John Patrick Bush, 29, will face a jury in a three-day trial scheduled to start April 6 in Jackson County Circuit Court. Bush’s blood-alcohol level was .296 percent — nearly four times the legal limit of .08 percent — during last April’s crash that killed 29-year-old Robert Andrew Baker of Butte Falls, police said. Bush was indicted in October on charges of second-degree manslaughter, criminally negligent homicide and driving under the influence. If convicted of second-degree manslaughter, he would spend six years and three months in prison under the state’s tough-on-crime law, Measure 11. Nearly nine years before Baker’s death, Bush was the driver in another crash that killed 21-year-old David Edward Buchanan of Central Point on Obenchain Road in March 1994. Bush was indicted on charges of second-degree manslaughter and criminally negligent homicide in that case, but the charges were dismissed. He instead received a probation sentence after pleading guilty to DUII.
