved into apartment Parkwood
Apartments, 6401 Mount Ada Road, San Diego, California on Febru ary 5,
2000. The rental application shows that Al -Mihdhar and Al -Hazmi resided
with Omar A. Al -Bayoumi at apartment of the same apartment complex,
San Diego, California, before renting apartment . Prior to that,

2 Al-Mihdhar and Al -Hazmi claimed the y were in Saudi Arabia. Interviews
conducted at the Parkwood Apartments have reported that other residents
recognized the photograph of hijacker Hani Hanjour as visiting the
apartment complex. No records have been found that confirm Hanjour's
presence at the apartment complex.
The term of Al -Mihdhar and Al -Hazmi's lease was for four months.
Al-Bayoumi was listed as the guarantor and co -signer because Al -Mihdhar
and AL-Hazmi did not have established credit. Al -Mihdhar and Al -Hazmi
vacated the apartment on May 31, 2000, and left no forwarding address.
The records of the Parkwood Apartments show that Omar Ahmed
Al-Bayoumi and his wife Manal A. Bagader, with their children,
and moved into the Parkwood Apartments 6333 Mount Ada Road,
Apartment on or about September 1, 1999. According to the records
of the Parkwood Apartments, Al -Bayoumi and his family moved out of their
apartment on June 23, 2001.
Contact with the U.S. Postal Service determined a mail
forwarding notice was submitted for Omar Al -Bayoumi on June 23, 2001.
The notice requested all mail delivered to Al -Bayoumi at apartment 152
be forwarded to apartment Contact with the apartment management
has determined the occupant of apartment during June 2001 was Abdallah
Al-Towayan.
Review of rental records has determined Towayan Abdallah
Al-Towayan, date of birth moved into 6401 Mount Ada
Road, Apartment San Diego, CA on April 6, 2001 and moved out August
5, 2001. Al -Towayan was accompanied by
and Rental records further indicate
Al-Towayan held Oregon Identification Card issued October 18,
2000, expires September 2, 2008. The Identification Card list an address
of , Portland Oregon, 97203.
Interviews conducted at San Diego have identified Al -Towayan
as having contact with Hani Hanjour, one of the hijackers of American
Airlines Flight 77 which crashed into the Pentagon. Al -Towayan has been
identified as being the recipient of a desk moved from Al -Bayoumi's
apartment during June 2001. Although Al -Bayoumi was not present when
the desk was moved, a witness has identified Hani Hanjour as having helped
move the desk from Al -Bayoumi's apartment to Al -Towayan's.
Al-Towayan is reported by a witness to have said he was leaving
San Diego to study English at the University of Oregon.
An individual residing at 6555 Mount Ada Road, Apartment
San Diego, California, has been identified as a possible associate of
Al-Bayoumi and Al -Towayan. The individual, as listed on his California
drivers license, is has reporte d his association
with Al-Bayoumi was limited to working on Al -Bayoumi's computer however,
rental records identify as the emergency contact for Al -Bayoumi

Al-Towayan had requested the apartment manager forward any return of
his deposit to at apartment
Pursuant to a search warrant for mail delivered to Al -Bayoumi
and Al-Towayan, telephone records for Al -Towayan were obtained. A review
of these records indicates a call from Al -Towayan's telephone number
to on July 31, 2001. ACS identifies the above number
as being subscribed to by Saudi Arabian Airlines, 725 5th Avenue, New
York, New York. An additional call as reflected on the enclosed telephone
bill was place d to telephone number which was referenced
in Milwaukee file number on May 11, 2000. A third telephone
number appearing on the enclosed billing, has been
identified as being subscribed to by
Apartment Ashland, Oregon 97520 -7308.
Other telephone numbers as reflected on the enclosed telephone
bill are being provided to Portland and Medford for subscriber checks
as deemed appropriate.

On 09/24/2001, Abdussattar Shaikh (a.k.a. Sattar Shaikh)

, was interviewed at his residence. After being advised of
the identities of the interviewing agents and the nature and purpose of
the interview, and after being advised that he could terminate the
interview at any time, Shaikh voluntarily provided the following
information:
(This interview was Shaik's second by the FBI pertaining to
the terrorist attacks on 09/11/2001. Shaikh was interviewed on
09/14/2001 by SAs and of the
San Diego Division during a consensual search of his residence. The
results of that interview are contained in a separate FD-302.)

Shaikh has experienced a diminishing of his leadership at the
ICSD which he attributes to the rise in power in recent years of
Palestinian Arabs (hereinafter Arabs) in San Diego's Islamic community.
Shaikh describes Palestinian Arabs as Middle-eastern Muslims who are
neither Indian nor Pakistani. The Arabs have increased in numbers in
San Diego in recent years. They have also become more hostile to
Americans and western culture with the increasing tension between Arab
countries and Israel. Arabs would not tolerate an Indian or Pakistani
in a position of power at the ICSD.
With regard to the difference between Arabs and Indian and
Pakistani Muslims, Shaikh attributes the facts that Indians and
Pakistanis generally speak English to one another and socialize outside
of the mosque as the primary reasons for the divide. Arabs see the
Indians and Pakistanis as less than true Muslims. Shaikh sees the
divide as a political and cultural one rather than as a religious one.
Arabs tend to look down on Indians and Pakistanis. Arabs make it clear
in the San Diego Muslim community that any attempts to integrate into
the American culture are not appropriate. Shaikh has conflicted with
Arabs because he advocates more assimilation than the Arabs will
accept. One example of this conflict was manifested when Shaikh
attempted to use his position on the Police Advisory Board to lobby the
local government to accept more Muslim applicants into the Police
Academy. Shaikh was successful in his efforts to open the door of the
Police service to Muslims but he was unable to find any Muslims who
would be willing to apply.
Generally, the local Arab Muslim community does not speak
openly with one another about their hostility toward Americans and
western culture. Shaikh attributes this to the fact that Arabs are
always concerned about police infiltration of the mosques and the
community. Shaikh is aware of sentiments in the Arab community that
the known terrorist Usama Bin Laden (hereinafter UBL) is not
responsible for the terrorist acts to which the United States
attributes him. Shaikh is aware from his travels to Saudi Arabia that
the view of UBL as a victim of the West is common among the Arabs there
as well.
Shaikh has viewed much Muslim fund-raising in San Diego. He
is aware that the groups which coordinate the fund-raising do so for
political support, as well as charitable support, of Muslim causes in
the Middle-east. Shaikh believes that most Muslims who contribute to
these groups are not aware of what causes their money funds. Most
think they are making a charitable donation to build mosques, etc.,

