article by Edward Lee and Robert Wiedrich which set forth
the results of an interview of States Attorney Edward V.
Hanrahan and members of the raiding party of the west
side apartment, 2337 Monroe Street, Chicago, Illinois,
wherein Fred Hampton, leader of the Black Panthers party,
Chicago, resided.

Reason for No Goa
fianrahan insisted that his men could not have fired tear
gas shells into the, flat first since, under the law. they were
requircd to knock at the door in an attempt to scrce a se:|-ch
warrant, The warrant was issued on thc basis of information
that the apartment was a clandestine cache for weapons.
Fulther, iianrnhan and his mcn declared that they had
no prior knowledge that Hampton and Clark wultl he found
in the flat. In fact, the identitics of the two mcn were not
l92":|rncd until after they had been killed in the gun battle,
the prosecutor said.

Yarsenal had its beginnings Dec. 2, when informants who had
.=previously furnished the prosecutor's office with reliable in-
formation rcported the cache of guns in the first floor flat
at 2337 Monroe st.
Jalovec had received his information earlier in the day,
and Sgt. Groth xecelvcd his from an informant who tele-
. phoned his home at 10:30 p. rn. The following morning the
men met at the states attorney's office and compared notes.I According to the informants, at least thrcc shotguns had
been observed in the flat. Neither, however, made any men-
" lion of Hampton's or Clark's frequenting the apartment, Sm t "The first eye-witness accounts of state's attorney's police~ IGroth said.
At noon, Sgt. Groth and Detectives James Davis and Bill
Kelly discussed plans for the raid on the flat. This session
was held after Sgt. Groth had personally surveyed the building
and neighborhood and then dispatched Kelly and Davis to do
the same. .
Reject Early Night Raid .
At first I thought we'd hit the place at 8 o'clock that
might," Sgt. Groth said. But after talking it over, we decided
Llhat would be a had time, both for our safety and that of
.;esidents of the area.' "it's a heavily populated neighborhood, so we feared first
for the safety of people on the streets at that hour and see-
ondly we feared such a raid might create an incident in the
area, which we knewnvas the heart of Panther territory.
Our object was to avoid an incident."
On this basis, Groth and the other detectives decided to
stage the raid shorily before 5 o'clock the next morning,
_ Thursday, Dec. 1. '
I "This wasn't the first time our squads h:-:1 gone after
; dangerous individuals," Sgt. Groth said. And on the basis
f of the information we had, it was clear tii--t we might be run- nlng up against dangerous individuals."
IJudge Issues Warrant '
! At 1:45 p. rn. that day, Jalovec o'ct:tincd a search warrant
A from Judge Robert Collins of Criminal court, citirg the facts
j obtained from the informants. Then Groth Cll'E9292' a lengthy

him, spelling out in detail each of their assignments in t-Wt.t-
ing and entering the aparment's front and rear doors. Equip-
ment drawn for the rain included a suhmeclilno gm, three
shotguns, and wnlkic talkie radios.

were told what the mission would be. I
At 4 oclock the next morning, Sgt. Groth doled out the
assigments which called tor live men to enter the front door
cit the apartment, four to enter the rear, three to stay outside!
and cover the front exit, and two to perform similar duties
at the rear.
The men stationed outside were assigned there not only
to prevent anyone escaping thru windows, but to also serve
as protection in the event of sniper re from nearby build-
ings, Groth said. Included in the party of 14 policemen were
five Negroes. The men arrived at the apartment at 4:45 a. m.
Sgt. Groth took Detectives Joseph Gorman, George Jones,
Robert Hughes, and Davis to the tront door. Meanwhile, De-
tectives Edward Carmody, John Ciczewski, Philip Joseph, and
William Kelly approached the rear door while Detectives
John Mai-usich, Fred Howard, and Lynwood Harris covered
the front yard. Detectives William Corbett and Ray Broderick
covered tl1e back yard.
Extra Squads Requested
Just shortly before he arrived at the building, Sgt. Groth
said that he radioed from the Chicago police department un-
dercover squad he was driving, asking that the squad opera-
tor dispatch marked cars from the Wood street district to the
front and rear exits of the building. _
I told them we were about to attempt to Qrve-a avar-
rant," Groth said. -
Once at the building, Groth ascended the front staircase
on the exterior with Davis on his left. Behind them wcri,
Golman, Jones, and Hughes. The men entered a small hall;
way containing two doors, one leading to the 2d oor and tho
otter to the Panther apartment. !'
Positioning themselves to either side of the apartment
door, Sgt. Groth said he reached over and first rapped firmly
with his lett hand. When there was no response, he pounded
again, but this time with his revolver butt.
I heard a voice inside-a male voice-call out, Who's
there?'," Groth said. l replied This is the police. I have a
warrant to search the premises. " -
' Again, there was no response, but Groth said he could
hear movement inside. Again he said he pounded on the door,
shouting, Police! Open Up!"
"Just a minute, Groth said the male voice replied.
Suspicious of the delay, Groth said he ordered Davis to
kick the door open. Davis kicked and the door slammed open
to reveal a small ante-room with another door leading to the
apartment's living room. That was shut._
Then suddenly, as the two policemen entered the ante-
room they said a shotgun blast was red thru the closed
living room door, a charge which later proved to have been
a solid rifle load deer slug red from a 12 gauge shotgun.

