White City man faces 90 months in shooting case Monday Jan 30, 2017 at 1:44 PM Jan 30, 2017 at 2:31 PM Mark Freeman Mail Tribune @MTwriterFreeman A White City man faces 7-1/2 years in prison for allegedly shooting a man in his hand during a fight over a woman Dec. 23 at a White City residence. Martin Keith Hutton, 51, pleaded not guilty Monday in Jackson County Circuit Court to first- and second-degree assault, unlawful use of a weapon, first-degree criminal mischief and recklessly endangering another person for the altercation in the 19000 block of Antioch Road, court records show. First-degree assault carries a mandatory minimum of 90 months in state prison upon conviction under Oregon sentencing laws. Second-degree assault carries a 70-month mandatory minimum. The other charges are also felonies except for the endangering charge, which is a Class A misdemeanor. Jackson County Circuit Judge Tim Barnack ordered an April 6 pretrial hearing for Hutton, who has remained free on bail since Dec. 30. Hutton is accused of shooting a man in the hand as the two grappled through a travel-trailer window Dec. 23, according to court records. Hutton was attempting to gain access to the trailer, wgich was locked and contained a woman identified as his girlfriend and a man identified as her ex-boyfriend, according to a police affidavit filed in the case. The male victim allegedly punched Hutton in the face through the window before Hutton allegedly retrieved a .45-caliber handgun from his vehicle and fired two shots into the man's pickup truck, the affidavit states. Hutton then returned to the trailer window and the male inside allegedly punched Hutton again in the face and attempted to grab his shirt, the affidavit states. Hutton then stepped back and fired a bullet that entered the victim's hand and traveled up his arm, the affidavit states. The affidavit said that Hutton acknowledged that firing the gun was not justified and that he had several opportunities to leave the scene before the shots were fired.
