On Thursday, Medford lawyer Michael Bertholf was granted a motion to withdraw from Robert Davies-Calhoun's cases. Davies-Calhoun is charged with murder for the Nov. 2 shooting death of 53-year-old Douglas Michael Spaur outside a Central Point Stop 'n Go market, according to documents filed in Jackson County Circuit Court. Davies-Calhoun had refused to see Bertholf at the jail every time between June 8 and July 19, according to Bertholf's motion filed Tuesday, and Davies-Calhoun filed three complaints against Bertholf with the Oregon State Bar. At the end of May, lawyer Andrew Vandergaw with Southern Oregon Public Defender withdrew his law office on grounds that "a conflict has arisen between defense counsel and defendant." Bertholf had represented Davies-Calhoun, 30, only since the first week of June, according to court records. In the middle of June, Bertholf submitted a court order for Davies-Calhoun to be transferred to the Oregon State Hospital for psychological examination in order to determine whether Davies-Calhoun is mentally capable of participating in his own defense. In handwritten letters to Circuit Court Judge Tim Barnack dated May 27 and June 7, Davies-Calhoun made bizarre demands for a defense attorney in a murder case. In May, Davies-Calhoun asked that a new court-appointed lawyer serve only in the role of advisory counsel, insisting that he be allowed to be the primary person defending himself on the charge and demanded his trial continue to June 6. The trial has since been rescheduled. In June, Davies-Calhoun submitted more specific requests, asking that his attorney be certified to practice law regarding military re-enlistment into the U.S. Navy and "to practice civil lawsuits, specifically: wrongful imprisonment, pain and suffering and character assassination." Davies-Calhoun allegedly waited outside the Stop 'n Go market in the 6000 block of Table Rock Road before shooting Spaur as he sat in his pickup truck, archives said. There was no argument prior to the shooting, a witness said at the time. Davies-Calhoun's trial date is currently scheduled for Oct. 31, court records show.