outside ot the door as it exited and narrowly missed the two

In that moment, the woman fired again, the ash oi hei-
weapon illuminating her lace for Sgt. Groth who was still
at the doorway of the room.
"I figured Davis had been hit when I saw him go down,"
Groth said. That second shotgun round went right past me
as I hugged the door jamh and narrowly missed hitting
Hughes who was behind me. 1 tired two shots at her."
Almost simultaneously, Groth said he ordered Hughes to

told him to notify the men at the rear of the building via
walkie talkie radio that these people are shooting in here!"
Fires at Armed Woman ' ~

This gunman was identified after the battle as Clark, 22,
a Panther leader from Yeoria.
Meanwhile, Detectives Jones and Garman pluugcd into
, the darkened room which was lighted only by the dim glow
oi a gas space heater in a far corner, opposite of the bcd on
which Miss Harris was lying. Gormzn crouched near the
door and threw his ashlight momentarily on hiiss ilarris,
then charged tor the bed. The light had sh:-wn that she was
wounded in her right thigh, aliho she still held the shotgun
in her hands. '
Discovers 3 More Guns
. l yanked the gun from her hands and hurled it behind
me toward the door," German said. "in that moment. I also
kicked aside a round hassock near the bed on which there
, were lying three hand guns. The guns spilled onto the oor."
Davis, who by this time had risen to a crouch, looked
down the long hallway toward the rear of the at just in time,
he said, to see n man duck in and out of the rear bedroom
nearest the kitchen. lie had a shotgun. v
By then, the guys had broken down the kiiclicn cloor, '
Davis said. l saw Ciszewski in the kitchen behind the

Detective Jones was crouching between two wooden dresser
along one wall at the mouth of the long ball that stretches
the length of the apartment. lie said he saw n hand reach out
from the rear bedroom and fire a shot with a revolver or
automatic pistol at the kitchen where other detectives were
crouching, _ ' " _ -
Shoot It Out! -
It was just about then, Sgt. Groth said, "That I heard
a voice call out from the front bedroom, Shoot it out! This
was followed by two ashes from the same room I bclleve
were from n shotgun.
At this point, police resumed ring and then minutes later,
or perhaps only seconds, Groth said, be again ordered his
men to cease fire and again coiled out to the Panthers,
"Come out with your hands up!"
At the rear of the apartment, Dective Carmody jumped
over n wooden door that fonned a barricade between the
kitchen and dining room as the Panther fire continued.
German covered him with subrnachine gun fire from the
living mom which he fired thru the connecting wall of the
living room and front bedroom and down the hallway.
Carmody fired one round from his .38 caliber re~.-olver
as he plunged past the rear bedroom doorway to shelter
against a far wall of the dining room. . _
Cease Fir_e Again Called ~ -
Again. Sgt. Groth called out for surrender and a cease
tire and this time, from the rear bedroom, Harold Bell, Z3,
of Rockford, emerged with his hands in the air. Broderick
and Cimewski, who by then had also jumped over the barri-
cade into the dining room, grabbed Bell and took him to the
kitchen where other detectives held him. -
But again, gunfire directed at police from the front
bedroom broke out and Broderick and Ciszewski fired into
both bethoorns from their vantage point in the dining room.
,5gt. Groih called another cease fire and ordered the
Fanthers tosnrrender, he said. This time, :l voice called fron'._

an injured man back here. -

rendering, Sgt. Groth again ordered a cease re.
I was virtually pleading with those, in the frout bed-
room to come out," he said. But again they fired so Brod-

Gorman approached the front bedroom door with his su ~~

open closet I spotted out of the corner of my eye directly
in the right inside the door," Gorman said. "I saw two beds"
with the forms of two people rising between them. One had

As he started to aim, I fired and the gun fell as he did.
The second form kept rising in those few seconds and I tired
again after I saw something that looked like 'n hand gun in

