Oregon Road Conditions & Cams Email Story to a Friend June 24, 2004 Wal-Mart takes Medford rejection appeal to LUBA Wal-Mart Wednesday appealed Medford’s rejection of a 207,000-square-foot supercenter to the Oregon Land Use Board of Appeals. "It’s a very general notice," said Wal-Mart attorney Greg Hathaway of Portland, explaining that the details of their argument will come later. "It’s our position that this is a case about whether we comply with the city’s requirements," he said. He said both city staff and the Site Plan and Architectural Commission were clear in determining that Wal-Mart had complied. "That’s why we believe that the city erred," he said. In May, the City Council voted to reject plans for a Wal-Mart Supercenter at the Miles Field site. The council determined the project was incompatible with the area based on the size and design of the proposal. Following the decision, Wal-Mart bought the property from Jackson County for just over $8 million, following 14 months of negotiations. Advertisement The sale does not change the status of the city’s decision. City Attorney Ron Doyle would not say if he was surprised to learn of the appeal. "We’ll wait to hear from the Land Use Board of Appeals," he said. He said once the city receives the notice of appeal, it has 21 days to file a response. Hathaway said given the time allowed for each side to respond and file documents, the process could take a while. "You’re probably looking for a decision sometime in October, early November, generally speaking," he said.
