Oregon Road Conditions & Cams Advertisement Email Story to a Friend April 18, 2006 Alleged killer’s trial to begin today A murder trial is to open today for a man who claims he was extremely disturbed when he killed a paroled sex offender in October 2004. David Michael Jurich, 26, is charged with bludgeoning to death 68-year-old David Evan Rice on Oct. 29, 2004, in an Ashland motel room. Jurich’s defense attorney last month notified the court of his intent to introduce expert testimony of his client’s "extreme emotional disturbance." Jurich told detectives that he "went insane" when Rice "flashed" him and asked the younger man to lie down in bed with him. He also admitted to being drunk the night he shared a room with Rice at the Relax Inn on Clover Lane. If his attorney proves the defense, Jurich’s murder charge will be reduced to first-degree manslaughter, which carries a mandatory 10-year prison sentence. The penalty for murder is life in prison with a 25-year term before parole eligibility. Jackson County Circuit Court Judge Ray White in October threw out Jurich’s confession to police, ruling that investigators illegally provoked it after Jurich repeatedly asked for an attorney. Committed in January to the Oregon State Hospital in Salem for psychiatric evaluations, Jurich has remained in custody since his arrest in Reno, Nev., on Nov. 3, 2004. The trial is scheduled to run through April 25 in Circuit Court.