when, in fact, their money may be used to finance a political group
which engages in terrorism.
With regard to other conflicts between sub-groups within the
Muslim community, Shaikh is aware of an ethnic/nationalistic class
structure. Saudi Arabians are regarded as the highest level of Muslim.
Other Arabs, including those who have emigrated to Saudi Arabia from
such countries as Yemen and Egypt, are regarded as second-tier Muslims.
Yemenis and Egyptians provide the menial labor force in Saudi Arabia.
Non-Arab Muslims such as Indians, Pakistanis are considered third-tier.
Arabs tend to harbor strong negative racist feelings toward African
Muslims. Arabs will, however, work with the Indian and Pakistani
Muslims as well as the African Muslims to achieve their political
goals. Presently, there exists tension between Yemeni Arabs and Saudi
Arabian Arabs because the Saudi Government expelled many Yemenis who
were living in Saudi Arabia during the Gulf War since Yemen supported
Iraq.
As a side note, Shaikh has knowledge that the non-Muslim
Chaldean Iraqi community in San Diego received money to build its
temple in San Diego from Saddam Hussein. Chaldeans come to the United
States as refugees, however, Shaikh is aware that Chaldeans face no
true political threat in or from their native Iraq. In fact, the
Chaldean community maintains close political and financial ties to
Iraq.
(At this point in the interview, Shaikh was shown photographs
of 23 individuals who have been identified by the FBI as potential
subjects or associates of subjects in the attacks of 09/11/2001. These
photographs will be included with writer's notes in the FD-340.)
Upon viewing the photographs of numbers 7. Wail M. Al Shehri,
8. Waleed M. Al Shehri, and 12. Marwan Al Shehhi, Shaikh indicated that
these individuals looked familiar from the ICSD Mosque but he was
unable to remember their names or offer any information about them. He
positively identified numbers 1. Nawaf M. Al Hazmi (a.k.a. Nawaf
Alhazmi), 3. Khalid Al Mihdar (a.k.a. Khalid Almihdhar, Khalid
Almihdar), 20. Omar Albayoumi, and 21. Omar Saleh (a.k.a. Omar
Bakarbashat). Shaikh was unable to identify any of the other numbered
photographs.
Shaikh provided the following information on those
individuals he was able to positively identify:

Shaikh knew Alhazmi as a quiet and pleasant young man. He
described their relationship as close; in many ways like a father and
son. Shaikh first met Alhazmi at the ICSD. (LNU), an employee of
the ICSD, introduced Shaikh to Alhazmi and Alhazmi's friend Khalid
Almihdar (hereinafter Almihdar)(see below). The purpose of the
introduction was to ask Shaikh if he would rent a room in his home to
Alhazmi and Almihdar. He agreed and the two younger men moved in
sometime between May and August of 2000. It is Shaikh's understanding
that the two were living in an apartment on Mt. Ada Street in San Diego
prior to moving in with him. The two shared a Toyota vehicle.
Alhazmi and Almihdar told Shaikh that they were from Makkah
(a.k.a. Mecca), Saudi Arabia. Shaikh believes that Alhazmi was Yemeni
because of his facial bone structure. Almihdar indicated that the two
were fishermen before immigrating to the United States. Shaikh
determined that the two men were from a poor part of Makkah because
they were very light eaters and always sat on the kitchen floor when
they ate. Further, both men always ate in accordance with Islamic
tradition; never eating non-kosher foods, etc. Shaikh was not included
in their eating rituals.
Alhazmi came to the United States on a student visa. He
carried a Saudi Arabian passport. He told Shaikh that he immigrated on
a visitor visa. Shaikh believes that Alhazmi lied to him about the
nature of his visa because he did not attend school full time and he
was in the United States for longer than the six month period granted
to holders of visitor visas. Shaikh is aware that Alhazmi's visa
expired in June of 2001. Alhazmi did attend an adult school on 52nd
Street in San Diego to improve his English.
Alhazmi once indicated to Shaikh that he was interested in
finding a Mexican woman, who also attained American citizenship, to
marry so that he would be able to become an American citizen himself.
Shaikh is aware that Alhazmi used an online dating service to find a
Mexican woman but was unsuccessful in finding one.
Shaikh recalls being surprised about how much Alhazmi knew
about governmental systems in the United States. An example of this
knowledge was manifested when Almihdar transferred ownership of the
Toyota vehicle he shared with Alhazmi to Alhazmi. Alhazmi asked Shaikh
if he would assist them in the transaction due to his superior mastery
of the English language. Alhazmi was concerned about the taxes he
would have to pay if the transfer documents indicated the true sale
price. Alhazmi also used Shaikh to help them open an account at Bank

of America. Between the two of them, Alhazmi was clearly the smarter
one.
With regard to the account at Bank of America, which the two
men opened with $3,000.00 cash, Shaikh always wondered where they
received their money. They never worked, but always seemed to have
money available. They did not fit the profile of rich Saudi Arabians.
It is a cultural insult to question one about their finances for
Muslims so Shaikh never discovered where the money came from.
Alhazmi was a devout Muslim. He would join Shaikh each
morning at 5:00 a.m. to pray for approximately 15 to 20 minutes.
Shaikh would usually go back to bed. Alhazmi would sit on the kitchen
floor and meditate for hours with a set of rosary beads. Alhazmi
frequently attended the mosque at ICSD. While at the mosque, Alhazmi
always prayed alone. He did not socialize like most of the other
Arabs. Alhazmi never accompanied Shaikh to the Mosque; he always went
by himself. Alhazmi did, however, always dress in western attire.
Only in his passport photo has Shaikh seen Alhazmi in traditional
headdress.
Alhazmi and Shaikh only once engaged in a political
conversation. The nature of the conversation was about the money held
by the Saudi Arabian royal family and how Alhazmi felt that the people
of that country should share that money. Alhazmi did not seem to like
the decadence of the Saudi royal family.
Alhazmi indicated that he intended to take flying lessons in
San Jose, California. He told Shaikh that pilots were scarce in Saudi
Arabia and that one could make a good living there with a pilot's
license.
Shaikh only knows Alhazmi to have socialized with Almihdar,
Omar Albayoumi (hereinafter Albayoumi) (see below), Omar Saleh
(hereinafter Saleh) (see below), and an unidentified male who Alhazmi
brought to the house just before he moved out. (Shaikh was shown a
photograph of Hani Hanjour for a second time to determine if the
unidentified individual was him. Shaikh was unable to provide a
description of the unidentified male, but was positive that he did not
recognize Hani Hanjour.) Alhazmi virtually never went out of the house
during the day. He frequently went out at night. Alhazmi did not use
Shaikh's telephone. Shaikh recalls Alhazmi using pre-paid calling
cards to make telephone calls using local payphones. He has since
discovered that Alhazmi had a cellular telephone though he never saw
Alhazmi using it. Alhazmi would also use the public library computers

