Posted Oct. 21, 2014 @ 12:01 am » Social News The NFL and four other sports entities on Monday filed a “Complaint for Declaratory and Injunctive Relief” in federal court against the state’s attempt to allow sports betting at New Jersey racetracks and casinos — as soon as this weekend, in the case of Monmouth Park. The request for an injunction came after Governor Christie on Friday announced he had signed a revised sports betting bill. As expected, the leagues in their brief stressed similarities to the 2012 federal court battle on this topic. In that sports betting case, the leagues first obtained a permanent injunction to stop the betting, then prevailed in U.S. District Court and the Third Circuit Court of Appeals, with the U.S. Supreme Court in June 2014 declining to take up the case. “For years, New Jersey has been attempting to devise a way to get around these unambiguous prohibitions and authorize sports gambling in Atlantic City casinos and horse racetracks throughout the state,” attorney William O’Shaughnessy of McCarter & English wrote. “On October 17, 2014, before this Court could consider the State’s last attempt to circumvent the Christie injunction, Governor Christie signed into law Senate Bill S2460 (the “2014 Sports Wagering Law”), which repealed the 2012 Sports Wagering Law in its entirety and replaced it with yet another attempt to authorize sports wagering in Atlantic City casinos and horse racetracks throughout the state. “While styled as a ‘repeal,’ the 2014 Sports Wagering Law is nothing more than a de facto authorization of sports gambling. Like its vetoed predecessor, the 2014 Sports Wagering Law ‘repeals’ all existing prohibitions, rules, and regulations that are specific to sports wagering, but does so only at Atlantic City casinos and horse racetracks throughout the state — in other words, only at venues that are already state-licensed and regulated.” By The Record (Hackensack, N.J.)
