Cody suffered a cut hand in the assault but said it could have been worse. "Good thing my puppies woke me up because who knows?" he said. On Friday, James Conrad Herron, 56, of the 400 block of Newtown Street in Medford was sentenced to five years probation for the Feb. 26 attack after pleading guilty to second-degree assault in Jackson County Circuit Court. A charge of attempted murder was dismissed in the plea agreement. While Measure 11 calls for five years and 10 months in prison upon conviction for second-degree assault, Herron was sentenced to far less under "safety valve" provisions of the Oregon law. He had no previous convictions and was in the midst of a mental health crisis after not taking medication for his bipolar disorder. He was also extremely intoxicated, the defense and prosecution agreed. Herron said he is taking medication again and feeling better. He has been held in Jackson County Jail since his arrest. "I saw it was not doing any good to not take them," he said of his medications. Herron apologized for his actions. Cody said he was pleased with the results of the court case. "I didn't want him to go to prison. He needs to get the help he needs," Cody said. Medford police said Cody was able to disarm Herron during the Feb. 26 machete attack Herron must comply with terms of his probation, including consuming no intoxicants and possessing no weapons, or be sent to prison for three years.
