State Farm Fire and Casualty Insurance has filed a lawsuit against Regina Troxler in Jackson County Circuit Court. A trial is scheduled for March 8. In a complaint, the insurance company said Troxler threw a burned bag of rice onto a couch on the porch of the home, causing a fire that spread to the home in 2013. The insurance company accused Troxler of negligently, recklessly and willfully failing to properly dispose of burned food. In an answer to the complaint, Troxler denied responsibility for the fire, pointing to a Jackson County Fire Dist. 3 investigative report. The report said Troxler's friend, Mark Davis, heated a rice pillow in a microwave for four minutes. After it began to smoke and stink, Troxler asked Davis to throw it outside. He placed the smoldering pillow on the back of the couch, which was on a patio. Davis and Troxler were then watching a movie at home and Troxler's son was sleeping when a smoke detector went off. The boy said he saw a wall of fire on the patio, with flames beginning to enter the living room, the report said. All three were able to escape the blaze and were interviewed by investigators, the report said. "The fire was caused by a smoldering rice pillow placed on a couch," the report said. The homeowner had insurance but the renter did not, the report said. In its complaint filed in court, State Farm Fire and Casualty Insurance said it has a contractual right to seek compensation from third parties responsible for losses paid out to policy holders.
