U. S. Magistrate OIEA JURCO, NDI, Chicago, Illinois. At
that time LEVIN was represented by Attorney EDWARD CALIHAN
who advised U. 8. llagistrate JURCO that his client waiveda preliminary hearing. LEVIN was then released by U. S.
llagistrate JUBCO on a $15,000 Own Itecognizance OR! bond.
At that tine, Iagietrate JURCO bound this matter over tothe Jurisdiction of the USDC. .
On April l8, 1974, SAP InternalRevenue lervice IRS!, Chicago, linois, was contacted byNi concerning this investigation. At thattime, 8 advised that LEWIN's activities would be
checked with regard to IRS jurisdiction.

merchandise consisted primarily of cigarette lighters but
also included cuff links, pens, and other miscellaneous
jewelry.
At that timgexamined the items obtained
by the Chicago Division on April 17, 1974, form the
Universal Gem and Jewelry Company, Incorporated, room 604,
5 North Wabash Avenue, persuant to the issuance of a search
warrant by the United States Magistrate, Northern District
of Illinois NDI!.

was represented by his attorney EDWARD CALLAHAH.At that time Mr. CALLAHAH pointed out to the- court that he only had a very short opportunity
to review the report of United States ProbationCfficerCHARLES MARTIN which has been preparedand was the basis for the Government's motionfor revocation of probation. At that time JudgeLYNCH continued the hearing until 2:00 p.m.that afternoon. .

On lay 22, 1974, ADOLPH LRIIN appeared beforeU. S. District Court Judge IILLIAM LYNCH, HD1, Chicago,Illinois. LEIIN,at that tine,appeared in response toa Government notion for revocation,of probation andduring this hearing took the stand in his own behalf.LEVIN, at that time, testified in open court to the effectthat the stolen property recovered from his premises byAgents of the FBI on April 17, 1974, had been left thereby JACB CORN. It is noted that COHEN, subsequent tothis alleged incident, was shot and killed by BuAgentsand Milwaukee, Iisconsin, police officials in the latterpart of February, 1974. Judge LYNCH, after hearing theGovernment's notion and LEIIN's testimony, immediatelyrevoked LIIIN's probation and ordered his to the custodyof the AG for a period of 90 days.

On June 14, 1974, the facts concerning thisinvestigation were presented by 81- to the FederalGrand Jury FOJ!, II, Chicago, Illinois. U. S. Departmentof Justice Attorney CHARLES IBHNRR, who handled this
presentation, avised that no vote'would be requested oithe IGJ concerning this matter until June ll, 1974.
On June ll, 1974, the IGJ, I01, returned a truehill with a three-count indictment charging ADOLPH LEVIN
with violations of Title 18, U. 8. Code, Sections 2315and 1962 c!.
On that date, the U. 8. Government entered amotion for a restraining order and the establishment oia performance bond with regard to ADOLPH LIIIN, dba UniversalGem and Jewelry Company, lnc., loom 604, 5 North Wabash.On that same date, UBDC Judge IDIII A. ROBSON issued the
restraining order and establishment of a formance bond

Re Chicago nitel to the Bureau dated 11/4/74,
captioned as in the LEWIN matter.
On l2/17/74, subject appeared in U.S. District
Court, Northern District of Illinois, Chicago,I11inois,
before Judge ROCHARD B. AUSTIN. At that time, subject was
sentenced to the custody of the Attorney General for a
period of five years on each of the two counts which
sentences were to run concurrently. Imposition of sentences
suspended and subject placed on probation for a period of
five years, of which he is to be incarcerated for the first
177 days thereof. At that tine the execution of this
sentence was stayed until 1/3/75.
According to AUSA, NDI, Chicago, Illinois, he has
no indication as to whether or not LEWIN plans an appeal in
these matters. .
Bureau and Dallas will be kept advised of all
pertinent developments. -

PROPERTY MAJOR THEFT
On ll/H/7H, after two day jury trial, ADOLPH LEWIN found
guilty of two count violation of Title 18, Section 2315, USC.
Three counts concerned stolen jewelry, of the Hammond Company
and the LIBERACE watch, which items were taken in separate
burglaries in Dallas, Texas, in February, 197M. On 12/17/7h,
in USDC, NDI, Chicago, Illinois, LEWIN sentenced to custody
of AG for a period of five years on each of the two counts,
which sentences were to run concurrently; imposition of the
sentences suspended and subject placed on probation for a
period of five years of which he is to be incarcerated for
the first 177 days thereof. LEWIN scheduled to surrender
himself at the U.S. Penitentiary, Marion, Illinois, on 1/17/7H
Departmental attorney authorized the return of all recovered
jewelry to their rightful owners.

