Wood firm sues insurer over damage White City's Cascade Wood Products is suing its insurance company for more than $1 million in a dispute over who should pay for damage done by faulty products. The lawsuit was filed Monday in Jackson County Court. In it, Cascade Wood claims that Reliance Insurance Co. is refusing to pay on a property damage policy that Cascade believes should cover damage done by its products. The dispute arose out of another lawsuit -- a case filed in 1996 in which H. Window Co. sued Cascade Wood. H. Window claimed that defective products it bought from Cascade Wood bowed and caused glass windows to break. The window company sought $559,309 in out-of-pocket expenses and $570,540 in lost profits. Cascade filed a countersuit, seeking $78,766 for goods sold and delivered. A ruling in that case, brought in Minnesota state court, was handed down in September. H. Window was awarded $749,600 plus interest for a total of $828,366 -- less than the $1.1 million it was seeking. Cascade was awarded all $78,766 of its counterclaim. In November, a judge overturned that ruling and a new trial has been scheduled for March; H. Windows has appealed the judge's decision. Reliance Insurance Co. has continued to defend Cascade in the case but informed the company that it will not cover any damages that H. Windows is eventually awarded. Cascade contends that such losses would be covered under its bodily injury or property damage liability policy. The property damage policy covers $1 million per occurrence or $2 million aggregate losses. David Couch, Cascade's general counsel, declined to comment on the case. Cascade Wood Products was listed 71st on Oregon Business magazine's list of the state largest 150 private companies with sales of just under $100 million.
