The council considered the first draft of an ordinance that could allow the city the option of taxing if voters approve Ballot Measure 91, titled the Control, Regulation, and Taxation of Marijuana and Industrial Hemp Act of 2014. Councilor Bob Strosser said he’s still uncomfortable creating a tax while the issue of marijuana use could cause potential health and safety risks. “I’m still struggling philosophically,” he said. The council didn’t take any formal action on a tax but hopes to take action before Measure 91 is voted on. Previously, the council placed a permanent moratorium on medical marijuana. Deputy City Attorney Kevin McConnell said the city would be in a lot better legal position if it enacts a tax at this juncture rather than waiting until after the measure passes. McConnell said other states have struggled to set a tax rate on cannabis that isn’t so high as to create a black market but also isn’t so low that it doesn’t create revenues. “Colorado seems to be getting it right,” he said. The state of Oregon would also collect taxes from the sale of marijuana, so any city tax would be on top of that, he said. The proposed ordinance would create a cumulative tax that would have a potential maximum of 18 percent that would be collected from producers, wholesalers, processors, retailers and medical marijuana facilities. However, councilors indicated they may want one ordinance to deal with medical marijuana and another ordinance to deal with recreational pot.
