Oregon State Police, who led the investigation, said Officer Andrew Gault will receive a class B traffic violation for the crash in downtown Medford shortly after midnight Aug. 7. That violation carries a $260 fine. Medford police said Gault was providing backup to an officer in pursuit of Robert Franklin Brooks, 26, of Gold Hill, who eluded police at the Travelodge in south Medford even after being hit twice with a stun gun. After leading police on a chase through Medford that reached speeds of 100 mph, Brooks hit a vehicle driven by 63-year-old Catherine Hein, killing her, then crashed into the Li'l Pantry at Table Rock and East Vilas roads, setting the business ablaze. Gault was traveling south on South Central Avenue with his lights and sirens activated when he ran the red light at the intersection with East Eighth Street. Bridget Stockwell, 25, was traveling east on Eighth, "driving through as her signal turned from green to yellow," according to an OSP report. Gault's 2014 Dodge Charger police vehicle collided with Stockwell's Highlander, then slammed into a tree. Gault was transported to Asante Rogue Regional Medical Center for a cut on his head, according to OSP. Stockwell was transported for neck and knee pain. Under Oregon law, emergency vehicles can travel through red lights in emergency situations, but operators still have "the duty to drive with due regard for the safety of all other persons," according to ORS 820.300. "We still have to make sure it's safe to do so," said OSP Capt. Bill Fugate. Brooks has been indicted on charges of first-degree manslaughter, first-degree escape and attempt to elude. He is scheduled to be arraigned Wednesday in Jackson County Circuit Court.