On November R, 197k, after a two day jury trial,before U.S. District Court Judge RICHARD B. AUSTIN, NorthernDistrict of Illinois NDI!, Chicago, Illinois, ADOLPH LEWINwas found guilty on two count violation of Title 18, Section231%, U.S. Code. These counts concerned LEWIN's possessionof stolen jewelry of the Hammond Company, San Antonio,
Texas, and LEE LIBERACE's watch, which items were taken inseparate burglaries in Dallas, Texas, in February, 197k.
At that time, U.S. District Court, Judge AUSTINset December 17, 197k, for sentencing of LENIN.
On December 2, 1974, U.S. Department of JusticeAttorney GREGORY WARD advised that to date he has not re-ceived any indication as to whether or not LENIN plans anyadditional legal action concerning his convictions.
On December 17, 197%, the subject appeared beforeU.S. District Court Judge RICHARD B. AUSTIN, Northern Distriof Illinois NDI!, Chicago, Illinois. At that time, LEWINwas sentenced to the custody of the Attorney General for aperiod of five years, on each of the two counts, which
sentences were to run concurrently. Judge AUSTIN furtherordered the imposition of these sentences suspended andplaced LEWIN on probation for a period of five years ofwhich he is to be incarcerated for the first 177 days.Ct
_ Judge AUSTIN, at that time, also ordered theexecution of this sentence stayed until January 3, 1975.
On January 6 1975 Deputy MarshalChicago, Illinois, advised that LENIN's stay has been con-tinued until January l7, 1975.
On January 13, 1975, U.S. Department of JusticeAttorney, GREGORY WARD advised that he has received noinformation which would indicate LEVIN plans an appeal inthese matters. Departmental Attorney WARD further advisedthat it is his understanding LENIN will be incarcerated inthe U.S. Penitentiary, Marion, Illinois.

Chicago, Illinois, advised that his office has not received
any inquiries regarding LEVIN which would indicate LEWIN has
surrendered as ordered by the court.
' On January 20, 1975, Departmental Attorney GREGORY
WARD, Chicago, Illinois, was recontacted at which time he
advised that the stolen jewelry recovered during this invest
gation may be turned over to the rightful owners and the
unidentified items still in the possesion of the Federal
Bureau of Investigation FBI! may be turned over to the In-

It is noted that at the time of LEWIN's
indictment, the Government entered a motion for a
restraining order and establishment of a performance
bond concerning LEWIN. In this motion, the Government
pursuant to Title 18, United Statés Code USC!,Section 1963, moved that an order be entered in joiningand restraining LEWIN, his officers, agent, servants,
employees, attorneys, and other persons during the
pendency of this proceeding and until further orderof the court from the follouing:
l. Selling, transferring, leasing, pledging,encumbering or otherwise disposing of any rights,titles, or interest in or to any goods, titles,chattels, fixtures, whether real or personal,
owned, operated, held or used by the defendant in
connection with the retail and wholesale
sales and manufacturing of jewelry by Universal
Gem and Jewelry Company, Incorporated. The fore-
goint property or interest therein shall includebut not be limited to jewelry, gems, precious
metals, coins, presses, molds, smelting equipment,safes, display cases, furniture, contracts, accounts
receivable, shares of stocks or other evidence of
ownership or interest in such property or any
entity having rights, title or interests in such
property.
It was further moved that the court
appoint a duly qualified appraiser and authorize
and direct said appraiser to appraise and take
inventory and accounting of all the values orall of the above-described property or interest

