Wilson Pelot was 10 when he tumbled 60 feet down a cliff and landed unconscious in a pool of near-freezing water, according to the lawsuit filed last year by his family. The injury occurred two years ago. Since then, Pelot has struggled with persistent thoughts of death, the suit said. The settlement brought an end to the legal fight over whether the state was responsible for the railing that gave way, The Oregonian reported. The lawsuit argued that state employees didn't act for four weeks after a park ranger was notified of the broken railing at the park in Marion County. It says a volunteer identified the faulty fence by hanging a small piece of orange tape from it. Pelot's family argued that no reasonable adult would think the tape served as an adequate warning to stay clear of the railing. The state hasn't admitted fault in any court documents, instead saying it agreed to the settlement to avoid "further legal wrangling." The state contended in court filings that responsibility lies with Pelot's parents for failing to properly supervise their children. The state also said it's immune from liability under state law because it didn't charge Pelot and his family any fees to use the park. The family claims they paid a $5 day-use fee and $57 to reserve a cabin for the night. Pelot, now 12, is expected to receive about $70,000 of the settlement when he's 18. The rest of the money will go toward legal costs and medical bills, the newspaper said.
