House Bill 4040 heads to the Senate for a final vote after passing out of committee on Tuesday in a narrow 3-2 vote. Upholding the delisting decision with a state law is an unusual move. At the beginning of the legislative session, some lawmakers in the House said the idea was to simply support that decision. But when the bill made it to the Senate, a committee determined the intent is actually to make moot an ongoing lawsuit filed by wildlife conservationists, who say the bill will prevent them from challenging the scientific merits of the delisting decision in court.
