BKCKE?-{IIND FLCTS .
It is alleged that the/!5rogressive line Iorkers of America Union___ _was formed in 1932 as a revolt against an effort by John L. Lewis to force a 92
the stronghold of the United Mine Iorksrs of America Union. A referendum 0!
the miners had rejected the reduced scale. During a second referendum, the
ballot boxes were mysteriously ltolen and Lewis declared an emergency and ,
Bigned an agreement with the mine operators. It was stated that 25,000 miners
revolted against this agreement and set up a new organization called the .
Progressive Mine Workers of America, which g-ew rapidly and soon dominated ,
the entire State. It is alleged that Lewis bitt__er1y swore to n back the
lost territory and break the rebel union. It was also stated that Nine B
was the stronghold of the Prog-eesive Mine Io:-kers Union and was located in
Springfield, Illinois, Lewis former home and present legal residence.reduced wage scale upon the miners in Illinois, which theretofore had been !

bitter struggle for supremacy was carried on between the Progressive Mine
Workers Union and the United iiine Workers of imefii, involving in-eh violenri.
In Hay, 1937, it was stated that the Progessive lline Iorkers discovered that1.4 of its members were paid spies of the United Mine 1iorkers.92 Upon Elshoff'e
refusal to fire these ll. individuals, a strike was called and the mine was
closed. The mine remained closed until November, 1939, 2} years later. It
was alleged that during this period, the United Mine Workers paid Elshoff
$150,000 in sums ve-vying from £1,000 to $20,000. It was further stated that
during this period and coincident with the payments of money, Elehoff was sus-
pected of unfair labor practices against the Progressive Mine Iorkere. Lfter
the mine opened, the United liine iorkers continued the payments to Elshoff
until the total of $225,000 me been paid. It was also stated that in
August, 1937, Elshoff recognised and signed a collective bargaining agree-
ment with the United Mine Tiorkers, even though at that time they were in
the minority and did not have enough members to operate the nines,
Allegations have been made that during the period that line B was
out of operation, the United Mine Workers proselvted the members of the
Prog-essive Kine Iorkere, which, coupled with the alleged unfair practices
and deprivation of rights imposed by s;1ehoii, resulted in the United iiine
Iorkers gaining a majority membership by mid-summer of 1940. The United
ltine orkers petitioned the National Labor Relations Board for an election .

The Department did not advise as to what the National Labor Relations
Board investigation developed as to the existence of unfair labor practices;
however, it stated the National Labor Relations Board file was being reviewed
and investigative leade developed from such a review would be forwarded to
the Bureau immediately.
SCOPE OF DEPA.R11[tNT'S REQUESTED INVETIGATION .__
The Department in its wmc:'a.r-dun dated Jill;- 24, L7 , sets Icrth
ten pages of requested investigation in the captioned matter which cover all
of the elements oi the alleged violation in this matter. Le an example, it
is noted that the Ibpartment sets forth eighteen incidents which it states
should be thoroughly investigated and which are alleged to be unfair labor
practices indulged in by Carl H. Elebofi. It is noted that the existence
of unfair labor practices in violation oi the Rational Labor Relations Act
is basic to proving am; violation oi Section 51, Title 18, U, S. Code.
Although the Department statee John L. Levi! admits the existence of pay-
manta or Floansi by the irdted Kine iorkere Union to Elehorf, it em. :1.»-+t
be necessary to Show that there nae a definite deprivation of rights £01110-
teed to the members of the Progressive Nine Iorlmrs Union during 1937 to
1941 prior to establishing that the payment was made with the intent to
cause Elshoff to impose unfair labor practices upon hie employees.
It is also noted that the Department requests that the actual cost
oi the operation of lline B for the period during which it was idle be as-
certained sc that it may be determined if Elshcff was paid more than the
actual cost or such operation.

the Progressive line Iorkers Union during the period 1937 to 1941 be inteb
viewed to ascertain which of those individuals believed they were subjectedto a deprivation of their rights. ,

