According to an indictment filed Feb. 13 in the U.S. District Court for Southern District of California, David and Sandra Perez, along with co-defendant Beth Campbell, sold about $700,000 worth of so-called "biofrequency" devices between August 2011 and March 2014 using marketing materials that claimed the devices would treat ailments ranging from diabetes to AIDS. David Perez pleaded guilty Sept. 15 to a felony charge of conspiracy to introduce and deliver misbranded and adulterated devices into interstate commerce. His wife pleaded guilty the same day to a single misdemeanor charge of selling unapproved medical devices and was sentenced to a year's probation and fined $1,495. The devices, sold under the name "Energy Wave" and allegedly manufactured by an un-indicted co-conspirator in his Southern California home, consist of a small computer-controlled generator connected to metal cylinders intended to be held by the user. "Users were provided with an operating manual and a listing of 'Auto Codes' that set forth hundreds of digital settings for the device directed to specific conditions such as abdominal pain, AIDS, diabetes, stroke, ulcer and worms," the indictment says. Court records show agents from Homeland Security Investigations arrested the couple Feb. 26 in Medford, while Campbell was arrested Feb. 24 in California by agents from the Food and Drug Administration. The indictment says David Perez previously had been a partner in California-based CGNI Inc., the owners of which were convicted in 2011 of selling a product called the "Detox Box," which prosecutors say was almost identical to the Energy Wave. Court records show David Perez has been scheduled for sentencing Jan. 11, 2016. Campbell, who pleaded guilty Aug. 6 to a charge of selling misbranded devices, is scheduled for sentencing Nov. 2.
