Andres Z. Nuno, 20, admitted in Jackson County Circuit Court that he fired between five and six pistol shots at Glenn Keith Maxwell while others were nearby on March 18 in White City. Nuno previously had faced an attempted murder charge, but prosecutors dropped it as part of an agreement in which Nuno pleaded guilty to a felony charge of attempted first-degree assault with a firearm and three misdemeanor counts of recklessly endangering another person. Nuno and his defense lawyer, Justin Rosas, had sought a probation sentence. The three misdemeanor counts of reckless endangering involved three others who were in the general area at the time he fired the weapon. Prosecutor Alyssa Claseman referenced a sealed probable cause affidavit that alleged Nuno chased Maxwell, attacked him and grabbed a gun from his car before firing the shots at Maxwell as retribution for "ratting someone out." Rosas, however, called the gang connection "a little bit tenuous," instead framing the altercation as a fight among White City residents that was "basically just trash-talking." Maxwell did not attend the hearing. In 2015, Nuno pleaded guilty to a misdemeanor charge of first-degree animal abuse for shooting a dog three times because it bit him, along with a felony charge of methamphetamine possession. The dog survived. Claseman cited the previous case as evidence of a trend, and advocated for a prison sentence. Nuno broke down in tears seeking leniency after entering his guilty plea, and made an apology to the people he impacted. "I'm not a monster," Nuno said after apologizing to his victims between sobs. "I really want to raise my son." Circuit Judge Lorenzo Mejia said Nuno's remorse weighed on him, telling him, "Your tears do affect me." Mejia said he considered how his sentence would impact Nuno's family, but determined the shooting deserved a stiffer consequence. "It brings me no pleasure or joy to sentence you to 20 months in the Department of Corrections," Mejia said. "The gun, the multiple shots — that's too much." The sentence is on the higher side of a range of recommended sentences for attempted first-degree assault, Mejia said after the hearing.
