Richard "Ricky" Michael Fay, 38, now faces 16 total charges, according to court documents. An indictment alleges that sexting between Fay and one of the female victims occurred on or between Sept. 1, 2014, and June 2, 2016. The suspected sexting and physical activity with another student took place between Feb. 10 and June 2, 2016, the indictment alleges. Jackson County Deputy District Attorney Zori Cook said the new charges came about because of new evidence discovered by the Southern Oregon High Tech Crimes Task Force. "Sometimes it takes awhile to get through everything," Cook said. "We try to do an accurate job when we first get the case, but new evidence is always coming in." Fay now faces felony charges of using a child in a display of sexually explicit conduct, attempted use of a child in a display of sexually explicit conduct, second-degree encouraging child sexual abuse, second-degree possession of materials showing sexually explicit conduct and luring a minor, records show. He also faces two misdemeanor counts of third-degree sex abuse. Fay pleaded not guilty to all charges at his arraignment in Jackson County Circuit Court on Friday, court records show. He has not been in the Jackson County Jail since earlier this month when he posted 10 percent of a $500,000 bail. A social studies teacher, he was arrested June 2 after Medford police did a forensic analysis on the smartphone of one of the two victims, which turned up evidence of the explicit messages. The Medford School District has removed Fay, who taught in the district for two years before his arrest, from the classroom pending the investigation's outcome.
