COURTS Murder case declared a mistrial for the second time Comment MailTribune.com Writer Posted Jan. 28, 2015 at 5:26 PM Posted Jan. 28, 2015 at 5:26 PM » Social News A second mistrial has been declared in the case of a Medford man charged with murder in a 2013 stabbing. Jose Valencia-Gaona, 46, is accused of killing 38-year-old Maria Guadalupe Rodridguez outside her Medford apartment Sept. 1, 2013. Valencia-Gaona's first trial in 2014 was also declared a mistrial after Judge Tim Barnack found then-Judge Adam Peterson's staff had inappropriately provided a witness list to jurors before the trial. Barnack had taken over the trial after Valencia-Gaona declined to give Peterson — whose tenure as a Jackson County deputy district attorney overlapped with Rodriguez' killing — a daily written waiver to oversee the trial. Valencia-Gaona's second trial began Monday and was expected to conclude today. Court records show Valencia-Gaona is now scheduled for a pre-trial conference at 1:30 p.m. Feb. 9.
