EXTORTION - THREAT TO THE PRESIDENT
Swwmm Assistant Prosecutor, Camden County, N.J., advised
that a review of the local statute books and the criminal
code for Camden County, N.J., does not give his office any
jurisdiction to move against LIVEZLY, as the mailing of the
extortion letters in ns case involve a Federal violation and
not a local violation. Information from Security Officer,
Radio Corporation of America, Camden, N.J., on 10/25/67, dis-
closes that no action taken against LIVEZLY for a physical
examination either by the Company or by the Industrial
Security Office, Columbus, Ohio. LIVEZLY still has secret b6clearance at RCA. On 10/25/e7,|_ | ;b7c[:::::::]RCA, Camden, N.J., indicates that Company will make
immediate arrangements for psychiatric examination of LIVEZLY.
The FBI Lab concluded that the typewriting on the letter,and
envelope of the extortion letter to CARDINAL JOHN KROL,
at Philadelphia, Pa., was prepared by the same typewriter
that prepared the other extortion letters in this matter,

On September 26, 1967, First Assistant Prosecutor
ALBERT SCARDUZIO, Camden County, New Jersey Prosecutor's
Office, Camden, New Jersey, advised the writer that he does
not feel that LIVEZLY has violated any criminal law in
Camden County, New Jersey. SCARDUZIO advised that he will
review the New Jersey State Statute books and will advise if
he can find any violation of local.law under which.LIVEZLY

Gn September 26, 1967, Assistant Prosecutor
SCARDUZIO recontacted SA PHILIP J. CARROLL and advised
that he is willing in any manner to offer assistance to
the Federal Government in order to have LIVEZLY committed.
SCARDUZIO advised that a review oi the New Jersey State _Statutes and the criminal code for Camden County, New Jersey,
does not give his office any jurisdiction to move against
LIVEZLY, as the mailing of the extortion letters in this
case involve a Federal violation and not a local violation.
SCARDU%IO advised that as there is no local
criminal violation, his office is unable to take any
action against LIVEZLY. He pointed out none of the Victims
_reside in Camden County.
Mr. SCARDUZIO advised that the only action
available locally would be for one of the individuals
whose names were used on the letters sent by LIVEZLY to
come in and sign a complaint against LIVEZLY for Defama-
tion of Character. SCARDUZIO advised that this is a
civil tort action and under this type of action, it would
not be possible,for Camden County authorities to order
LIVEZLY to be given a mental examination.
The matter would be handled in civil court to
determine the amount of damage to the character of the
complainant as the result or the letter or letters, and
if LIVEZLY were convicted, he would be given a fine by
the court.

am en, new ersey, advised that the company doctor has
recommended that LIVEZLY be givenan examination by a
private psychiatristgaid for by the company to determine
his sanity .

to the company union and they are in agreement that this
be done. The union has suggested to LIVEZLY that he con
sent to the examination by a private physician paid for
by RCA, Camden, New Jersey.

will consent to this examination. He advised that it has
been the company's experience in the past that when such
an examination is afforded, the private psychiatrist is
careful in his evaluation and he will probably not judge
the subject as insane as tie is regarded as almost impossible
to establish with one visit.
[:::::::::]advised that the examination may causea transfer of LIVEZLY to another division of the plant,
but he does not believe that it will result in the releasing
of LIVEZLY from his employment on medical leave and it
most certainly will not accomplish the commitment of
LIVEZLY to a mental institution.
advised that the final arrangementsfor such a physical cannot be accomplished by the company
immediately, and he does not feel that LIVEZLY will be
given the examination for at least a month.
On October 2 and 17 1967 advised I 7that no arrangements have been made as yet for LIVEZLY
to be given a physical examination by the company. [:::::::::]
stated that he has not received any further communication
in regard to LIVEZLY from the Industrial Security Oice,
Columbus, Ohio, and that LIVEZLY still has a secret clearancej
with that company.

physical examination and that no action in regard to
LIVEZLY has been taken by the Industrial Security Office,
Columbus, Ohio.

Swwmm Subject given Psychiatric examination by RCA, Camden
NJ. Examination disclosed that LIVEZEY has some emotional
problems but psychiatrist does not consider LIVEZLY to be
dangerous, a menace to society, or incapacitated for work.
Psychiatrist recomended psychiatric treatment for LIVEZLY
whthh he felt would be helpful in helping LIVEZLY to overcome
his emotional problem. LIVEZLY has agreed to take the
psychiatric treatment and he is to be continued as an employee F
