Christopher Sean Horton, 43, of the 3100 block of Cedar Links Drive pleaded not guilty to charges of third-degree assault, fourth-degree assault and harassment Friday in Jackson County Circuit Court. He has a pre-trial conference scheduled for Feb. 8. The case began to unfold after the boy's mother picked him up after he visited his father on Nov. 29, 2015, according to an affidavit. The boy allegedly had an injury to the left side of his face that Horton said the boy received when he fell on the street. He was examined by two doctors. The boy's injury did not seem consistent with a fall, the affidavit said. The boy said the injury occurred outside near his father's house, but would not discuss details of what happened, the affidavit said. Medford police interviewed Horton, who allegedly initially said the boy got the marks on his face from falling on the street. When confronted with medical evidence, Horton then allegedly said he may have unintentionally slapped his son when the boy startled him in the middle of the night. Police discovered the owner of the house where Horton was living had an elaborate camera system that captured images of Horton taking the boy out of the house on Nov. 28, 2015. The surveillance system allegedly captured the sound of Horton striking the boy while the boy is asking him to stop. When confronted with the surveillance system evidence, Horton allegedly said he slapped the boy's hands, but not his face. Horton was lodged in the Jackson County Jail with his bail originally set at $25,000. He was released in December 2015 on his own recognizance. In June 2015, Horton pleaded no contest to a charge of second-degree child neglect in relation to his son, according to court records. With a no contest plea, a defendant does not admit guilt, but concedes that prosecutors would likely convince a jury of a defendant's guilt during a trial. —Staff reporter Vickie Aldous can be reached at 541-776-4486 or [email protected] .