This is the case involving a raid by the Chicago Police Department /
on aBlack Panther Headquarters 12/ 4/ 69, during winch two Black Panthers
were killed. The Department has requested mvestigation based upon
allegations that the dead victims wage shot while sleeping in bed.
The Department has specifically requested a diagram of the
premises and has requested that the investigation include an examination
of bullet holes to determine the direction from which the bullets were
fired smce it has been alleged that no shots were fired by the Panthers.
SAC, Chicago has requested that the Exhibits Section prepare
diagram requested by the Department and that an expert from the FB
Laboratory make an on the scene examination to determine the dir '
from which the bullets were fired.
In view of the importance of this case and the widespread publicity
iti receiving, it is recommended that the Exhibits Section and the FBI
Labratory comply with the SAC's request. The SAC, Chicago should
perfect arrangements for access to the space prior to the departure from
Washington of the Laboratory and Exhibits Section personnel.

an investigation be made of the matter.
In view of the circumstances, please conduct
a preliminary investigation so that we may determine

whether violations of 18 U.S.C. 242 and 241 are involved.
The investigation should include, but need not be limited
to, the following.
1. Identify and interview all persons, including
the allegedly wounded individuals who were present when
the police conducted the Black Panther Party raid at
2337 West Monroe Street, Chicago, on December 4.
2. Identify the police officers who took part
in the raid and interview the subjects named above.
3. We understand that two autopsies on victim
Fred Hampton's body were performed, one by the Coroner
and one by a group of physicians headed by[:::::::::] b7c
[::::::]of Northwestern University. Obtain copies of
each report.
b. Ascertain whether a state or local investi-
gation is being conducted or has been conducted, and
furnish us with a copy of any available report of such
investigation. In this connection, inspect the official
records and ascertain the charges placed against the
victim and the status of same.
5. Inspect the premises of 2337 West Monroe
Street, the location of the raid, and note and photo-
graph any physical evidence such as bullet holes, blood,
the general arrangement, location and condition of the
furniture, windows etc. In connection with any bullet
holes noted, determine if possible, the direction of the
bullets, with particular reference as to whether they were
apparently fired from the outside doors and windows toward
the interior of the apartment and from the interior toward
the outside doors and windows. Please furnish us with a
diagram of the premises noting the particular location
therein where victims Hampton and Clark were allegedly
shot.
If victims or other persons in the premises at
the time of the raid decline to be interviewed, please
notify me immediately without waiting for the completion
of the report of this investigation.

on 12/4/69 which appeared in the Washington Post 12/20/69, the
article indicates that Hanrahan insisted that his men had offered
to cooperate and U. S, Attorney Thomas Foran said that Hanrahan did
make his men available. The facts are that Hanrahan, when con-
tucted by the SAC in Chicago on 12/13/69, advised that he would
xmake the officers available for interview provided that an
official from his office was present during the interviewg and
that copies of the results of the interviews either signed
statement or interview report form! were made available to him w
or the officer interviewed.J]
A Justice Department source is quoted in the article
as having stated that Hanrahan refused to permit his police to
_ he questioned unless a member of his staff was present. The
tconditions which he set- as well as those set by the Panthers

SUMMARY PUNISHMENT - CIVIL RIGHTS
By letter dated 12/11/69, from AAG JERRIS LEONARD,
Civil Rights Division, a preliminary investigation
was requested to determine whether violations of
18, USC, Section82h2 and 2hl are involved in the
shooting of FRED A. HAMPTON and MARK CLARK by the
Cook County States Attorney's Police raid on the '
Black Panther Party BPP! apartment, 2337 west
Monroe Street, Chicago, on 12/N/69. SAC M. W. JOHNSON
personally advised USA THOMAS A. FORAN, Superintendent
of Chicago Police Department JAMES D. CONLISK, and
Cook County States Attorney EDWARD V. HANRAHAN, of
the requested investigation. HANRAHAN stipulated that
all lh officers in the raid would be made available
for interview provided an official from his office
was present and that a copy of the interview was madeV
available. SAC M. W. JOHNSON also contacted Attorney
WARREN WOLFSON representing victim BRENDA HARRIS, who
was to consult with other victims attorneys and to
advise if they will make their clients available
for interview. SAC M.W. JOHNSON also contacted
DENNIS CUNNINGHAM, Attorney for BPP, who desired
an attorney be present during FBI examination of BPP
apartment. On 12/17/69, CUNNINGHAM advised SAC M.W.
JOHNSON that "it is polically impossible for the BPP
to voluntarily cooperate" with any FBI investigation.
AAG JERRIS LEONARD in Chicago on 12/18/69, advised
he would personall handle FGJ inquiry into thismatter. On 12/22/Z9, FBI examination commenced of
the premises at 2337 West Monroe Street, Chicago,
FGJ commnced receiving evidence in this case.and