to e-mail individuals unknown to Shaikh. Occasionally, Alhazmi would
use Shaikh's computer for this purpose as well.
During his last days at Shaikh's house, Alhazmi had to go to
the San Diego Airport. Shaikh never learned the purpose of this trip.
Alhazmi moved out of Shaikh's house on 12/10/2000. Shaikh is
certain of this date because the day after, 12/11/2000, he received a
letter from the United States Immigration and Naturalization Service
(INS) for Alhazmi. Shaikh remembers clearly writing on the back of the
envelope that Alhazmi moved out on 12/10/2001. When he left, Shaikh
told Alhazmi that he wanted to keep in touch.
In January, 2001, Alhazmi called Shaikh to tell him that he
was in Arizona taking pilot's lessons. On 01/10/2001, Alhazmi e-mailed
Shaikh to check in and tell Shaikh that he was doing well. He signed
the e-mail Smer - a misspelled version of the common Arabic name Samir
- to conceal his identity. Shaikh did not understand at the time why
Alhazmi would want to conceal his identity. Between 12/10/2000 and
01/10/2001, Alhazmi sent Shaikh three such e-mails. Alhazmi's address
was
Khalid Almihdar
Shaikh described Almihdar as dim-witted and much less
friendly than Alhazmi. Almihdar had no sophistication and seemed to
have little interest in doing much of anything. He spoke strictly
Arabic and knew little, if any, English.
Almihdar was carrying a Saudi Arabian passport like Alhazmi.
It was clear to Shaikh that he was truly of Yemeni descent; again
because of his facial features.
Almihdar lived with Shaikh for only about six weeks. During
that time, Almihdar never engaged Shaikh in any type of substantive
discussions. Alhazmi and Almihdar were very careful to refrain from
substantive discussions between them as they were aware that Shaikh
spoke some Arabic.
Though he was not as smart as Alhazmi, Almihdar seemed to be
in charge of the money they shared. After Alhazmi and Shaikh opened
the account at Bank of America, Almihdar seemed to control it.
Further, he had access to more than one credit card while Alhazmi had
none.

in San Diego. Albayoumi once told Shaikh that he received money from
his family in Saudi Arabia. Shaikh did not believe him because
Egyptians living in Saudi Arabia do not generally have money.
Albayoumi clearly did have access to a significant source of
money. Shaikh witnessed him driving a new beige 4 door Toyota vehicle.
He spent a lot of money while he lived in San Diego. For example; for
the birth of his youngest daughter, Albayoumi threw a party at the ICSD
mosque. Many people from the Islamic community attended this party.
The party was catered and Albayoumi paid for everything.
Albayoumi was a member of Toastmasters, a public speaking
club in San Diego. He is very charismatic, charming, and does not mask
his attempts at inserting himself into leadership positions in the San
Diego Muslim community.
Albayoumi has, on several occasions, indicated to Shaikh that
he would like his help in becoming a citizen. Albayoumi is married so
he is unable to attain citizenship through a sham marriage; the way
many Arab men who come to the United States on visas do. Shaikh does
not trust Albayoumi and has not endeavored to help him. Albayoumi
sought out close associates of Shaikh to encourage them to lobby Shaikh
to help him attain United States citizenship. Shaikh always thought
this aggressive pursuit of Shaikh's help was strange. Now, in
hindsight, Shaikh thinks Albayoumi's efforts were to create a false
image of his desire to integrate into the United States. Albayoumi,
Shaikh believes, was trying to use Shaikh as an alibi and to make the
mosque attendees who are not hostile to the United States comfortable
with him. As far as Shaikh is aware, Albayoumi never attained
citizenship or even received a resident green card.
Alhazmi once told Shaikh that Albayoumi is a spy for the
Saudi Arabian Government. Alhazmi further told him not to associate
too much with Albayoumi.
Albayoumi attended the United States International University
where he took business classes. Albayoumi has also been back and forth
to England twice in the past two years. He indicated to Shaikh that
his trips to England were to attend school there. He further indicated
that he was the President of a Saudi Arabian club at the university he
attended.
Shaikh is aware that Albayoumi was provided an office at the
Kurdish mosque in El Cajon, California. Shaikh believes that the

leadership neither liked nor trusted Albayoumi and asked him to leave
approximately three years ago.
Shaikh does not trust Albayoumi and believes that it is
possible that he had something to do with the bombings which occurred
on 09/11/2001.
Omar Saleh (a.k.a. Omar Bakarbashat)
Saleh is of Yemeni descent though he claims Saudi Arabian
nationality. He has family in Saudi Arabia and Yemen. Shaikh first
met Saleh when he was introduced to him by Alhazmi. Saleh was an
associate of both Alhazmi and Almihdar. The purpose of the
introduction was because Alhazmi thought Saleh might be able to fix
Shaikh's broken computer. As it turned out, Saleh knew very little
about computers and was not able to fix the problem.
Saleh would frequently call Alhazmi at Shaikh's house. On
one occasion, Saleh called for Alhazmi when Alhazmi was not home.
Saleh told Sheikh to call him at the Texaco gas station where he,
Saleh, worked. Shaikh later learned that the Texaco gas station where
Saleh worked was located at the corner of University and Spring Streets
in La Mesa, California. This station, Shaikh is aware, is owned by a
Palestinian Arab named (LNU) (hereinafter ). Shaikh has
met once. He is a tall, thin man.
On 08/17/2001, Saleh approached Shaikh at his home to ask if
Shaikh might have a room where he could stay for a few months. Shaikh
said that he did and Saleh immediately moved in. During the entire
time he lived with Shaikh, Saleh spent little time at the house. He
would work a lot and go out at night.
Saleh once told Shaikh that he "helped people" in a financial
context. Shaikh thought it strange that Saleh was in the business of
helping people financially when he seemed to have little in the way of
financial resources himself. In hindsight, Shaikh thinks that this
comment may have pertained to his relationship with Alhazmi and
Almihdar and that he may have been a conduit between them and whoever
was funding their terrorist activities.
On 09/11/2001, the date of the terrorist bombings on the East
Coast of the United States, Shaikh and Saleh were watching the
television coverage of the event. Shaikh was in shock and would make
comments to Saleh to the effect of how tragic the events were and how
terrible the loss of life was. Saleh remained silent with his arms

crossed in front of him. Though he was clearly interested in the
television coverage, he showed no emotion and did not make any comments
in agreement with Shaikh's opinions. After the event, Saleh was less
friendly with Shaikh. When the two did spend time together, Saleh
seemed somber and rarely spoke. Shaikh attributed the breakdown of
their friendship to his (Shaikh's) opinions about the horrible nature
of the bombings.
After the first FBI visit to Shaikh's residence on
09/14/2001, in connection with the events of 09/11/2001, Saleh became
even more withdrawn and began to look very worried. One day, Shaikh
sat down with Saleh and asked him why he was acting so strangely.
Saleh told him with some flippancy that he did not care about the FBI's
investigation because he did not do anything. Shaikh just let the
issue go even though Saleh's behavior indicated to him that he did care
a great deal about the investigation.
(Shaikh was cooperative during this interview. A third
interview of Shaikh was conducted on 09/26/2001, the results of which
will be reported in a separate FD-302.)

