Kenneth W. Medenbach, 62, of Crescent, was ordered to obey all laws and not occupy federal land when he was released from custody Nov. 13 on misdemeanor charges of unlawful camping and unlawful occupying federal land during the Sugar Pine Mine standoff near Galice. U.S. District Magistrate Judge Mark D. Clarke ruled Medenbach violated that condition when he was arrested Jan. 15 for allegedly driving a stolen refuge pickup into Burns, where authorities said he was arrested in the parking lot of a grocery store. Medenbach has been in the Jackson County Jail since Thursday, when he was transferred from the Multnomah County Jail to take part in Monday's hearing. During the hearing, Medenbach denied violating the release conditions and represented himself. In the Sugar Pine case, Medenbach has filed motions to have his case dismissed based, in part, on claims the federal government does not own Bureau of Land Management lands where he was camped and that the U.S. Constitution does not grant courts the power of judicial review, court filings state. His arguments were dismissed in court rulings. His case is scheduled to go to a jury trial March 22, court records show. The Sugar Pine Mine incident began in April when local members of a national organization called Oath Keepers issued a nationwide call for volunteers to defend a contested claim at the remote mine on BLM land near Galice. After a month-long "security operation" that included an armed demonstration at the BLM office in Medford, the standoff ended and the group dispersed when the miners agreed not to work the claim pending an appeal, and BLM in turn promised not to take any action in the interim. In Eastern Oregon, members of the armed group led by anti-government militant Ammon Bundy of Arizona initially said they took over the Malheur refuge Jan. 2 as an act of solidarity for a pair of Burns-area ranchers facing jail time for burning government land. The occupiers also have tried to get Eastern Oregon ranchers to denounce their grazing contracts and have called for the transfer of federal lands in the West to states for local control, saying the Constitution supports their causes. The group has vowed to stay at the refuge indefinitely, and members have threatened an armed confrontation if law enforcement intervenes.