This report contains the results of a preliminary
investigation in accordance with departmental lcller to
the Bureau dated December ll, 1969, regarding the above
captioned matter. This departmental letter, which was
forwarded by Mr. JERRI5 LEONARD, Assistant Attorney
General, Civil Rights Division, is summarized as follows:
! The Department received a telegram dated§ December 5, 1969, from of the Illinois State' Branch, National Association or the Advancement of Colored
b7¢ People NAACP!, and other officials of that or a ization. ~I lso received a telegram fr' [fEi:§ifi:f77ff:j "Chicago Daily Defender," WHITNEY M.
' YOUNG, Jr., Executive Director, National Urban League,
and a number of individuals of Maywood, Illinois. All of
these communications generally alleged that the shooting
and killing of members of the Black Panther Party BPP!
on or about December 4, 1969, was unnecessary, unjustified,
and of questionable legality. They requested that an
investigation be made of the matter.
The departmental letter requested the FBI to
conduct a preliminary investigation so that the Department
could determine whether violations of Title 18, United States
Code, Sections 242 and 241, were involved. It was stated
that the investigation should include, but not be limited
to, the following:
1. Identify and interview all persons, including
the allegedly wounded individuals who were
present when the police conducted the Black
Panther Party raid at 2337 West Monroe
Street, Chicago, Illinois, on December 4, l969.

gation is being conducted or has been
conducted, and furnish us with a copy of
any available report of such investigation.
In this connection, ins ect the officialrecords and ascertain the charges placed
against the victim and the status of same.b7C
Inspect the premises of 2337 West Mbnroe
Street, the location of the raid, and
note and photograph any physical evidence,
such as bullet holes, blood, the general '
arrangement, location and condition of
the furniture, windows, etc. In connection
with any bullet holes noted, determine, if
possible, the direction of the bullets,
with particular reference as to whether they
were apparently fired from the outside doors
and windows toward the interior of the
apartment and from the interior toward the
outside doors and windows. A diagram of
the premises, noting the particular location
therein where victims FRED HAMPTON and MARK
CLARK were allegedly shot, is to be furnished.

The Department's letter requested that if the
victims or other persons in the premises at the time of
the raid declined to be interviewed, Mr. JERRIS LEONARD,
Assistant Attorney General, Civil Rights Division, should
be notified immediately without waiting for the completion
of the report of this investigation.1
It is noted that the telegram of December 5,
1969, addressed to United States Attorney General JOH
MITCHELL reads as follows:
We of the NAACP are extremely alarmed,
concerned, and confused relative to the contra-
dictory statements and facts in connection with
the slaying of MARK CLARK and FRED HAMPTON by
Cook County law enforcement officials on
December 4, 1969. Pursuant to the same incident,
we demand that an adequate, thorough investiga-
tion and that the results of such investigation
be made known to the public in order to alleviate
a tense, anxious situation. We simply will not
tolerate a modern day lynching; and should the
results of your investigation prove a violation
of civil rights, we shall use maximum resources to
pursue the apprehension and punishment of those
responsible.
Upon receipt of the departmental letter onDecember 13, 1969, M. W. JOHNSON, Special Agent in Charge SAC! of the Chicago Office, personally advised UnitedStates Attorney USA! THMAS A. FORAN of the requested
investigation. SAC JOHNSON informed JAMES D. CONLISK,
Jr., Superintendent of the Chicago Police Department, of

the requested investigation. CONLISK stated that he had
no objection to police officers assigned to the State's
Attorney's Office being interviewed by the FBI, but he
suggested that Cook County State's Attorney EDWARD V.
HANRAHAN be contacted as these officers were working for
him at the time of the raid.
SAC JOHNSON contacted Cook County State's Attorney
HANRAHAN, who advised he would make all 14 officers
involved in the raid available for interview immediately,
provided an official from his office was present during these
interviews and that copies of the results of the interviews
in the form of either a signed statement or the Bureau's
interview report form would be made available to him.
HANRAHAN added that making such copies available to the
police officer being interviewed would suffice. HANRAHAN
pointed out that demands have been made for these police
officers to be charged with murder in connection with the
killing of BPP members FRED HAMPTON and MARK CLARK.
Cook County Coroner ANDREW J. IOMANins announced he
is calling a "blue ribbon" coroner's jury to look into
this matter. Because of this, HANRAHAN deemed it necessary
to grant the interviews of the police officers only under
the above stated conditions.
SAC JOHNSON personally contacted Attorney WARREN
WOLFSON at 30 North La Salle Street, Chicago, Illinois.
WOLFSON advised he represents victim BRENDA HARRIS. WOLFSON
stated that all of the victims, except DEBORAH JOHNSON,
are either in jail or in custody at the Cook County Hospital
and that since the other victims are represented by other
attorneys, he desired to consult with these attorneys
concerning the granting of interviews by the FBI.