would take Dyson to get something to eat up in LA after going to the

permissible and is a type of food Muslims are allowed to eat. On this
day, Al-Bayoumi and Dyson left San Diego from the Parkwood Apartments.
Al-Bayoumi drove to LA in his gold Nissan. They went to the Saudi
Consulate and Al-Bayoumi got his visa paperwork straightened out. Al-
Bayoumi dealt with an older, bald man, with a big beard at the
consulate. The man was in his late thirties or early forties.
After leaving the consulate, they proceeded to the
Mediterranean restaurant Al-Bayoumi was speaking about. Dyson does not
recall the name of the establishment, but it is near Culver City and
the I-405 freeway. It is also near the Culver City mosque. Al-Bayoumi
told Dyson that he wanted to show him the Culver City mosque, which was
built by the Saudi government. While at the restaurant they ate
together. No other events occurred. They did not meet with anyone
else at the restaurant. After they ate, they went to the Culver City
mosque for prayer and then came back to San Diego. They returned to
the Parkwood Apartments. Except for the time Al-Bayoumi was meeting
behind closed doors at the consulate, Dyson was with Al-Bayoumi the
entire time during the trip. Al-Bayoumi did have his cellular
telephone on this day and was using it as normal. Dyson has used
Bayoumi's cellular phone in the past to make an isolated call here and
there when together, but does not recall whether he used the phone on
that particular day. Dyson could not recall the exact date of this
trip.

Investigation by San Diego revealed that
Abdussattar Shaikh (Shaikh), is a year old naturalized U.S
citizen, born in Shaikh, a devout Muslim, arrived
in San Diego, California, from San Francisco, CA, 1970. He is one of
the original founders in 1977, of the San Diego Islamic Society, or
the Islamic Center of San Diego (ICSD). After the Gulf War of 1991,
in an effort to reduce the ethnic tension between the local Islamic
community and the rest of the SD residents, Shaikh and others helped
found the National Conference of Community Justice, or the
Interreligious Council of SD (NCCJ). Shaikh is a member of the SD
Police Department Advisory Board.
Shaikh, on 05/2000, or 08/2000, allowed Nawaf
Alhazmi and Khalid Almihdar, both of whom were involved in the
09/11/2001, AA Flight 77 attack on the Pentagon, to stay in his San
Diego residence, at Lemon Grove, CA.
Omer Bakarbashat, an associate of Alhazmi and Almihdar, also lodged
at Shaikh's residence. Shaikh indicated that he also knew and
socialized with Omar Albayoumi. Shaikh couldn't identify any other
of the suspected terrorists, or associates of the terrorists who
attacked U.S. targets on 09/11/2001. Shaikh advised that he had no
prior knowledge that anyone was planning to attack targets in the
U.S., and that he didn't have any participation in any of those
attacks. Shaikh advised that Bakarbashat, Almihdar, and Alhazmi were
introduced to him by Mohder Abdula, an associate of Yazeed Alsalmi.
Shaikh participated in Islamic religious rituals with all of the
above mentioned individuals, at the local Mosque.

On 09/29/2001, Shaikh voluntarily appeared at the offices
of the FBI in San Diego, CA, for a scheduled polygraph examination.
Shaikh was admonished via Forms FD-328 (Consent To Interview With
Polygraph) and FD-395 (Interrogation: Advice Of Rights), which were
read to and by him; Shaikh stated he understood, and he signed.
Thereafter Shaikh advised that he didn't have any prior knowledge or
participation in any of the terrorist attacks against any U.S.
targets on 09/11/2001.
Shaikh was afforded a polygraph examination consisting of
the following relevant questions:

According to AL BAYOUMI's wife, the f amily has only been in
the residence three days. Prior to that they lived at
for a period of three weeks. Prior to that, AL BAYOUMI's wife was in
Saudi Arabia for a period of three months. Before that, the family resided
in San Diego a t the address previously furnished by San Diego Division.
Preliminary reporting on the results of the search indicate
that a computer, some correspondence, a telephone, and a mobile telephone
were seized. No further details available at this time.
All four suspects can be held for 48 hours. After that, New
Scotland Yard will have to petition the Circuit Judge to continue the
detention.
New Scotland Yard anticipates attempting to interview
on Saturday, September 22, 2001.
New Scotland Yard has requested the following information
regarding ties to the individuals responsible for captioned
attacks:
- The ties, telephone, residences, dates of occupations, links
to flying schools, between and HANI HANJOUR and NAWAF ALHAMZI .
- With respect to the flying school:
a) Were these individuals in the same class?
b) Did they make individual or group bookings on flight
simulators?
c) How may flight simulators were available at the flying
school, and their ge ographical proximity?
d) Do Jet Tech records show this group sharing
flight time together?
e) Do the students have briefings and debriefings, and
if so, their content.
Phoenix Division is requested to review all available
information regarding O MAR AL-BAYOUMI and provide Legat with a document
suitable for dissemination to New Scotland Yard that summarizes the FBI
information on BAYOUMI and his ties to the subjects in captioned
investigation.
Basically, New Scotland Yard is looking for anything to counter
claims by that his ties to HANJOUR and ALHAMZI are circumstantial
and not criminal.

A federal control agency for e ntries and departures by
foreign nationals does not exist in Germany. Thus it is not
possible to obtain proof concerning an entry or departure of Mohdar
Mohamed ABDULLAH, alias Mohdar Mohamed AL MOHDAR ZEID. Inquiries
with respect to a possible applicati on for a visa by ABDULLAH
were negative. However, we must point out that such data in
Germany may only be stored until the expiration of the visa.
Thus it is not possible to make statements concerning
trips made in Germany by Mohdar Mohamed ABDULLAH, a lias Mohdar
Mohamed AL MOHDAR ZEID.
Should the furnished data be required in a form suitable

2 INFORMATION FROM NEW SCOTLAND YARD REGARDING
1. The past seven days have seen the interview teams subjecting
the property seized to a detailed examination and assessment.
A substantial amount of documentation was recovered from the
searches of the addresses, and this has now been fully copied
and sent to New York for the FBI Field Office to commence their
review of material.
2. In direct consultation with our existing Holmes Management
System, we have implemented a system whereby all high priority
actions can be raised in an expeditious manner. This allows the
investigative team the flexibility to pursue key areas of
investigati on and open up new lines of enquiry.
3. Significant areas of investigation for include the
following:
a. passport which has the United States entry
stamps missing and suggests that he possesses or uses another
passport of unknown origin.
b. The investigation into an associate in Montreal,
Canada.
c. Enquiries with a UK based travel company which appears
to have been used by on a regular basis to arrange travel
abroad.
d. The analysis of telephone billing and compilation
of frequ ency charts together with the request for subscriber
checks to be undertaken.
e. Further enquiries into his travel arrangements to
stay in Las Vegas on three possible occasions.
f. Enquiries in the USA clarifying the exact role played
by and link ing the material seized with enquiries already
undertaken by the FBI .
4. An evidential financial profile of is being
prepared by and is expected to take 2 -3 weeks to complete
in full.

