--> --> Family, doctor settle lawsuit MYRTLE CREEK (AP) - A Myrtle Creek couple who say a doctor's negligence caused permanent harm to their son have agreed to a $8 million settlement. Kimberly and Shawn Hastings filed a medical malpractice lawsuit against obstetrician William Hayton, saying the Roseburg doctor failed to take action after Kimberly Hastings complained about a lack of fetal movement as she neared the end of her pregnancy. It was later determined the baby's umbilical cord had been compressed, keeping oxygen from his brain and nutrients from reaching the rest of his body. The son, Cody, now 4, suffers medical problems. He can't go to the bathroom without help, he vomits on a daily basis and suffers from cerebral palsy diagnosed soon after his birth. A jury had awarded the couple $8.5 million, but agreed to settle because Hayton had considered appealing. Hayton was sued along with Roseburg Women's Healthcare, the clinic where he practices. Shawn Hastings said the settlement was acceptable, but that the family was disappointed because Hayton had not apologized. "He just needs to stand up and say he made a mistake," Hastings said. "I'd feel better and I would forgive him. He is only human, but this wasn't God's mistake. This was Dr. Hayton's. He needs to say he's sorry." Email your...
