Why wasn't the driver charged with a crime? Will the family of the deceased sue Big R? I surely hope they don't get away with this tragedy. -- Gloria H. More than three months after the industrial fatality at Big R Distribution Center in White City, the state Occupational Safety and Health Division (Oregon's OSHA) is still investigating whether the company violated any regulations that could have contributed to the Nov. 6 accident. Oregon OSHA officials said they expect to issue a report at the end of March on the accident, which claimed the life of worker Shane Watson, 18. Watson was crushed and killed when another worker lost control of a forklift. Advertisement Jackson County District Attorney Mark Huddleston chose not to file charges against the forklift operator, as there was no evidence he was under the influence or had committed any other criminal negligence. "It's always a judgment call to determine whether a case crosses the line to become criminal conduct," Huddleston said. "The reality is sometimes it is something accidental, and if he had done something else, it might not have happened. But criminal charges were not appropriate." The Mail Tribune could not reach Watson's family to find out whether they plan to sue Big R. A check of state court records indicates nothing has been filed to date.