HOLFSON stated that all of the victims had beencharged by Cook County authorities with serious crimes; andas the victims are in custody, the attorneys themselves havenot had the opportunity for thoroughsinterviews of theirclients. WOLFSON stated he wanted to emphasize the factthat statements in the news media credited to the victimsand their attorneys are not necessarily true as the aLLorneyshave not authorizedsuch statements. WOLFSON further statedthat due to the seriousness o the charges pending againstthe victims, their attorneys would undoubtedly desire to
be present during any FBI interviews.HOLFSON further stated that he would be most. reluctant to authorize an FBI interview with his client,BRENDA HARRIS, until he personally had an opportunityto completely interview er. Also, WOLFSON stated that dueto the local charges placed against his client, he wouldinsist upon obtaining a copy of the results of any FBIinterview. He was sure that the other attorneys of the
victims would feel the same way.
WOLFSON agreed to contact the other attorneys assoon as possible and would advise SAC JOHNSON whether theinterviews of the victims would be permitted.
It is noted that in connection with the Department'srequest for an investigation at the premises of 2337 WestMonroe Street, Chicago, Illinois, where the raid ofDecember A, I969, occurred, these premises are under the

that he saw no objection to making these premises available
to the FBI, but he desired to first consult with other
attorneys, whom he did not identify, and stated he would
call SAC JOHNSON later that weekend. CUNNINGHAM said he
would try to make the premises available by Monday afternoon,
December 15, 1969, or by the morning of December l6, 1969.
CUNNINGHAM desired either he or his representative to be
present ddring the FBI investigation at 2337 Nest Monroe
Street, Chicago, Illinois.
On December 13, 1969, the above was discussed with
USA moms A. FORAN, Northern District of Illinois um!,
who stated that although he was not in a position to
recommend Federal Grand Jury FGJ! action at this time,
he would give the matter further consideration. USA FORAN
stated it was his feeling that the requests by State's
Attorney HANRAHAN and the victim lawyers regarding the
interviews should be complied with in view of the pending
charges which exist in regards to the 14 police officers
and the seven victims in this matter.
On December 14, 1969, DENNIS CUNNINGHAM, BPP
Attorney, contacted SAC JOHSON at 4:30 p.m. and stated that
after consulting with "most of the attorneys involved,"
it was decided that additional consultation was necessary
by them before the FBI would be given access to the
premises at 2337 West Monroe Street, Chicago, Illinois.
CUNNINGHAM advised that the attorneys are meeting at 5:00 p.m.ondDecember 15, l969, at which time a decision would be
ma e.
CUNNINGHAM stated, however, it is his unofficial
opinion that access to these premises by the FBI will
be authorized for Tuesday morning, December 16, I969, and
that he would call SAC JOHNSON immediately following the
above described meeting with the other attorneys.

released that day on $25,000 bond, which was made at
the l3th District of the Police Department.

On December 17, 1969, JAMES IONTGOIERY,
attorney representing the Black Panther Part tele-phonically contacted Special Agat the Chicago Office, to advise t a po ce o cershad arrived at 2331 lest Ionroe Street, that morning,
and they had informed BOBBY BUSH, Deputy Defense
Iinister of the Illinois Black Panther Party, that
they had a search warrant for the purpose of searching
the outer halls of the building, According to IONI-
GOIERY, the officers were asked to leave, and they
departed, However, the officers returned shortly
thereafter, at which time the officers refused Black
Panther Party members access to the apartment.
IOTGOIERY stated that he was notifying the Federal
Bureau of Investigation, in view of his belief that
the Federal Bureau of Investigation or the Department
of Justice was looting into the shooting incident.
At 3:27 p,m,, on December 17, 1969, DENNIS
CUNNINGHAM, attorney for the Black Panther Party, Y
telephonically contacted Special Agent in Charge,
I. W. JOHNSN, to advise that attorneys for the Black
Panther Party and victims had decided they did not
feel the Justice Department would help then, and there-
fore, they were taking the position they would not
voluntarily cooperate with any Federal Bureau of Inves-
tigation tavestigation. CUNNINGHAM stated that this

decision was based upon newspaper articles reporting
a Federal investigation ot the Black Panther Party.
CUNNINGHAI lnrthor stated that this decision was actually
reached on Ionday night, December 15, 1969, but that
he had been "too busy" to contact Special Agent in
Charge JOHSON.
CUNNINGHAM urther informed Special Agent
in Charge JOHNSON that undoubtedly the Federal Govern-
ment could obtain access to the premises at 2837 lest
lonroe Street, through legal action, and that "or
course they could not prevent that." CUNNINGHAM
stated that "it is politically impossible for the
Black Panther Party to voluntarily cooperate."
CUNNINGHAI also interned Special Agent in
Charge JOHSON that the Cook County States Attorney's
Police, "using some kind of warrant" were at the above
Ionroe Street premises at approximately 10:30 a.m., on
December 17, 1969, and that they were denying everyone
access to these premises, unless they could present
a lease agreement. CUNNINGHAM further stated that he
recognized that this latter was not involved with any
Federal Bureau of Investigation investigation.

