1. Money-transmitter licensing of virtual currency

  • Before 2026-11-01: Oklahoma's older money-transmission law applied; kiosk operators were already required (from 2025-11-01) to be licensed under it by SB 1083. [S1] Whether a pure Bitcoin exchange or custodian needed a licence under the older law was not established from sources read (gap).
  • HB 3521 (2026) — Oklahoma Money Transmission Modernization Act (Rep. Marti; Sen. Reinhardt). Senate passed 37-9 (2026-05-04); House concurred 65-23 (2026-05-06); became law without the Governor's signature 2026-05-13; effective 2026-11-01 (Section 56). Saved in full. [S3]
  • § "21. 'Money' or 'monetary value' means currency or a claim that can be converted into currency through a financial institution, electronic payments network, or other formal or informal payment system. The term includes stablecoin that: a. is pegged to a sovereign currency, b. is fully backed by assets held in reserve, and c. grants a holder … the right to redeem the stablecoin for sovereign currency from the issuer." — the same approach as Texas, under which Bitcoin itself is not money (see us-state-tx.md). 3. Crypto ATM / kiosk law

SB 1083 (2025) — Sen. Weaver; Reps. Lepak and Bashore. Senate 41-4 (2025-03-27); House 84-2 (2025-04-30); Senate adopted House amendments 28-15 (2025-05-15); Vetoed by Gov. Stitt 2025-05-22; veto overridden — Senate 37-9 (2025-05-27), House 78-4 (2025-05-29); filed with the Secretary of State 2025-05-29; effective 2025-11-01.   • Licence: a digital asset kiosk operator may not transact unless licensed as a money transmitter; violations are punishable by a fine of $600–$2,000 per violation or county-jail imprisonment of at least 30 days (penalty text as read); injured persons may file civil suits.
  • Notice: tell the Banking Department at least 10 days before activating a kiosk at a location; quarterly location reports within 45 days of quarter-end.
  • Disclosures and warnings, including a daily-limit disclosure; receipts; written anti-fraud policy; blockchain analytics; compliance officer who owns no more than 20%.
  • Refunds: a new customer fraudulently induced gets a full refund of all fraudulent transactions, including fees, if they contact the operator and the Office of the Attorney General within 14 days of the last fraudulent transaction; an existing customer gets fees refunded on the same conditions.
  • Daily limit: no more than $2,000 per day for a new customer across the operator's kiosks (no statutory limit stated for existing customers in the text read).
  • Fee cap: all fees and spread may not exceed 15% of the dollar value.
  • Live customer service Monday–Friday 8 a.m.–10 p.m. CST; Banking Department may adopt rules. [S1]

4. Tax treatment

  • HB 3594 (2024): no "additional tax, withholding, assessment, or charge" may be imposed on a payment made with digital assets. [S2]
  • HB 1600 (2024): sales-tax exemption for certain digital-asset-mining purchases (NCSL summary). [S6]
  • Oklahoma income tax follows federal AGI (general knowledge; unverified); no Tax Commission crypto guidance found (gap).

5. Notable enforcement

The 2026 session ended in May 2026; Oklahoma bills carry over within the two-year legislature only until the 2026 session ends, so remaining bills are effectively dead (procedure — general knowledge; unverified).

7. Contested and fringe claims (flagged, not endorsed)

  • Governor's veto of the kiosk law. Gov. Stitt vetoed SB 1083; the legislature overrode him by wide margins. His veto reasons were not read (gap); such vetoes are commonly framed as avoiding over-regulation of a lawful industry. [S1]
  • "Bitcoin Rights" / "right to mine." Supporters (e.g., Rep. Brian Hill; national groups such as Satoshi Action Fund — attribution unverified) frame HB 3594 as protecting individual rights; critics cite noise and grid concerns from mining. [S2]
  • Strategic reserve. The House passed it with claims of inflation protection; the Senate committee killed it — a common pattern in 2025. [S4]
