Oscar Anthony Martinez, 35, of Portland was going through the drive-thru Sept. 21 when workers flagged down an Oregon State Police trooper because they suspected Martinez was drunk, according to an affidavit. The trooper arrested Martinez on charges of driving under the influence of intoxicants, two counts of recklessly endangering another person and reckless driving. The trooper also discovered an out-of-county warrant for Martinez's arrest for assault charges. On Wednesday, Martinez pleaded guilty in Jackson County Circuit Court to the DUII charge. The other counts were dismissed in a plea agreement. Martinez remained lodged in the Jackson County Jail Wednesday on $254,000 bail because of a warrant for second-degree assault, fourth-degree assault and attempted fourth-degree assault, jail records showed. Known for its cult-like following in California, In-N-Out opened a franchise at 1970 Crater Lake Highway in Medford Sept. 9. The Medford location has been mobbed by lines of burger fans ever since. Jackson County Circuit Judge Timothy Barnack cautioned people about driving while intoxicated in their quest for In-N-Out burgers.