The following account of the Cook County State'sAttorney's raid upon the Black Panther Party BPP apartmentat 2337 West Monroe Street, Chicago, Illinois, onDecember 4, 1969, is summarized from news media reports:
1 The State's Attorney's police, under the directionof Cook County State's Attorney EDWARD V. HANRAHAN, secureda search warrant, based upon information supplied byinformants, from Criminal Court Judge ROBERT COLLINS tosearch the first floor apartment at 2337 West MonroeStreet, Chicago, Illinois. It was alleged that there was
a gun cache in this apartment.
At 4:&5 a.m. on December 4, 1969, 14 officers fromthe State's Attorney's police broke into this first floorapartment, which consists of two bedrooms and one bath,with a front and rear entrance. They allegedly encounteredgunfire resistance; and following a shootout, FRED HAMPTON,Illinois Chairman of the BPP, lay dead in his bed andPeoria, Illinois, BPP leader MARK CLARK was found dead
in the living room of this apartment.
There were nine members of the BPP in this h7Papartment; and of the seven surviving, two men and two " *women had been wounded. Of the nine BPP members in theapartment, six were men and three were women. One woman,FDEBORAH JOHNSON, age 19, the alleged girl friend of HAMPTON,_ dJghe seven surviving members_ of the BF? were arresten - charged with attempted murderand aggravated battery and were taken into custody.

According to its oliiciul newspaper. the Black Panther
Party BPP! was started during December, [N66, in Oakland,
California, to organize black people so they can take control
of the life, politics, and the destiny of the black community.
It was organized by BOBBY GLORGH 5L92LL, HPP Chairman, and HULY
P, NLWTON, BPP Minister oi Driense. NEWTON is presently serving
a sentence of 2 to l5 years on a conviction of manslaughter in
connection with the killing of an Oakland police officer.
The official newspaper, The Black Panther," which further
describes itself as the "Black Community News Service," states
that the BPP advocates the use oi guns and guerrilla tactics
in its revolutionary program to end oppression of the black
people. Residents of the black community are urged to arm
themselves against the police who are consistently referred to
in the publication as "pigs" who should be killed,
"The Black Panther" issue of September 7, l968, contains
an editorial by BPP Minister of Lducation, Gb0RGE MASON MURRAY,
which ends with the following:
"Black men. Black people, colored persons of America,
revolt everywhere; Arm yourselves. The only culture worth keeping
is u revolutionary culture. Change. Freedom everywhere.
Dynamite! Black Power. Ue the gun. Kill the pigs everywhere."
Included in the introduction to an article appearing
in the October 5, 1968, edition of "The Black Panther" is the
statement, .....We will not dissent from American Government.
We will overthrow it."
Issues of "The Black Panther" regularly contain
quotations from the writings of Chairman MAO Tse-tung of the
People's Republic ot China and feature lA0's statement that
political power grows out of the barrel of a gun."
The national headquarters of the BPP is located at
3106 Shattuck Avenue, Berkeley, California. Hranrhes have been
established at various locations throughout the United States,

Conversation with Illinois State Senator Charles Chew,
Jr., December 8, 1969 at 9:30 sun.
Senator Chew came to Washington on behalf
of 10 black Illinois legislators. These people have
conducted a limited investigation into the Panthers
shootings and have concluded that an impartial full
investigation is needed. He came to Washington to
ask the Department to conduct such an investigation;
another member of the group is going to Springfield
to ask the State Attorney General to investigate.
The group's investigation indicates that
Fred Hampton, Chairman of the Chicago Chapter of the
Black Panthers, was shot by a machine gun while sleeping
in bed. The police got access to his bedroom window '
by means of a ladder. The group examined physical
evidence at the scene and it appeared to them to indi-
cate that Hampton was shot in bed. They also had an
autopsy performed on Hampton's body.