3 American authorities have until 29 November to prepare a prima
face case.
INFORMATION FROM NEW SCOTLAND YARD REGARDING OMAR AL -BAYOUMI
1. Research so far has shown that BAYOUMI lived and worked in
Saudi Arabia. He initially gained employment with the Saudi
Arabian, Civil Aviation Authority (CAA), working within the
Finance Department. Whilst in employment he was awarded an
education sponsors hip through his company. BAYOUMI left Saudi
Arabia and went to America to study, arriving initially in Florida
but subsequently traveling to California. From documentation,
we can show that he attended at least five universities in Los
Angeles and San Dieg o and that he studied primarily English.
2. We can show that BAYOUMI and his family lived in three different
properties in San Diego. BAYOUMI purports to be a religious man
and documentation links him to at least four mosques in Los Angeles
and San Diego. He was made a trustee by a SAAD AL HABIB and given
$500,000 to purchase and run a mosque. He purchased a building
located in El Cajon, near San Diego, where he became the leader
of the mosque.
3. Found in a search were numerous letters from BAYOUMI reque sting
money from prominent figures in Saudi Arabia to support his mosque.
Documents reflect that numerous donations were being made from
BAYOUMI. Photographs that have been seized show BAYOUMI and a
number of young Arabic males attending social events in t he mosque.
These photographs are currently being examined in order to
identify any known hijackers.
4. BAYOUMI'S income whilst in America appears to have come
primarily from sponsorship by the CAA in Saudi Arabia. A number
of bank accounts and credit card s have been identified, and a
preliminary examination indicates that large sums of cash are
going in and out of his account. Financial investigators are
examining BAYOUMI'S accounts in more detail.
5. In 1999 to 2001, BAYOUMI made numerous trips to Saudi Arabia
and Europe, always appearing to travel alone. For example, he
traveled alone to Paris in 2001 (Exhibit .
6. In October 2001, BAYOUMI arrived in the UK after having applied
to numerous universities. He was accepted at Aston Univers ity
for a PhD in Business Studies, and he rented a flat on the
university campus. There is various documentation relating to

4 his course at the university. Passport documentation reflect
that his family arrived in the UK in July 2001.
7. Regarding BAYOUM I'S presence in the UK, numerous documents
relate to his having membership in the Birmingham and Leicester
Saudi clubs. These are being researched to identify any links
between the hijackers and BAYOUMI.
8. BAYOUMI has numerous documents relating to relig ion. However,
exhibit is a document with anti -American sentiments relating
to the Gulf war.
9. There are a number of videos, floppy disks and documentation
still to be viewed.
10. A review of documents relating to operations at the mosque
suggest p ossible financial improprieties.
11. Significant areas of investigation of BAYOUMI remain and
include:
a. The continuing analysis of data found in BAYOUMI'S
telephone book and the list of his associates throughout the world.
b. Enquiries into the list of the "Saudi Club" members
include names identical to those of the hijackers. Actions
relating to them were undertaken as a matter of priority, and
initial indications are that they are not identical with the
terrorists.
c. Analysis of the large quantity of photographs which
show AL-BAYOUMI in the USA with groups of Arabic males. (an album
is being produced to aid identification and will be forwarded
to the relevant law enforcement agencies in the USA.)
d. Analysis of data from the various computers continues
and will take some time to complete.
e. Large amounts of correspondence remain which
require the services of Arabic translators. END REPORTING.
NOTE: New Scotland Yard provided Legat with copie s of
all recovered exhibits to include mirror images of all computers
and records pursuant to the arrest and searches of and
AL- BAYOUMI. The aforementioned exhibits were previously sent
to FBI-New York via Federal Express.

Since September 11, 2001, NSY has hosted meeting in the U.K.
and/or traveled to the U.S. for meetings with FBI San Diego (Omar
Al-BAYOUMI), FBI Boston (REID), FBI Minneapolis and New York (MOUSSAOUI),
and FBI New York . During these meetings, NSY provided the FBI
with copies of material recovered as a result of searches or investigation
conducted in the U.K.
The NSY exhibit sheets being provided to New York include some
material previously provided. This shipment is not intended to be ALL
INCLUSIVE. NSY continues its in vestigations into subjects of interest
to the FBI and additional exhibits will be generated in the future.
Additionally, Legat notes that in many instances while NSY has provided
Legat with an exhibit sheet for a particular item, the item itself has
NOT be furnished; i.e. video and audio tapes, and some non -relevant items.
NSY continues to review, process, and duplicate these items.
As noted, for technical reasons NSY was unable to put the Index
of Books on a CD -ROM or floppy disk. This makes indexing o r locating
a particular exhibit difficult. As an example, London has determined
that besides Book 76 - MOUSSAOUI Investigation, matters related to
MOUSSAOUI are included in Book 1 - Miscellaneous. Also, other than one
(1) small box marked "Manchester Sear ches" (MOUSSAOUI investigation),
the exhibits were provided to Legat in four (4) boxes co -mingled, in
no particular order.
As a result, each individual page in each individual book would
have to be reviewed to locate all exhibits relating to a particular subject.
To expedite this process, Legat requests that the NYO
arrange to have the Index of Books scanned and placed on a CD -ROM. Once
on a CD, a 'word search' can be conducted to locate all exhibits related
to a particular subject.

of cancelled checks, Al -Bayoumi occasionally paid the rent for Al -Mihdhar

the name was on the boarding list for Flight AZ622 of
07/21/2001 from Milan -Malpensa to Los Angeles. Subject was in fact on
the flight. Subject purchased his ticket at the travel agency "Legend
Tours Swaifeih" located in Wadi Essir, Amman, Jordan.

