OUR VIEW Our View: Grow rules reasonable Comment DailyTidings.com Writer Posted Jan. 21, 2016 at 12:01 AM Posted Jan. 21, 2016 at 12:01 AM » Social News The Ashland City Council followed through on adopting reasonable rules for recreational and medical marijuana growing in residential neighborhoods, passing its ordinance on second reading Tuesday. The result may not satisfy the most vocal advocates for a completely hands-off approach, but it recognizes that not everyone wants to see backyards full of towering plants. The ordinance follows the voter-approved measure legalizing recreational marijuana by allowing four plants per household to be grown outdoors. Medical growing, already legal under state law, will be limited to six plants, a recognition that medical users may need more. The outside gardens may be no larger than 50 square feet and the plants no more than 10 feet tall. Gardens must be set back 10 feet from property lines and 25 feet from neighboring residences, and must be closer to the grower's residence than neighbors' houses. The ordinance does not limit the number of plants grown indoors in a residential property as long as it is occupied and primarily used as a residence. Small gardens for personal use are one thing, but commercial agriculture operations are not appropriate for residential neighborhoods, whether the crop is cannabis or sweet corn. Large-scale medical growers, too, should not infringe on their neighbors' ability to enjoy their own backyards. The Ashland ordinance strikes a necessary balance between accommodating legal marijuana use and protecting the rights of non-users to enjoy their properties. The council deserves credit for its rational approach to what has become an often divisive issue in Southern Oregon.