Senator Chew said that these officers are Chicago
policemen detached from regular duty for service with
the State's Attorney's office. he says that they are
political appointees.
Senator Chew provided the following investiga-
tive leads. The autopsy on Hampton's body was performed
at the A.A. Rainer meral Home, 320 E. 7lst St.,
Chicago. He does not recall the" doctor's name. Mr. Rainer,
who is a Chicago alderman and "who can be contacted at
the above address, can provide information, as can

Rush, who was arrested in the raid, and Deborah LNU,
who is in the Cook County Hospital and under arrest,
can provide information, as can the other Panthers who
were arrested.
I asked Senator Chew if the Black Panthers would
cooperate with white FBI agents or white Departmental
people. He said they would cooperate with any represen-
tatives of the Department of Justice, although they

might not be too happy with the FBI.
Senator Chew made it clear that neither he nor
. his group was concerned with the policy or philosophy
of the Black Panthers. They were concerned with the
. methods used by the police involved. he and his group
are not concerned with the outcome of an impartial
investigation. They are concerned that there be an
impartial investigation. He said the situation in
Chicago is quite explosive. He and his group have kept
the lid on by promising to get an impartial investiga-
tion.

This is the case involving a raid by officers of the Chicago
Police Department on Black Panther headquarters 12/4/69, during which
two Black Panthers were killed and others were wounded. The Civil
Rights Division of the Department requested investigation based on I If/9/9
allegations the killing and shooting of members oi the Black Panther
organization were unnecessary and imjustified.
SAC Johnson of the Chicago Office contacted police officials
regarding interviews with subject officers. SAC Johnson was advised by
State Attorney Edward Hanraban formerly U. S. Attorney! he would make
the police officers available for interview only if an official from his office/'
were present during the interview and copies of the results of the interview
were made available to him or the officers interviewed.
_' SAC Johnson of Chicago contacted Attorney Warren Wolfson, /92/A
who represented one of the Black Panthers. Wolfson stated as charges
had been made against his client he would insist on being present during
interviewand would insist on a copy of the results of the interview. He
advised charges were also pending against other members of the Black
Panthers and all the victims were either in jail or in custody at the county
hospital with the exception of one. He felt sure the attorneys representing
the other victims would insist on being present and expect to receive a copy
of the results of the interview. Wolfson stated he would consult with theother attorneys and advise SAC Johnson. To daét%iiIohnson has not been icontacted by Wolfson or the other attorneys. RE _ géfaa ___
In connection with the Department's request for investigation of
the premises where the shooting occurred, it is noted these premises arle
under the complete control of the Black Panther Party. The attorney for
the Black Panther Party stated he saw no objection to making the premises
available for examination but desired to consult with other attorneys andwould advise the Chicago Office of their decision. He indicated he or his E ,~

representative would have to be present while the premises were being
inspected. To date this attorney has not contacted the Chicago Office
regarding permitting access to the apartment.
The position of State Attorney Hanrahan andlthe attorneys for the
victims and the Black Panther Party was discussed with Deputy Assistant
Attorney General James Turner, Civil Rights Division, on December 15, 1969.
It was pointed out that the position of these attorneys would preclude a full and
free investigation by the Bureau into this matter and it was strongly suggested
that the Department should consider immediately calling a Federal Grand Jury
to inquire into this matter so the victims, witnesses and subjects could be
subpoenaed before the grand jury and be afforded an opportunity to make a .'
complete statement under oath. Mr. Turner stated he would take the matter
into consideration and would discuss it with Assistant Attorney General Leonard
later in the day on December 15. Mr. Turiuer noted that Leonard was unavailable
at that time.
Turner advised that Illinois State Senator Charles Chew, Jr. , had
been to the Department on December 8, 1969, on behalf of 10 black Illinois
State Legislators. These individuals had conducted a limited investigation into
the Panther shootings and concluded that a full, impartial investigation was
needed. Turner made available a memorandum reecting information provided
by Chew to a Departmental attom-5;. This was furnished for possible assistance .
of the Bureau in conducting any investigation. V
Turner subsequently advised that the matter would be taken up with
the Attorney General Tuesday and we would be advised of the results thereof.

possible before a Federal Grand Jury in Chicago. Leonard said he planned
to proceed to Chicago Thursday morning and wanted to have a preliminary
conference with SAC Johnson prior to his desired meet with Chief Judge
William Campbell. In our presence he called Judge Campbell's office and
was advised of his illness whereupon he was asked to be transferred to
Federal Judge Richard B. Austin, who was acting in Campbell's temporary
absence. Leonard advised Judge Austin of his desired meet on Thursday and
a mutually convenient time was set for 10:30 a. m. Thursday morning.
Leonard indicated he intended to explain the entire situation to the Judge
and get his views concerning the handling of the grand jury and would rely
on the Judge's assessment of the situation insofar as the need to advise
Judge Campbell of the developments. Leonard plans to have a group of
attorneys from Washington assist him in connection with the handling of this

matter and has indicated the Attorney General desires that he personally
handle the presentation. In addition, United States Attorney Tom Foran
is expected to be in Wadiington tomorrow to personally confer with the
Attorney General, at which time he will be advised of the Department's
views. It is assumed the purpose of this meeting is in deference to the
prerogative of the U. S. Attorney and in view of the fact Foran is personally
handling the trial of the seven defendants in the Antiriot cases arising out
of the Democratic National Convention in August of 1968.
ACTION TAKEN:
It would seem the action of the Attorney General in calling a special
Federal Grand Jury to handle the presentation of the Black Panther case is
well advised. SAC Johnson has been alerted to the above facts and he has been
instructed to confer with Assistant Attorney General Leonard prior to the
conference with Judge Austin on Thursday morning. You will be advised of
additional developments.

