Brandy Jerome Davis, 28, pleaded guilty Friday in Jackson County Circuit Court to a charge of second-degree assault. The crime requires a minimum 70-month prison term under Oregon’s Measure 11 sentencing guidelines. Davis received a longer sentence according to a plea agreement with Jackson County district attorneys who decided not to prosecute Davis on additional charges if his son later dies. Jordan Davis, now 18 months old, is blind and remains in a vegetative state, said Terry Smith, deputy district attorney. Jordan’s retinas detached when he was shaken, and he has no brain activity other than in the area that controls his breathing and heartbeat, Smith said. His mother and grandmother care for him round the clock at their home in White City, she added. "Jordan’s life was changed from the moment he was shaken. He’ll never be the same," said Oregon State Police Detective Maureen Bedell, who investigated the case. Jordan’s mother, Shauna Streight, did not address the court Friday. Streight was living with Davis in Shady Cove when he assaulted their child, Smith said. Davis shook Jordan sometime between Sept. 11 and Sept. 12 last year because the child wouldn’t stop crying, Smith said. Streight had recently returned to work, leaving Davis at home to care for Jordan and her other child, a 3-year-old from a previous relationship, Smith said. Davis was unemployed, she added. When Jordan started having seizures about a day after he was shaken, Davis told Streight that he had accidentally rolled over on the child while he was sleeping, Smith said. Davis dodged officers who visited his home after Streight took Jordan to the hospital, police said. State police investigators later interviewed him at Doernbecher Children’s Hospital in Portland, where Jordan had been taken in critical condition. Doctors discovered partially healed fractures on Jordan’s ribs while he was hospitalized, indicating that the child had been injured before he was ever shaken, Smith said. "I don’t think (Davis) had the emotional wherewithal to deal with children, ever," Smith said. Davis was convicted of possessing methamphetamine and hallucinogenic mushrooms in 1994. He told police that he was not intoxicated when he shook Jordan, police said. He also was convicted on charges of second-degree burglary and perjury in 1993 and first-degree theft last year.