2 11 This tape is of poor video and audio quality. It depicts
Al-Bayoumi and his family at what appears to be Sea World in
San Diego, unknown date. It also shows a social event at a
mosque which appears to be the mosque located on Balboa Avenue
in San Diego. There is a short part of the tape that shows
people traveling in an unidentified car. Almost all audible
speaking is in Arabic.
Later in the tape, paint ball battles are shown. The event
takes place in an unpopulated, rural area. The person who
is filming is not identified, however, Al -Bayoumi is not seen.
The men are dressed mostly in military fatigues. There are
only a few men, among a larger group, that do not appear to
be of middle -eastern decent. Most speaking is in English,
but some is Arabic.
Following this part of the tape, Al -Bayoumi is reading out -loud
from a book or document. The camera is fixed on him. The
setting looks like a livingroom. No other people can be seen
or heard. Bayoumi is looking at the camera as he reads in
Arabic. T his goes on for quite a while.
Lastly, there is a social event taking place in and around
the Balboa mosque. SA recognized the building and
surrounding neighborhood. It is not otherwise identified.
There are inflatable kids' play activity things , live camels,
and other carnival looking activities. There is a large crowd,
with lots of kids. The date was not determined.
13 This seems to be a duplicate tape of the paintball war segment
of tape 11. It is in color, and has better audio and v ideo
quality. Most conversation is in English. It shows men
eating lunch at their cars. The license numbers are not
visible. The location is not identified in the tape.
14 This tape depicts the meeting of several men at an apartment
described by Some of the mens' faces can be seen,
but others positioned so that they can not be seen by the camera.
All but a few words spoken by Al -Bayoumi to are in Arabic.
The words that Al -Bayoumi speaks to or whoever is film ing
are in English. SA recognized the apartment where the
meeting was taking place as similar to the apartment of the
two subjects in , which has been identified in
the investigative file. SA has been in that apartment,
and recognized the particular configuration of the first -floor
apartment.
There is more vacation and social event activity on the tape,
but the quality of this video is too poor to determine where
the recording was made, and what the content was. The poor

. She stated she was familiar with most of the foreign
students because the school only enrolled an average of forty (40)
foreign students at any one time. At a maximum, the school enrolled
one hundred (100) foreign students.
' responsibilities included dealing with the
Immigration and Naturalization Service (INS) form I-20, reviewing
student payments, and ensuring that each student was registered and
attending classes. worked closely with who was
responsible for obtaining a residence for the students in either a
hotel or family home during the training.
During 1993 had very few middle eastern students. The
school employed recruiters in many regions in the world, but the school
did not employ any recruiters in the Arab regions. does not
specifically recall the name OMAR AHMED AL-BAYOUMI, but believes he is
the same individual who she recalls attended classes for approximately
one month during August 1993.
According to INS records OMAR AHMED AL-BAYOUMI entered the
United States during August, 1993 in route to .
stated that she recalled a telephone call from a man
with an accent believed to be middle eastern who stated that he had a
friend from Kuwait who wanted to come to the United States and enroll
in an English class. She believes the caller was from out of state or
at least from out of the south Florida area. She believes this because
it was necessary for the school to locate a residence for BAYOUMI
instead of him staying in his friend's home.

The unknown man gave her the necessary information to
complete the paperwork. believes she received a $750.00 check
from the man to pay for the costs of a one-month class, then mailed
the I-20 either to the unknown man or to the student believed to be
OMAR AHMED AL-BAYOUMI.
recalls a problem the school had with BAYOUMI. BAYOUMI
was assigned to reside with a family near the school, and the family
reported that BAYOUMI was rude to the wife of the house, which
resulted in BAYOUMI being removed from the home and a new residence
found for him. does not recall the name of the family, but
believes the last name began with an "F" and the family consisted of a
wife, husband and two children who lived within ½ mile of the school.

AVIATION BACKGROUND:
MUSTAFA has never taken flying lessons nor is he aware of
anyone who has.
II. Events of March, 2000 in San Diego, California
RE: OMAR BAYOUMI
MUSTAFA identified a photo of OMAR BAYOUMI, but could not
recall his name. BAYOUMI worked at the Medina Mosque in El Cajon.
MUSTAFA traveled with BAYOUMI on occasion to the Medina Mosque, which
MUSTAFA described as a Kurdish Mosque.
BAYOUMI had an office at the Medina Mosque, and MUSTAFA
remembered seeing a Saudi Airlines poster and speculated that perhaps it
was a Saudi Airlines office within the mosque.
MUSTAFA believes that BAYOUMI intended to return to Saudi
Arabia in 2000 and has the following contact telephone number in Saudi
Arabia for BAYOUMI:

might be.
BAYOUMI suggested they meet in Saudi Arabia sometime in 2000,
and MUSTAFA actually tried to contact BAYOUMI at the number provided
without success. MUSTAFA could not recall if MUSTAFA himself was in the
United States or Saudi Arabia when he tried to contact BAYOUMI.
BAYOUMI resided at the Parkwood Apartments near or between
the pool and the fitness center and had a son and two daughters.
BAYOUMI drove a "grey Nissan Sunbird."
MUSTAFA believes it was through BAYOUMI or perhaps at the
mosque across the street from the Parkwood Apartments wherein he met two
Saudi men identified by MUSTAFA as NAWAF AL-HAMZI and KHALID AL-MIDHAR.

AL-HAZMI, MUSTAFA immediately recognized the name NAWAF, but was still
unsure of AL-HAZMI or AL-HARITHY.
RE: KHALID AL-MIDHAR:
AL-MIDHAR had a flash temper and was viewed by MUSTAFA as
having low self-esteem and lack of self-confidence. MUSTAFA said that
AL-MIDHAR would oscillate between being exuberant and then becoming very
nervous and depressed.
AL-MIDHAR had a scar over his left eye and was missing a
front eye tooth. AL-MIDHAR was also from within or near Mecca, Saudi
Arabia, but apparently had a wife and child in Yemen. The child was born
while AL-MIDHAR was in the United States.
AL-MIDHAR also expressed interest in obtaining an American
wife, and was particularly interested in an American girl who worked at
a nearby Starbuck's. However, AL-MIDHAR could not speak English well, he
asked MUSTAFA to intercede on his behalf and talk to the girl for AL-
MIDHAR.
MUSTAFA refused because he thought it was foolish and MUSTAFA
didn't want to be part of something that he felt violated his religion,
namely AL-MIDHAR's interest in the girl though AL-MIDHAR was already
married.
AL-MIDHAR was mad at MUSTAFA for not helping him.
RE: WEB-TV and INTERNET ADDRESSES AT THE APARTMENT
While at the apartment, MUSTAFA helped them set up a WEB TV
account after first taking MIDHAR and HAMZI to the Target store near
their apartment.
As both AL-HAMDI and AL-MIDHAR were computer illiterate,
MUSTAFA helped select the right components (modem and keyboard), and the
purchase was made at the Target store on Balboa (near the Parkwood
apartments) using the Bank of America Visa card of AL-HAZMI and AL-
MIDHAR. (MUSTAFA explained that they shared one account.)
The men went back to the apartment and registered on-line
using the TV supplied by an UM Saudi from El Cajon, and set up the
account for $20/month using the Visa card shared by AL-HAMZI and AL-
MIDHAR.

