With one notable exception, they generally make sense — and that one exception can be corrected only by the state Legislature or through a statewide vote. The rules include no smoking on the premises of retail outlets, limits on the size of rural plantings, a requirement that the majority of owners of the outlets have lived in Oregon for at least two years and strict limits on how much marijuana can be delivered to a customer's location. We could quibble over the smoking ban in outlets — essentially, the state is saying people should smoke at home, alone. Bars and pubs are legal, maybe there should be an option for marijuana "smokeries." Even OLCC officials admit the crop planting limit is a guess, but they had to start somewhere. The rule that makes no sense is the requirement that retail and medical marijuana dispensaries must be separate. That won't please anyone — it makes it harder on the operators, harder on consumers and harder on people who don't want dispensaries nearby, because the rule results in more dispensaries than are really necessary. Keeping separate books makes more sense than keeping separate buildings. But because medical and recreational marijuana were made legal under two separate laws, the OLCC's hands are tied. It likely will be up the Legislature to provide the remedy and it should do so at the first opportunity.
