Judge's ruling makes sense It's an employment issue, not a Second Amendment case Supporters of a Medford teacher's quest to bring her gun to school suggest a judge's ruling against her amounts to the loss of a cherished right. In truth, it doesn't. The truth is that teachers and school employees have not been bringing guns to their schools because school districts across the state and the country have long prohibited it. Judge G. Philip Arnold's ruling in favor of the Medford School District only reinforces a rule that was already in place and is not the elimination of some common practice of district employees. Arnold, a Jackson County Circuit Court judge, ruled last week that the district was within its rights to prohibit employees from bringing guns to work. The issue arose when a South Medford teacher, Shirley Katz, went to court to demand that the district allow her to bring a gun to work. She said she feared violence from her ex-husband. For starters, there are issues about Katz's claim. She says her husband — with whom she has had a custody dispute — has threatened her, but has never provided any evidence to support that. She was not worried enough to renew a restraining order she had filed against him. After the issue became public, she changed her story to say she wanted the gun to protect students from intruders. The proposition that armed teachers would prevent future Columbines is interesting, but half of the equation is not filled in: What is the potential downside of introducing guns into school buildings? The permit holders may be honorable, law-abiding people, but would they be in possession of their guns at all times or would those guns occasionally be left in purses or desk drawers? In the end, Arnold did not rule on the Second Amendment, the right to self-defense or the question of safety in schools. He ruled that the school district had not passed an ordinance or a law restricting firearms, which is what the Oregon Constitution prohibits. He ruled that the school district has a right to enforce its employment policies and noted that all employees, Katz among them, signed off on those policies — including the no-gun clause. In a case that has on occasion taken on tones of hysteria, that seems like a needed dose of common sense.