AL-MIDHAR's E-mail account was or
AL-MIDHAR received a photo of his child from his
wife in Yemen, and used the internet to search for an American wife as
well.
MUSTAFA helped AL-MIDHAR set up a site for this, but said it
was not particularly a web-site, more like an advertisement.
Later in March, 2000, AL-HAMZI and AL-MIDHAR approached
MUSTAFA saying that they wanted to terminate the WEB-TV subscription as
only MUSTAFA got the best use out of it and they weren't using it.
RE: RECREATIONAL VEHICLE
In one instance, AL-MIDHAR and AL-HAMZI asked MUSTAFA to help
them in a transaction with an American individual of Lebanese descent
who spoke very little Arabic. The individual worked at a parking lot
with tent trailers and big recreational vehicles (RVs).
The individual is described as bald with a short salt and
pepper beard. MUSTAFA cannot recall the exact transaction, whether AL-
MIDHAR and AL-HAMZI were wanting to rent, buy or had rented or bought an
RV, but there was an argument which MUSTAFA believes was over $150.
MUSTAFA tried to act as an interpreter and did not like
getting caught in the middle of an argument, specifically given AL-
MIDHAR's hot temper. AL-MIDHAR became very angry during the exchange at
the RV lot.
The RV lot was in the business area of San Diego, but MUSTAFA
could not recall the address, other than it was not near the apartment.
MUSTAFA stated that AL-MIDHAR became mad at MUSTAFA, who only
acted as an interpreter.
RE: FURNISHING OF THE APARTMENT AND A U-HAUL
AL-MIDHAR and AL-HAZMI purchased a television as well as
furniture from an unidentified Saudi male from El Cajon. MUSTAFA went
with them to the El Cajon apartment to help them load and then unload a
square-shaped U-HAUL truck that rented for $19.99 per day.

2 Benomrane gave e xtra attention to the photographs of al Hazmi
and al Mihdhar, leading the interviewing agents to conclude that Benomrane
may have driven the two hijackers to San Diego, at the behest of al Thumairy.
Special Agents from the Counterterrorism Division, detai led
to the National Commission on Terrorist Attacks Upon the United States
(9-11 Commission), have conducted investigation in Los Angeles in an
effort to resolve whether al Thumairy or Benomrane had any contact with
the 9-11 hijackers al Hazmi and al Mihdh ar. This contact would have only
occurred during the period of time 01/15/2000 to 02/04/2000. It is possible
that al Thumairy asked Benomrane to driver some other Saudis to San Diego,
to break the tedium of protracted medical treatment.
As an alternativ e scenario, it has been determined that during
July 2001, al Thumairy rented apartment at the Avalon Westside
Apartments, 3636 Sepulveda Boulevard, Los Angeles, on the behalf of the
Los Angeles consulate. During that period of time the apartment was
occupied by , his son,
and his son in law .
. home was Riy adh. He may now be deceased.
The Counterterrorism Division would request that a very limited
interview of and be
conducted. The purpose of the interview would be to determine if either
or recognizes Benomrane as a taxi cab driver they
used during their stay in Los Angeles and if Benomrane drove the two

that in April, 2001, ALRABABAH met AL -HAZMI and HONJOUR, in Falls Church,
Virginia. ALRABABAH assisted the two in locating an apartment to rent
in Alexandria, Virginia. Shortly after this meeting, ALRABABAH then moved
to Bridgeport, Connecticut. Sometime in early May, 2001, ALRABABAH claimed
to have received a call from , , also
known as , and was requested by to return
to Virginia to assist HONJOUR and AL -HAZMI in their travel plans. In
May, 2001, ALRABABAH returned to Virginia, spent the night of May 7,
2001 in Alexandria, with HONJOUR, AL -HAZMI and two younger males, later
identifi ed as MOQED and AL -GHAMDI.
During the early morning of May 8, 2001 ALRABABAH drove with
the group to Fairfield, Connecticut, where he assisted them in getting
a motel room at the Fairfield Inn. The group was interested in getting
an apartment in the area . ALRABABAH attempted to assist them in this.
On May 11, 2001, the four departed from the Fairfield Inn, to parts unknown.
Subsequent investigation has the four later in New Jersey. ALRABABAH
claims to have last seen the group on May 11, 2001.
A consent search of ALRABABAH's apartment at
located a number of documents to include 5 money order receipts dated
8/22/01 totaling $2,150.00, and a U.S. Express Mail receipt dated 8/22/01
from Bridgeport, Ct in the amount of $12.45 and be aring destination code

On 10/16/2001, (the former manager for
telephone number , advised that the only former
tenant that might have knowledge of AHMAD would be Last Name Unknown
(LNU). LNU lived in apartment # for approximately two years
and held a high ranking position at the Mosque located on Washington
Blvd. in Los Angeles. After viewing AHMAD's photograph (provided by
Baltimore), indicated that she had never seen AHMAD before.
On 10/17/2001, the man ager of the apartment complex located
at said that his previous renter AL THUMAIRY left for
Saudi Arabia approximately one year ago. He added that AL THUMAIRY is
Syrian and that he was a member of the Mosque on Washington Blvd. The
manager advised that he had never heard of or seen AHMAD before.
On 10/18/2001, LNU, , Los Angeles,
CA 90034 advised that he recognized AHMAD but knew him by his nickname,
"ABULCAACAA." LNU previously lived in a different uni t in the
apartment complex in 1996. It was around that time that AHMAD came from
Texas and lived in unit # with (phonetic). AHMAD
lived with for approximately three months and then moved down
the street to the . LNU most recently saw AHMAD
three months ago at the Mosque on Washington Blvd. He did not know anyone
who would know AHMAD's current whereabouts.
All other checks regarding addresses or other information