2. Under the aforesaid statutes, as provided
in 18, USC, Section 1963 b!, this court has
Jurisdication to enter such restraining orders
or prohibitions and to accept satisfactory performancebonds, as it shall deem properg I
3. That, pursuant to provisions ofTitle 18, USC, Section 1963 a! and c!, defendant,
upon conviction herein, is subject to the forfeiture
of any property or interest acquired or maintained
in violation of Title 18, USC, Section 1962 andin the interest in, security of, claims against,
or property of contractual right affording a source
of influence over the enterprise being conductedthrough the pattern of racketeering activity.
4. _It is necessary, desireable, and
appropriate in the interest of Justice and in orderto afford the United States the full, fair and completerelief to which it is entitled that the defendant
be restrained to dispose of the aforesaid properties
or interest in derogation of the forfeiture
proiisions referred to above, and that defendantbe required to give such adequate security as
will insure'compliance with such restraining order
and protection of the rights and entitlements of
the United States and the public in these presents.
Subsequently, a court order was entered
in connection with the above-described motion and
at that time, the Jewelry firm of Robert E. Donnellywas appointed by the court to conduct the appropriateappraisal and to take inventory of LEWlN's property.
Subsequently, but prior to making an appraisal
Of LEWIN's property, DONNELLY, for personal reasons
was excused from conductmg the ordered appraisal
and inventory, and the United States Customs Service
was then ordered to make an inventory of LEWIN's
property prior to the court's appointing a nea
appraiser to this matter.
On June 12, and l3, 1974, the United States
Customs Service inventoried the merchandise in the
possession of subject LEWIN. At that time, a small
portion of this merchandise was still located atLEWIN's office, Suite 604, 5 North Wabash Avenue,
Chicago, Illinois. A larger amount of jewelry was

By communication dated August 2, 1974,
the Dallas Office of the FBI was advised that
investigation at Chicago, Illinois, had failedl to develo an information which would indicatev s involved in the instant
investigations.
By communication dated August 28, 1974,the Dallas Office was advised that according to
United States Department of Justice Attorney
GREGORY WARD that on or about September 3, 1974,
there will be a status report rendered in United
States District Court USDC! concerning the setting
of a trial date in the instant matter. At that
time, Departmental Attorney WARD advised the Government
anticipates dismissing the RICO charges against
LEWIN, inasmuch as the Government cannot establish
a pattern with regards to LEWIN's receiving stolen
property, namely jewelry, involved in the twoDallas burglaries .
On August 28, 1974, _ Revenue Officer,
Department of Treasury, Internal Revenue Service IRS!,
3720 North Kedzie Avenue, Chicago, Illinois, made
available a notice of levy concerning ADOLPH LEWIN
and/or JOYCE LEWIN, 2501 Hnbbleford Lane,
Glenview, Illinois. This notice of levy stated
that there is now due over and unpaid to the United
States of America from the taxpayer the amount of
$156,445.55.
5'10 At that time, Revenue Officer_served
the Department of Justice with a notice of seizure
regarding the jewelry obtained by the FBI from
LEWIN on April 14, 1974, which jewelry has not as
yet been identified as being stolen property.
Revenue Officer also at that time, madeSA stodian of this jewelry until
such time as it was or was not identified as stolen
property.
On September 5, 1974, in United States
District Court USDC!, Northern District of Illinois
NDI!, the Government withdrew the RICO counts
contained in the indictment Of LEWIN's. At that
time, the USDC set the date of September l6, 1974,
for the date to set a trial date in connection with
this matter. e

On September 6, 1974, the Internal Revenue
Service, Chicago, Illinois, seized LEWIN's entire
jewelry stock,_uhich they ultimately planned to
auction off to satisfy his outstanding debt.
On September 16, 1974, the subject's attorney
appeared before United States District Judge, RICHARD B.
AUSTIN, and at that time, a trial date'of October 15,1974, was set in connection with this matter.
~ IOn September 16, IQMP InternalRevenue Service, advised SA t at the subject's
income tax matter has been continued until September 18,
1974. According to this matter is being
handled by United States District Judge WILLIAM J.
BAUER.
On September 24, 1974, the income tax
matter was again held by United States District
Judge WILLIAM J. BAUER. At that time, LEWIN's
attorney entered a motion to restrain Internal
Revenue Service from disposing of LEWIN's jewelry.
The Government, at that time, entered a motion to
dismiss this case before Judge BAUER as there was
a case pre-pending in tax court.
At that time, United States District Judge
BAUER denied the defense's motion, and continued the
Government's motion to a later unspecified date.
