Oregon Road Conditions & Cams Email Story to a Friend September 22, 2005 Criminal charges dismissed Tax preparer settles civil suits; deputy D.A. says the complex accounting case would be too difficult to prove to a jury Criminal charges have been dismissed against a Jacksonville tax preparer whose family alleged she stole thousands from her mother’s financial trust. The Jackson County District Attorney’s Office on Tuesday moved to dismiss 16 felony theft and mistreatment counts against 57-year-old Vivian Anne McAleavey. Prosecutor John Norton said explaining complex accounting to a jury made the case too difficult to prove. Agreeing to pay more than $132,000 plus interest, McAleavey also settled a civil suit with trustees for her 94-year-old mother, who lives in Napa, Calif. Trust funds helped McAleavey build a home on China Gulch Road. McAleavey’s family, in written documents filed in Jackson County Circuit Court, alleged she borrowed money and cost the trust stock losses totaling more than $375,000. However, McAleavey settled on the agreement that she admits no wrongdoing. The indictment filed in May charged McAleavey with stealing at least $24,500 from her mother. Medford police Detective Sue Campbell said her investigation didn’t reflect the entire alleged theft, which extended beyond the legal deadline for prosecution. McAleavey spent no time in jail.