(San Diego Field Office, TDY to Legat provi ded
the MPS with background information to aid in an interview of AL -BAYOUMI.
SA and SA were assigned TDY to Legat from
09/23/2001, to 09/30/2001. The purpose of the travel was to provide
the MPS with information concerning what wa s known about the relationship
between OMAR AHMAD AL -BAYOUMI and KHALID M. AL -MIHDHAR, NAWAF AL -HAMZI
and other subjects of this investigation.
Between 09/23/2001, and 09/28/2001, AL -BAYOUMI, in the
presence of his solicitor, was interviewed by law enfo rcement officials
of the MPS concerning AL -BAYOUMI's activities in the U.K. and his
association with subjects of this investigation. The FBI agents were
not allowed to be present in the room with the MPS interviewers and
AL-BAYOUMI while the interviews we re being conducted at the Paddington
Green Station of the MPS. The MPS asked for and was granted an extension
of the initial 48 -hour period allowed by law for such a detention so
that material collected pursuant to the searches of AL -BAYOUMI's residence
and office could be evaluated by the MPS before concluding the interviews.
During the course of the interviews, investigation in San Diego
revealed evidence of U.S. and immigration law offenses on the part
of OMAR AHMED AL -BAYOUMI. The office of the United States Attorney,
Southern District of California, sought and obtained an arrest warrant
for OMAR AL -BAYOUMI during the course of the interviews. The warrant
was based on a criminal complaint dated 09/27/2001, alleging a violati on
of the United States Code, Title 81, Section 1546. This violation is
identified as Fraud and Misuse of U.S. Immigration Documents, a Felony.
The warrant was signed by Magistrate Judge United States
District Court, Southern District of Ca lifornia. No bail is admitted.
The warrant data has been entered into the databases of The U.S. Treasury
Department and INTERPOL. The complaint and warrant were ordered sealed
under the Court's order.
Although the warrant described above authorizes the arrest
of OMAR AL -BAYOUMI, a provisional U.S. arrest warrant was not secured
as the U.S. Department of Justice determined on 09/28/2001, that the
immigration -related offense alleged did not fall within the regulations
of extradition from the U.K. to the U .S.
Additionally, the MPS did not allege any criminal activity
on the part of OMAR AHMED AL -BAYOUMI carried out in the U.K. that would
substantiate a continuation of his detention beyond the period authorized.
For these reasons, AL -BAYOUMI was released from custody without charges
on Friday, September 28, 2001.

Search results of AL -BAYOUMI's home and office are described
in this communication. Original documents and electronic data files
are maintained by MPS at the offices of Ne w Scotland Yard. Copies of
the original documents and electronically stored data from AL -BAYOUMI's
computers will be provided to Legat .
Another individual who was listed on the FBI's watch list was
detained on 09/21/2001 by MPS. This subject, was
interviewed by MPS concerning his association with subjects of this
investigation. did not answer the questions put to him
by the MPS, and he made no statements to the MPS officials during the
time he was detained. A provis ional warrant seeking the arrest of
and his extradition to the U.S. from the U.K. was obtained by
the U.S. Department of Justice on Thursday, 2001. On Friday,
/2001, was brought before a court and charged with the alleged
offenses set forth in the warrant. was remanded into
custody. No bail was admitted. is to appear before the same
court on , 2001, and on , 2001. A separate
communication covers those events.
The following is a su mmary of the interviews of OMAR
AL-BAYOUMI:
AL-BAYOUMI stated he traveled to Los Angeles, California, in
January 2000. He claimed he had a chance meeting with KHALID M. AL -MIDHAR
and NAWAF AL -HAMZI (both were hijackers aboard AA #77.) The chance
meeting took place in a Los Angeles, California, restaurant. After the
meeting, AL -MIDHAR and AL -HAMZI attended a San Diego mosque. AL -BAYOUMI
admitted to playing an administrative management role in the mosque.
After the second meeting, AL -BAYOUMI offered to assist them
with housing accommodations and took them to his apartment complex.
He arranged for them to get an apartment, he completed and signed the
lease as a guarantor, and he paid their rent. AL -BAYOUMI provided a
reference. (NOTE: MPS learned a Mr. (FNU) NORR was the reference, but
NORR denied knowing he was listed as such.) When he was questioned about
the falsity of the reference, AL -BAYOUMI became evasive and vague.
AL-BAYOUMI facilitated opening bank accounts for one of the
hijackers (NFI.) When questioned about the banking documents found in
his residence, AL -BAYOUMI became evasive. Despite being a qualified
accountant, he claimed to have not known the nature of a wire transfer.
In addition, AL -BAYOUMI did not give any det ails regarding a series
of cash deposits into his account. (NOTE: MPS understands these
deposits may have commenced at or around the time AL -BAYOUMI met AL -MIDHAR
and AL-HAMZI.)
AL-BAYOUMI hosted a religious party at the apartment of
AL-MIDHAR and AL -HAMZI, at which both hijackers were present.

AL-BAYOUMI admitted to being connected to a Saudi Arabian
company affiliated with the Saudi's equivalent to the Federal Aviation
Administration. This company paid AL -BAYOUMI $5,000 per month for him
to study for his Ph.D.
SEARCH RESULTS ( AL-BAYOUMI): Legat is aware MPS seized
voluminous amounts of information during the search of AL -BAYOUMI's
residence, vehicle and office. Inclu ded in the recovered items were
a laptop computer, several computer diskettes, a cell phone, numerous
video tapes, and many documents. MPS provided Legat with a mirror
of the laptop's hard drive and an assortment of documents. MPS continues
to review the seized information. MPS will retain all original evidence.
Copies of the items will be provided to Legat Recipients of
this communication will be provided with an update on the seized when
it becomes available.
Below is a summary of the items seized during the AL-BAYOUMI
search:
· A number of banking documents and evidence of travel between

residence. One video revealed the party at the hijackers'
apartment; however, they were not seen in that particular

and Keller Graduate School, Pomona, California regarding Omar Al -Bayoumi.
Details: As a result of the investigation being conducted at San Diego
it has been determined that Omar Ahmed Al -Bayoumi played an important
role in helping terrorists, Nawaf Al -Hazmi and Khalid Al -Mihdhar
assimilate into San Diego. Al -Hazmi and Al -Mihdhar were on Flight #77
that crashed into the Pentagon on September 11, 2001.
At the end of January, beginning of February 2000, Al -Bayoumi
allowed the two terrorists to stay at his apartment, at the Parkwood
Apartment Complex, prior to obtaining their apartment at the same complex
approximately two weeks after they entered into the United States through
Los Angeles, California. Since the terrorists did not have credit history
or bank accounts Al -Bayoumi was listed as the guarantor and co -signer
on their apartment, and on at least one occasion paid for their rent.
Additionally, he helped set up a bank account for Al -Mihdhar.
While Al -Bayoumi resided in the United States he attended
numerous schools and in December 1997, graduated from Alliant
International University (AIU), formerly United States International
University, San Diego, California, with a Master's Degree in Intern ational
Business Administration. In May 1998, Al -Bayoumi applied for an
Executive Doctorate, in the Management Program at the Weatherhead School
of Management, Case Western Reserve University (CWRU) in Cleveland, Ohio,

Al-Bayoumi stated that he has been employed by the Civil Aviation
Administration of Saudi Arabia (CAA) for at least 20 years and is also
associated with Dall ah/Avco Trans Arabia Company (DATA) as the Assistant
to the Director of Finance, in the Contracts and Finance Control Division,
PCA, Airways Engineering. Additionally, a letter dated May 16, 1998,
from Al-Bayoumi to Case Western Reserve University, disclo sed that in
1995 (and it is understood through the present) that Al -Bayoumi is
Assistant Director of CFC at DATA.
