The ballot titles will be final unless they are challenged in Jackson County Circuit Court by Thursday, April 21. A “yes” vote on one ballot measure would prohibit recreational marijuana retailers from operating in the city, according to the ballot title. A second ballot measure, which would take effect only if voters approve sales of recreational marijuana in the city, would impose a 3 percent tax at the time of sale. Medford City Council in December passed an ordinance preventing medical marijuana dispensaries from selling recreational marijuana in the city. The city does allow medical marijuana dispensaries. Complete copies of both the ballot titles and text of the initiative petitions can be obtained at the City Recorder’s Office, City Hall, 411 W. Eighth St. The ballot titles are also available for viewing on the city’s website, www.ci.medford.or.us/Index.asp . A voter disputing the ballot title can file a challenge in Circuit Court seeking a different title and stating the reasons the proposed title is insufficient, not concise or unfair. The petition must name the city attorney as respondent. Any elector filing a petition is required to notify the city elections officer in writing that the petition has been filed. The notice must be given no later than 5 p.m. on the business day following the day the petition is filed with the Circuit Court.