On December 4, Fred Hampton, Illinois chairman of the
Black Panther Party, and Mark Clark, a member of the party,
were shot to death when police assigned to the State's
Attorneyls Office attempted to serve a search warrant in an
apartment believed to contain illegal firearms. Six other

"There have been serious allegations raised criticising
police tactics," Mr. Mitchell said. "A number of responsible
citizens have questioned whether this incident may have
involved a denial of federally protected rights92"
"I agree with U. S. Attorney Thomas Foran of Chicago
and Assistant Attorney General Leonard that the only way to
answer these questions and these fears honestly and fairly
in to conduct this special federal inquiry. Accordingly,
I have picked a team of experienced government attorneys
to work with a grand jury and to develop the facts in this
case. I hope that all who have personal knowledge of this

Hr, Mtchell said that the grand jury investigative
approach 92 with the subpoena power -- was suggested during
Ieetings between Mr. Foran, Mr. Leonard and the Attorney
4 General. Mr. Poran agreed to provide a member of his staff
92 to serve on the investigative team and to provide assistance
1 to the team during the course of its investigation.

-- James P. Turner, Deputy Assistant Attorney General
' for Civil Rights. ~Mr. Turner, 39, a native of Colorado,
joined the Civil Rights Division as a trial attorney
February 24, 1965, and participated in many grand jury
investigations and prosecutions of civil rights violations
including some in Bogalusa, Louisiana; Jackson, Mississippi;
Selma and Montgomery, Alabama and Chicago, Illinois. _

Mr. O'Connor, 38, a native of the District of Columbia,
first joined the Justice Department as a trial attorney
in the Tax Division in June of 1961, transferred to the
Job Corps in 1965 and returned to the Civil Rights Division

prosecutions of both tax and civil rights violations,
he won special commendations. ' ~> -
-- Jesse H. Queen, a senior trial attorney in the
Civil Rights Division's Criminal Section. Mr. Queen, »
46, a native of Kansas.City, Kansas, first joined the I
Justice Department as a trial attorney in the Civil
Division in May of 1962 and transferred to the Civil
Rights Division in April of 1965. As chief of litigation
for the state of Louisiana prior to the division's recent
re-organization, Mr. Queen appeared in court for the
United States in all civil rights cases in the area
during a three-year period.
-- Milton C. Branch, Assistant U. S. Attorney for
Colorado. Mr. Branch, 49, a native of Chicago, joined
the U.S. Attorney's office in 1963 and has been involved
in a large number of grand jury investigations and
prosecutions. In 1965 Mr. Branch investigated a number
of'Mississippi civil rights violations for the Department.
Earlier this year, he temporarily joined the staff of
the U. S. Attorney in Brooklyn, New York, to prosecute
crininal cases and help clear a big backlog of cases.

appointment.
-- Maceo Hubbard, the Acting Chief of the Criminal
Section of the Civil Rights Division and a Supervisory
Trial Attorney.
Mr. Hubbard, a native of Pennsylvania, has been
with the the Department of Justice since 1946. He was
with the old Civil Rights Section of the Criminal Division
from 1946 to 1956; and from 1956 until his retirement last
year he was with the Civil Rights Division where he was
Chief of the Eastern Section. '

WAS CONDUCTING INVESTIGATION REGARDING THE SHOOTING
INCIDENT AND DESIRED TO KNOW IF FBI COULD "HAVE AN
OBSERVER PRESENT, DURING ALL PHASES OF THEIR INVESTIGATION
HE WAS ADVISED THIS WOULD NOT BE POSSIBLE AT WHICH TIME

Panther Party BPP! headquarters by Chicago
police officers on l2/4/ 69. Attorney for BPP
advised SAC, Chicago 12/17/69 that attorneys
I01 BPP and victims had decided Justice
Department could not help them and therefore
they would not cooperate with any FBI
investigation.
The Attorney General has instructed
Assistant Attorney General Leonard, Civil
Rights Division CRD!, handle presentment
of this matter to Federal Grand Jury in