It is noted that should a grand jury be directed to investigate
the above entitled matter, all witnesses could be required to testify under
oath, and it is conceivable that such a procedure nigat be preferable to
M1.d_ng Agents interview witnesses in the eld where they would not be under
oath,
It is observed that the Ibpartment states it is reviewing the
files of the National Labor Relations Board and will forward this material
to the Bureau in the immediate iuture.
It is also noted that at 3:30 pm on July 26, 1943, llr. Frank Cole-
man of the Civil Rights Section of the Bspartment, called at the Bureau
and discussed this case with Supervisor Franlr Ls !eleh.- lL'. Golan-an stated
he recently conferred with the attorney General on this case and indicated _
his desire to have the Bureau handle the investigation. According to llr.
Coleman, the Attorney General remarked to him that the FBI was always hesitant
to take over an investigation after it had been handled by another Federal
agency. Coleman then remarked to llr. Biddle that he definitely thought tin
Bureau should be asked to conduct the investigtion.

Inasmuch as witnesses before a grand Jury testify under oath, you
may desire te recommend to the Department that the investigation in this
case be conducted by a Federal g'l.nd Jury. In the event it is not desired
to recommend the use of e Federal grand Jury in this matter, it is recon-
mended that the requested investigation by tin Department be instituted
immediately upon the receipt of further information from the Department
as disclosed in the files of the National Labor Relations Board and the
Internal Revenue Department. .

reason he desires to make photostatic copies available to us. Hr. Coleman
has ascertained that it would take approximately one week to have this
material photostated in the Department, and he stated that in view of this,
he would like to know if the Bureau would make photostatic copies of the
exhibits for its use and than retum the documents to him. In this con-
necti9n_I advised him that the backlog on gur_photostatic worE was such thatit would be imggssible to photostat these docunents within the near future and

copies prepared and make thm available to the Bureau. He stated that this
would be done.
Hr. Coleman made reference to that portion of the Department's memorandum
which indicated that in Hay, 1937, the Progressive line Workers discovered
that several of its members were paid spies of the United Mine Workers Union,
and when the operator of the mine in question refused to discharge these
individuals, a strike was called and the mine was closed. Hr. Coleman
thought it would be advisable to interview these particular persons at the
beginiing of the investigation. He stated that there were several other
persons who he believed should be contacted at the very beginning before the
report was circulated that the FBI was conducting inquiries into this matter.
I advised Mr. Coleman that in any investigation conducted by the Bureau, the
circumstances in the case were carefully evaluated and that consideration was
give: to the order in which the various individuals involved were to be
interviewed.
During the interview Hr. Coleman statedgthat even though a viQla§iQn_QIue CivilfhightsStatutesjlwe§ta§II§EEd,he is in no position tozstate whether
the President will authorise any_prosecution agsinstifewis at sons razuge size.
He stated that he felt this was a very important case inasmch as tne*rs&1 ln
issue at hand appears to be whether one union can make payments of money in
such a manner as to destroy a rival union. He also comented that from dis-
cussions he has had-with labor men, he does not believe that the CIO will
"push" this case against Lewis because of their fear that they will be accused
of "knifing him."

morning of July 29, 1943, with reference to the investigation pre-
viously requested by the Attorney General in connection with the above-
entitled case. I suggested to Mn Carusi that it was the Bureau:opinion that this matter was one which should be and could be properly
handled more aduontageouely' by a grand jury inquiry. I pointed out to

President about this, and the Presient insists that the
FBI make the investigation. Accordingly, the Attorney
General has asked me to confirm his prior instructions
that the investigation be conducted by you rather than
by e grand jury.

of smday, August 8, 1943, carried an article bearing a spring-
field date line saying it had been leamed from a reliable eouro

It is obvious from the facts that we new know that during
the period 193'? to 19-£1, El shoff and the Mine "B" Coal Ccmpeny
expended large sums of money for legal fees and expenses in the
various proceedings before the ctional Labor Relations Boa-F6
and in the Circuit Court of Appeals, in the effort by El ehc
to avoid his obligations under the Rational Labor Relations
Act. There also must have been substantial sums expended for

proceedings in the Federal Court in November, 1937-
It is believed, of course, that all of these expenses
were financed out of the sums which were advanced to Elshoff
Lewis and Edmundson, and that the latter two subjects must
